Variance Request:
• The request is approved as stated, but please retype the original request to
reflect the chosen solution and submit a final copy for formal approval for the
record.
Street Lighting Plan/Variance:
• Staff still needs to meet with the Traffic Engineer and Development Engineering
Manager to go over the following comments and to obtain any additional input on
the proposal. Providing the additional information requested below will help in
discussing the request further.
• Submit a specification, brochure, etc. to show what the proposed bollard lighting
will look like and what level of lighting they provide. The City's concerns are with
vandalism, maintenance and labor costs, and roadside safety (placement of the
bollard in relation to the curb).
• A standard residential street light should be provided on each cul-de-sac, not just
bollard lighting. This will be discussed further with other departments including
Police.
• Show and describe the lighting proposed internal to the community center area
and the multi -family areas. The private lighting proposed for these areas may
reduce the need for street lighting in these activity areas where safety is a
concern. Staff will review the proposal and evaluate if any additional street
lighting is necessary or not.
• There may need to be more lighting along CR 11 - for example at the Richard's
Lake intersection.
• Still have not seen an example or spec for the proposed house number lighting
with Hearthfire P.U.D. - assume the same is proposed in the Richard's Lake
project - please provide a spec/sample.
Utility Plans:
• Richard's Lake Road - Staff will be recommending to the Director of Engineering
that the improvements as proposed by the developer (connector street
widening, curb, gutter, and sidewalk north side) is acceptable and appropriate so
long as the drainage on the south side of the road can be handled without
impacting the existing properties. Is there a drainage ditch on the south side ?
Please address/show on the plans how drainage will be handled along the south
side of Richard's Lake Road.
• Redsail Place south of Morningstar Drive appears to be of a volume and
configuration that would meet the standards for a residential local access cross-
section if the developer wants to narrow it down.
• Is Somerset Place a connector or local width ? It can be a local south of
Morningstar Drive given the volumes and adjacent uses/configuration.
• Overall, the street network and classification works much better than the original
layout did.
Schooner's cove could also be a local residential cross-section - volumes for this
roadway were not shown on the traffic study addendum but are assumed to be <
1000
Adjustments to the multi -family area layout and configuration may be necessary
at final due to the needs of the utilities (separation, installation, and
maintenance).

Dear Mike:
As per your comments regarding the above referenced variance request as
submitted by Matt Delich on November 20, 1996, we have made revisions
to the plans as you suggested under Option #L Lot 279 has been eliminated
and left as open space. Also a commitment from the developer has been
made to provide street lighting at this curve. (A copy of the revised Site
and Landscape Plan is enclosed.)
Hopefully, this resolves your concerns and the radius and the variance
request can be approved.

Dear Kerrie:
As per your comments of December i6, 1996, for the above referenced development
proposal, we have made the following revisions:
I. 'fhe sails report has been updated by Terracon and a copy is attached for .a �
your review. The final pavement design will be completed at the time
of construction.
2. The Street Lighting Plan and variance request have been sent to Mr. Gary
Diede for review. A copy of the plan is attached for your review.
3. The Variance Request for the Minimum Centerline Radius on Whitesail Cove:
Per Mike Herzig's comments, Lot 279 has been eliminated and will remain
as open space. A street light has been shown in this location on the lighting plan.
4. A traffic study was submitted on December 20, 1996, to Mr. Steve Olt. An
additional copy is enclosed for your review as well as an update letter addressing
street sizing.
5. Morningstar Way (Richard's Lake Drive) and Morningstar Drive (Richard's
Lake Way) R.O.W. widths have been increased to 76' and will be built to the
collector street standard with on -street parking. Waxwing Lane, Somerset Place
and Schooner's Cove have been increased to a 57' R.O.W. and will be built
to the connector local street standard. (See attached street sizing letter from
Matt Delich.)
6. Richard's Lake Road will be built to a connector local street standard within
the existing 60' R.O.W. although the developer is requesting on behalf of the
homeowners on the south side of Richard's Lake Road that no curb, gutter or
sidewalk be required on the south half of the road.
7. Per your comment on the overloading of collector streets, we have added another
connection north of Morningstar Drive (Richard's Lake Way) to County Road 11.
This connection is shown on the O.D.P.
At the request of the neighbors on Richard's Lake Road, the developer had agreed
to limvt as much as possible any street connections to Richard's Lake Road.
Therefore, we did not extend Redsail Place out to Richard's Lake Road. Instead,
Redsail Way was extended out to C.R. 11 south of Morningstar Drive and 350'
north of the centerline of Richard's Lake Road. We feel this will accomplish the
same intent as extending Redsail Place because it will provide more direct circulation
to and from the southern portion of the property directly to C.R. 11. This connection
will be it 57' R.O.W. with a connector local road street section.
8. A "Context Diagram" showing the surrounding areas and transportation network was
prepared. A copy is enclosed for your use.
9. The O.D.P. has been revised to label the classification of the proposed streets.
10. The phasing of the Final P.U.D.s and required improvements will be determined at
the time it Final P.U.D. is submitted.

It. Morningstar Drive (Richard's Lake Way) has been widened at the intersection of
C. R. I I to provide additional turn lanes. By widening the R.O. W. and road, we
feel the median can remain.
12, All Utility Plan comments are being addressed by Intermountain Engineering and
you should have their revised plans
13. The developer will contribute his required contribution to construct County Road I 1
adjacent to the site to the City's minor arterial street standard with an 84' R.O.W.
Additional R.O.W. will be dedicated to the City to provide 'k the required R.O.W.
width (42') from the centerline of the read to the west.
14. Richard's Lake Road will be constructed to the City's connector local Street
Standard within the existing 60' R.O.W.
15. The Site Plan has been revised to show only crosswalks at critical locations. If these
crosswalks are to be stamped colored concrete, it will be determined at the time of
Final P.U.D. submittal.
16. Street cross -sections have been labeled to identify which sections correspond to
the correct streets. (These cross -sections are included on page I of the Site
and Landscape Plan.)
17. Note #6 has been removed.
18. Richard's Lake Drive and Richard's Lake Way have been renamed to Morningstar
Way and Morningstar Drive, respectively.
I've enclosed 6 copies of the revised Site and Landscape Plan; I copy of the soils report; I copy
of the Street Lighting Plan and Variance Request Letter; 6 copies of the Overall Development Plan;

Soils Report:
• All new projects submitted to the City after April of 1996 are subject to the
Engineering Department's new standards for soils reports (and final pavement
design at the time of construction). The soils report submitted is from 1986. A
new soils report, or an updated report, must be submitted in accordance with the
new criteria (copy available in the Engineering Department) by revision date -
1/8/97 for the project to continue to be considered for the January P & Z

traffic entering and exiting the site is all funneled onto Richard's Lake Way and
Richard's Lake Drive. To avoid the overloading of collector streets we see on
some existing collectors in the City, a second collector or connector street out to
County Road 11 is needed. Similarly, Redsail Place should be extended out to
Richard's Lake Road to provide more direct circulation to and from the southern
portion of the property. Part of the effort of the new street standards is to provide
multiple connections to a development, as well as connections internal to the
site, to disperse traffic and provide alternative travel routes.
• Due to the scope and scale of this project, it is strongly suggested that a context
diagram be prepared to show the surrounding area, transportation network, and
how this project is tying in to it (including Hearthfire P.U.D., adjacent county
developments and roads).
• The graphics of the O.D.P. are unclear as to the classification of the street
network proposed. Typically, O.D.P.s show collector streets but not local streets.
With the new street standards, it seems appropriate to show the entire network
to illustrate the connections being made. However, there must be some
distinction (varied line weight ?) to distinguish arterials, minor arterials, collectors,
connectors, locals, etc.
• Again, without a traffic study, there is no way to evaluate what improvements
(besides what the City Code requires) are necessary and when they are
triggered The developer probably wants to phase Final P.U.D.s and
construction within the Preliminary called Phase 1 as well as phased
development of the O.D.P. The traffic study needs to discuss improvements
needed in terms of this phasing as well as in terms of overall site buildout.
• If a future street aligns with Richard's Lake Way on the east side of County Road
11 as is typical with collector streets, there will probably need to be a combined
through and left and a right turn lane. The median/entry feature does not leave
room for these improvements in the roadway -

Lighting Variance Request:
• The "variance" request is simply a statement that the project would like a
variance to street lighting. It does not explain what variance(s) are proposed,
where the variance is proposed to apply, etc. Has there been any discussion of
specifics with the Director of Engineering that staff is not aware of ? Whatever is
decided with respect to any variance must be resolved before the project can
proceed to the P & Z Board.
Based on this same type of variance being worked on with the Hearthfire
development, the applicant should have some idea of what issues are
associated with this type of request and be able to submit at least a proposed
lighting plan for review along with an explanation of the reasoning behind the
proposed plan.
Variance Request Minimum Centerline Radius - Whitesail Cove
• See attached response
Traffic Study:
• No traffic study was received. There are many impacts that need to be assessed
before any discussion can take place regarding necessary on -site and off -site
street improvements, phasing of improvements, etc. as well as operational
issues. Because of the scope of the traffic issues and impacts on this project,
the traffic study is a critical element of this submittal. Since it did not come in
with the initial submittal, the project will likely experience delays in the review
process.
* When a traffic study does come in, it must include a breakdown of all proposed
streets and their proposed classification based on the criteria (e.g. projected
volumes, parking needs, etc) in accordance with the new street standards. Many
of the streets as proposed do not meet the functional needs associated with the
new street standards. For example, Richard's Lake Drive and Richard's Lake
Way must be built to the collector street standard with on -street parking since
there are lots that front on the street, a park (especially with proposed soccer
and softball fields), multi -family, and commercial uses adjacent to the streets.
The same is true for Waxwing Place and Somerset Place - they serve as
significant connections with on -street parking needs and/or have more intense
land uses adjacent that require a wider cross-section for parking and access.
- Be sure to classify Richard's Lake Road and discuss the proposed
improvements to that road (developers are obligated to improve both
sides of local and collector streets)

The improvements proposed along Richard's Lake Road and County
Road 11 are not clear. Again, it is difficult to identify potential conflicts
between utilities, street improvements, existing features, and/or proposed
landscaping. Cannot tell what the intent is for improvements to CR 11 or
Richard's Lake Road (r.ow. width, widening, improvements, etc.)
- The grading along the proposed detention ponds, and in all other
locations, must accommodate the detached sidewalk and at least 2 feet
at 2% behind the walk then a 4:1 slope to grade. (Also, be sure all
proposed detention and freeboard is outside of the public r.o.w.)
- It appears there is rear lot detention proposed. Typically, the City has
not allowed rear lot detention except for on a few infill sites.
- Show how this project's proposed grading ties into Hearthfire's proposed
(and existing) grading.
- All site plan comments apply
Site Plan:
• Proposing stamped, colored concrete crosswalks. Any materials specifications
for paving will be reviewed with final P.U.D. plans against standards current at
the time of the review.
• It is not clear which street cross -sections correspond to which streets. See
previous comments regarding street classification. Street classification must be
supported by traffic study documentation for all streets.
• Remove Note #6 since street do not comply with standards (see variance

• Since there is already a Richard's Lake Road, having a Richard's Lake Drive and

• The area being platted on some of the sheets is unclear. Make platted boundaries clear and
fade all surrounding "necessary" data and delete all surrounding "unnecessary"data.
• Add final Site Plan note (oil well setback) to this Plat.
• Please add corner sight distance easements (shown on street plans) and the City's sight
distance easement restriction notes to this Plat.

Overall Utility Plans:

To Whom it May Concern,
It is requested that the Utility and Drainage Easement along the Westerly side of Lot 11 be adjusted
from six feet wide down to four feet wide. The reason for the request is the foundation of the
building has been built and is encroaching into the easement. Currently, the building is not in
conflict with any utilities along the lot line and the remaining four feet is sufficient for subsequent
utilities.
The easement will be sufficient to cant' the runoff from the two lots to the street. Attached are the
rational method calculations for this area. The contributory area to the lot line is approximately 0.10
acres. The runoff coefficient for Medium Density Planned Residential District (R-M-P) is 0.60.
The intensity of the 100-year storm (using a time of concentration of 10 minutes) is 7.20 in/hr. The
runoff expected along the lot line during the 100-year storm, is 0.4 ft'/s. The swale along the lot line
will have a slope of 2.5% (per the grading plan). The depth of flow within the swale, for 0.4 ft'/s, is
0.25 feet. Using a side slope of 4:1, the spread of the flow will be approximately two feet (one foot
on each side of the lot line).

EXECUTIVE SUMMARY:
The Owner has requested the vacation of 2 feet of a 6 foot sidelot utility and drainage
easement on Lot 11 of Richard's Lake PUD, Filing One, because the house that was
constructed extends into the easement. The utility companies have been contacted
and have no problems with the proposed vacation.

OF THE CITY OF FORT COLLINS VACATING 2 FEET OF A 6 FOOT
SIDELOT UTILITY AND DRAINAGE EASEMENT
ON LOT 11 OF RICHARD'S LAKE PUD
WHEREAS, Section 2-353 (4) of the Code of the City of Fort Collins authorizes the
Planning and Zoning Board to vacate certain easements, by resolution or by approval of
replats containing notation of such vacation; and
WHEREAS, the Owner has requested that the City vacate 2 feet of a 6 foot sidelot
utility and drainage easement on Lot 11 of Richard's Lake PUD, which proposed vacation
is more particularly described on Exhibit "A"; and
WHEREAS, the vacation request has been reviewed and approved by the pertinent
City and private utilities, and they report no objections.
NOW, THEREFORE, be it resolved by the Planning and Zoning Board of the City of
Fort Collins that 2 feet of a 6 foot sidelot utility and drainage easement on Lot 11 of
Richard's Lake PUD, Filing One, which easement is more particularly described on Exhibit
"A", attached hereto and incorporated herein by this reference, is hereby vacated.
Passed and adopted at a regular meeting of the Planning and Zoning Board of the
City of Fort Collins held this 16'h day of June A.D. 2005.

SITE AND LANDSCAPE PLANS
• Please separate Site and Landscape Plans.
• Corner sight distance easements have been identified on the street plans. Please contact the
Developer's engineer for the easement locations and show them on the Landscape plans along
with the City's sight distance easement restriction notes.
• Add a note on the Site Plan stating the oil well setback restrictions as they pertain to the
ability to build on those encroached lots.
PLAT
• All easements must be clearly shown and defined. With as many existing and somewhat
overlapping easements, indicate both lines defining each easement.
• All easements being vacated by this plat should state "To be vacated by this Plat".
• This Plat is overly congested with necessary data. Please remove all unnecessary lines, paths,
access drives (which will disappear upon overlot grading) and all other non -Plat necessary
data. Separate Site Plan data from Plat data.
• Title the plat "A Plat of Richard's Lake P.U.D., Filing 1" and remove the word "Final" from
Final Plat in the title block area. You can stamp it Final or Prelim during review period, but do
not make it a permanent reference, since it is only "a" Plat.
• The area being platted on some of the sheets is unclear. Make platted boundaries clear and
fade all surrounding "necessary" data and delete all surrounding "unnecessary"data.
• Add final Site Plan note (oil well setback) to this Plat.
• Please add comer sight distance easements (shown on street plans) and the City's sight
distance easement restriction notes to this Plat.
• Define all the Tracts purposes under the Notes area of Plat sheet P1, ie: Tract C is dedicated
as open space, and a drainage and public access easement (must use words "dedicated" and
"easement" when an easement situation).
• State each streets classification under/beside the name, ie: Morningstar Drive (collector w/
parking).
• All easements to be dedicated by separate document to the public or as an offsite easement for
public concerns must be submitted to the City for acceptance (or copy of executed private
easement) at least two weeks prior to final P&Z hearing.
• Only provide sheets that have Plat data relevant to Filing One. Do sheets P4, P5, and P9 meet
this requirement?

UTILITY PLANS
Cover Sheet:
• Include standard City General Notes, Benchmark (referenced to the City "Black Bolt
Survey"), and the date prepared under the title (update date w/ ea. submittal).
• Re -number all sheets, except Plat, consecutively from Cover Sheet and revise the title to
say " Utility Plans for Richard's lake P.U.D."
Phasing Plan:
• Some how, this development must show how the utilities and streets will be phased so we
can verify each phase is capable of functioning on its own, that is, to function
independently of the remaining undeveloped phases. Any liveable area must have two
points of access, stormwater must be handled without detriment to others, etc. these
things we have to verify that they exist in any part of a development especially phased
ones.
Overall Utility Plans:
• Suggestion: possibly show whole phases on the utility plan sheets with phasing info on
each; possibly adding phase numbers to the title, ie: "Utility Plan - Phases I thru 4". If do
not use suggestion or your own methods, show phase lines on each sheet.
• Remove all irrelevant lines, ie: existing paths and roads that will be graded over for lots.
• Please show the stormwater system, all crosspans, street names and any other utility
components.
• Show "Type III barricades at all short dead ends and public turn -a -rounds at others.
• Is there a utility easement on the South side of Richard's Lake Rd. covering the 4" water
line ? If yes show on plat and utility plans; if private show anyway and provide copy of the
easement to the City. If no, need to provide.
Onsite Street Plans:
• Please provide this data for all streets:
- Both flowline profiles and full descriptive data to PCR of intersecting street.
- Intersection data per City detail D-18.
- Labeled PCR data (stationing and elev).
- Curve table with arc length, bearing, delta, chord length, tangent and radius data.
- True lengths of flowline line segments (by table or on profiles, clearly).
- Detail drawing w/ descriptive data, of anything differing from City standards.
- Show and label all elements in the street prism, ie: inlets, crosspans, etc..
- State width of all sidewalks, ie: "proposed 5' sidewalk".
- Fade all data not relevant to describing the street elements and related components.
- State classification, r-o-w and flowline width, of each street under the street name.
- Provide cul-de-sac data per City detail D-5 for each c-d-sac (see comments on c-d-sac
detail, sht. R19, for recent changes).
- Label all street width transitions by stationing and description.
- Show "Type III" barricades at all stub streets and public turn -a -rounds at all long
incomplete streets.
- Show phase lines and temp. tum-a-rounds or "Type III" barricades at same.
- Use matchlines to continue street plan and profile views
- Show PCR to intersecting street PCR slopes, stationing and elev's on flowline profiles
( if a street being profiled is intersected by another street do not show the PCR-PCR
data, show data of flowline going thru intersection. If profiled street intersects another
street at the profiled streets ends, do show data from the profiled street PCR to
intersected street PCR; see sheet R3).
- Corner sight distance easements.
- All paths leading to a street crossing should be done at the intersection corners (where
people expect to find people crossing the streets) with the exception of the raised
crosswalk on Morningstar Drive. Paths do not have to lead to the comers (preferable)
but no ramps shall be allowed at those mid -block locations to discourage unexpected
pedestrian crossings.
