December 19, 2005 Mr. Marc Virata City of Fort Collins Engineering 281 North College Avenue PO Box 580 Fort Collins, Colorado 50522-0580 Re: Aztlan Subdivision — Request for Variance 1 — Willow Street (various) Proj: 203-25 Dear Marc: The following is a request for variance from the Major Collector Street Section (Figure 74F) and Section 7.7.4 (Drainage Over Sidewalks) in the "Larimer County Urban Area Street Standards, October 2002". These variances are related to the 215 linear feet of Willow Street frontage on this project. Willow Street is classified as a Major Collector Street. Presently there is curb and gutter on both sides, the street is 36' FL -FL and there is a 5' attached sidewalk adjacent to the existing Aztlan property. The street is platted as a 100' right of way. At this time, the City is in the preliminary design phase of the "Downtown River District Project" which will look at the infrastructure and streets in this area. The Aztlan Design Team will be meeting with Kathleen Bracke and her team in January to discuss what improvements they would like to see in this area. At this time, we are showing no major improvements to the street in this area. We are only showing moving the drive and replacing the existing drive with curb, gutter and attached sidewalk. The specific variance from the street section that is being requested at this time is to remove the requirement for the 9' utility easement behind the right of way. The proposed building has been designed with the southwest corner of the building on the right of way line. The existing building will remain during construction, so if the easement were required, the building size would need to shrink (it cannot be moved north while keeping the existing structure). We would like to request a utility coordination meeting for this site in January where we can request this variance from the utility companies. Because the street has an oversized right of way (100' of existing right of way and 66' required per the Standards), and because this is a City project with the City is able to allow utilities to be routed through the site if necessary, we feel that all utilities can be accommodated without the 9' easement. 700 Automation Drive, Unit I Windsor, Colorado 80550 970-686-6939 Phone • 970-686-1 1 88 Fax The other specific variance requested at this time is related to drainage down the proposed Aztlan driveway from Willow Street (crossing the sidewalk). Willow Street has very poor drainage throughout. The street is not crowned and the entire street flows to the northwest and presently drains down the Aztlan driveway and down Pine Street and into the United Way parking lot. We are proposing to keep the drainage going down the Aztlan Driveway. If we raised the driveway to keep this water in Willow Street, it would add to the drainage problems already present at Pine Street. For this reason, we would like to keep the existing drainage pattern and allow this small area to drain down the Aztlan driveway. These variance requests, if approved, will not be detrimental to the public health, safety and welfare. At this time, we agree with the potential work on the casement in concept and find no opposition with the proposed plans. Public Service Company of Colo will need finalized casement documents in place prior to the relocation of said 10" I.P. gas main.
