RE: Priority Processing and Waiver of Development Fees for the Cherry Street
Lofts
Troy Jones is the project manager for the Cherry Street Lofts and he is requesting
affordable housing status for the project. The project is located at 317 and 325 Cherry
Street and will have 10% of the units or (one unit) affordable to a household at 80% and
below Area Median Income (AMI).
The development meets the City's definition for an affordable housing project and
qualifies for Priority Processing and a 10% waiver of its Development Review Fees. The
waiver only applies to fees charged by the Current Planning Department.
Please implement Priority Processing procedures for this project's development review
process. The developer will be submitting an application for review to the Current
Planning Department today.

On behalf of our client with the above referenced project, we request a variance to the
City's Standard Design Criteria. Per the Larimer County Urban Area Street Standards,
Sec. 9.3.2.E and Figures 706 and 707, driveways for single family dwelling units shall be
a minimum width of 12 feet. The driveway for this project has been designed with a width
of 9 feet (please see attached).
There are several reasons for the reduced driveway width. First, in order to meet the
minimum width requirement, the driveway would comprise almost the entire space between
the existing building and the west property line. It is probable that, because of their
psychological discomfort with obstructions near the edge of the pavement, drivers would
not utilize the full width of the driveway. Second, because Cherry Street is 60 feet wide
(15 feet wider on each side than a standard residential local street) more space is
available for a turning movement into the driveway.
In conclusion, full compliance with the Standard Design Criteria would impose undue
hardship in developing the site. It is our opinion that the proposed design will adequately
meet the intent of the standards for the health, safety and welfare of the public.

Re: Cherry Street Lofts - Greg Glebe, Developer
Dear Ms. Moore:
Mr. Glebe has requested that I write you concerning the use of one sewer line to
serve both residential and commercial purposes in the above -referenced condominium
development. We will place provisions in the Condominium Declaration that the sewer
line is a shared line and that all costs will be shared on an equitable basis, which basis
will be worked out after final plans are approved, and that the association has the full
responsibility for the repair, maintenance, and replacement of the sewer line without
obligation or liability to the City of Fort Collins. We will need to decide whether this
responsibility attaches at the connection to the main line or commences at the property
boundary. Nevertheless, adequate provisions will be placed in the Declaration to ensure
that the City has no responsibility.
