Dear Ms. Womhoff:
This office represents Fetco II, LLC. Fetco is the owner of Fossil Creek Nursery P.U.D.
located at 7029 South College Avenue, Fort Collins, Colorado. Adjacent to the Fossil Creek Nursery
property is Shenandoah P.U.D. Filing 1. When the Fossil Creek Nursery P.U.D. was approved, a
thirty-foot public access and utility easement was shown on the western edge of the Fossil Creek
property and was to continue across the Shenandoah property to a public street at such time as the
public street developed. When the Shenandoah P.U.D. First Filing Plat was recorded, Strausburg
Drive became the public street which the public access easement should connect to. The Filing Plat
contains an emergency access easement over and across Tract E, but not a public access easement.
In order to connect the Fossil Creek Nursery P.U.D. to Strausburg Drive, it is necessary to
create a thirty-foot public access easement over and across Tract E of the Shenandoah P.U.D. I have
enclosed for your review a legal description and drawing prepared by Land Star Surveying, Inc.
which shows the proposed location of the public access easement.
On behalf of my client, I am requesting the City of Fort Collins approve a public access
easement across Tract E to allow the intent of the original Fossil Creek Nursery P.U.D. plat to
become a matter of public record. It is my understanding the City of Fort Collins acquired ownership
of Tract E as a result of the dedication language in the Shenandoah P.U.D. Filing I recording plat.
It is my understanding upon my providing the legal description and drawing of the proposed
public access easement, you will prepare the appropriate easement for submission to the Fort Collins
City Council for review and action. I have not been able to verify that the legal description submitted
accurately creates a thirty-foot easement. If there are problems with either the drawing or the
easement description, please contact me immediately. Once you have created the easement, I would
appreciate the opportunity to review the document which will be presented to the City Council. If
there are no problems, please inform me when the item will be placed on the City Council agenda.

Seed Mix specification for restoration along the east side of College Avenue
Sheri,
As a part of the approved utility plans, we were to have a mitigation plan reviewed and approved
for the existing culvert, and specifically for the cleanup downstream of the existing culvert on
the east side of College Avenue. The general concept of this mitigation plan have been submitted
to the City, and verbally approved by all parties concerned. Kim Kriemeyer requested that we
provide a specific seed mix for restoration of the disturbed areas. The following represents the
mix that has been Used on the disturbed areas to the west of College Avenue in the remainder of
the Shenandoah project, and is the mix we will use also on the west side. This mix also has been
reviewed and approved by Bob Zachely of Stormwater Utilities.

RE: Access permit for Shenandoah P.U.D.
Dear 'I ess:
Attached is the application and State Highway Access Permit for an access point for Shenandoah PUD. This is a
new access that is located on State Highway (SIT) 287 approximately 2,650 feet North of County Road 32 on the
West side. This access will be a City Street (Triangle Drive) providing access into the proposed residential and
commercial development. I riangle Drive will also connect to Avondale Drive ( a north south street) which
currently connects to Trilby Road (CR 34). Avondale Drive is planned to connect to SI 1287 at CR 32 or connect
into the future extension ofCR 32 cast of SH 287.

Victoria Drive will become a right -in right -out access only -
Due to the location of Triangle Drive, the volume of traffic projected, and its proximity to Victoria Drive, a
median in Sl1 287 will be provided for channelization of the north bound left turns. This median, which
has been designed to extend 100 feet south of Victoria Drive in accordance with the ultimate design for
this intersection, will limit the Victoria Drive access to a right -in right -out only. The Victoria Drive
residents were nfonned of the restrictions of the access upon the installation of Triangle Drive and were
instrumental in determining the location of this access.
Fossil Creek Nursery access shall be reevaluated -
Fossil Creek Nursery's access permit, a temporary permit, was issued with the requirement that at the time
the property to the west was developed and it was possible to provide a public vehicular connection to the
public street system, it would be done. In addition once this connection is made the state highway access
permit is to be reevaluated and the access could be limited to a right -in right -out, limited to a right -in right -
out and left -in, eliminated or left as a full movement intersection.
In addition to the nhedian in SI 1287 the existing shoulders along Sl 1287 will be restriped to provide deceleration
and acceleration lanes for the access point (See Exhibit"6"). The plans also provide a preliminary design for the
southbound right turn lane which is needed for the access at the time that SH 287 is expanded to a six (6) lane cross
section (City's Major Arterial Standard). This right turn lane will not be built at this time; however a preliminary
design has been provided to guarantee the proposed development and current improvements would not preclude the
installation of the lane in the future.
Triangle Drive has also been designed such that if the number of cast bound left turns requires the need for dual left
turn lanes, the landscaped median in Triangle Drive can be eliminated or redesigned to accommodate the additional

RE Access permit and submittal for Shenandoah
Dear Tess:
A submittal for Shenandoah PUD was submitted for review on October 21, 1996. This development is
located west of SH287 and North of County Road 32. 1 had a few questions in regard to this development
and the States requirements.
The main access into the site (Triangle Drive) is located to the north of Victoria Drive and the north bound
left turn lane for this access point will extend past Victoria Drive eliminating the left onto Victoria Drive
from SH287_ We have, told the developer that they are required to place a median in SH287 because of this
conflict and to control the turns at this intersection. With this the Victoria Drive intersection will be limited
to a right -in right -out. Because of this does an access permit for Victoria Drive need to be submitted, or the
existing permit modified? Would the City be responsible for doing this'?
The traffic study for this development indicates that an acceleration lane should be provided at the
intersection of Triangle Drive and SH287. With the future three lane (each direction ) cross section would an
acceleration lane still be required by the State" Il is anticipated that this intersection will be signalized in the
future.
1 also have a question on the State Highway Access Code. What do you do when the number of turning
vehicles goes above the numbers shown in the chart. For example the traffic study for this development
shows that there will be 455 right turns at County Road 32. This is well above the 300 shown on Table 4.8.4
for Storage Length. Should the 250 feet for 300 vehicles be used'? Should this still be cut in half as can be
done for storage lengths for right turns? Or should the numbers be interpolated out for the 455 and then cut
in half?
1 would appreciate if you could answer these questions. I do not need an answer in written form leaving a

RE_ Shanendoah PUD; NW comer of Hwy 287 and County Rd 32
Dear Teresa:
I have been recently reviewing the Shanendoah PUD project with the State Highway Access Code and have a
fbw questions. The Shanendoah PUD is a residential and commercial project located at the northwest comer
of County Road 32 and Hwy 287 (College Ave). This project is proposing two access connections off of
I h\N 287 at this time and the possibility of a right -in right -out between these new access points in the future.
Using Section 4.7 of the State Highway Access Code both proposed accesses, the extension of Victoria Drive
and County Road 32, require right turn acceleration and deceleration lanes, but Section 4.7. Le of the State
Highway Access Code states that "Where there are three or more though lanes in the direction of travel, the
Depart ucnl will normal] drop the requirement for right turn acceleration and deceleration lanes. However
each case should be reviewed independently and a decision made based upon site specific conditions." Basec
on this in your opinion do these access points need right turn acceleration and deceleration lanes when Hwy
287 has a three lane cross section in both directions?
If the right turn acceleration and deceleration lanes are not needed than this next question will not apply to
this project, but I would like to get an answer for future reference. Is a light at an intersection considered a
'stop condition'?
If a light is placed at a intersection is a right turn acceleration lane needed? If no - at Victoria where a light
would not exist immediately would they need to provide an acceleration lane until the light is warranted?
What if Elie x-section is widened to three lanes before a signal is warranted?

Dear Mr. Curtiss,
In reviewing the approved utility plans for the Shenadoah PUD Filing One project with the Colorado Department of Transportation (CDOT) it was
noticed that the striping as proposed on the plans does not meet CDOT requirements. Therefore it is requested that the following changes be
made to sheet A2 of the Utility plan set and that a revised mylar be submitted for review and signatures. The State Highway Access permit can
not be completed until these changes have been made.
• In the typical cross section a 12 foot right turn lane/ future 12 foot through lane is being shown including the existing curb and
gutter. What is the width of this existing gutter? A minimum I I foot lane is allowed and the gutter can not be counted as a part of
the Zane width.
• Striping for the south bound right turn lane should be as follows: The 8 inch solid white channelization line should be a 4 inch solid
white shoulder line. Thie 10 inch solid white channelization line should be a 8 inch solid white channelization line.
• The south bound acceleration lane striping should be as follows: The 10 inch solid white channelization line should be an 8 inch
solid line for half the distance of the acceleration lane with the remaining half being striped in 4 inch skips.
• For the southbound acceleration lane the 8 inch solid white channelization line should be a 4 inch shoulder line.
• Show the proper signage that is needed in the median. General median signage and the signage necessary at the Victoria
intersection (indication one way travel only).

Dear Mr. Fulton:
Please accept my apologies for the tardiness of this letter. It seems the QuitClaim Deed form was
misplaced and didn't get signed by the appropriate City Officials. However, I have enclosed the Quit
Claim Deed from the City of Fort Collins, to Shenandoah Land Limited Liability Company with the
required City signatures. In order to expedite this process I believe it would be best to have the owner
record the document: and send a recorded copy to The City of Fort Collins care of the City Clerks office.
1 will begin the process for the refund of the $8.00 check you sent to the City prior to the City Council
hearing date.
