A copy of the Warranty Deed by which Kim Stuart conveyed Overland Hills First Filing to Springfield Subdivision Sixth Filing Joint Venture. As the Deed indicates, the consideration was $75,000. 2. A copy of the Real Property Transfer Declaration which indicates the consideration for Overland Hills First Filing was $75,000 cash. 3. Copies of the purchaser's and seller's statements of settlement which indicate that the purchase price of Overland Hills First Filing was $75,000 cash. 4. A copy of a letter from Elaine Spencer to Jim Gefroh dated February 18, 1992, concerning the road which was to have been constructed adjacent to the detention pond in Springfield Subdivision Sixth Filing. Stuart c/o Jim Gefroh 145 West Swallow Road Fort Collins, CO 80525 Re: Overland Hills Second Filing Dear Mr. Stuart: The purpose of this letter is to inform you that the last sentence in paragraph I.C. of the Development Agreement, dated July 24, 1992, for the above titled subdivision, which states that no building permits will be issued for structures located beyond 660' from a single point of access, is not entirely correct. According to the City Code, Section 29-657(b), "if fire sprinkler systems or other fire prevention devices are to be installed within the residential subdivision, these requirements may be modified." The Poudre Fire Authority Fire Marshall, Warren Jones, has informed me that he agreed with your architect, Jim Gefroh, that residential fire sprinkler systems installed in the homes beyond 660' from a single point of access is acceptable for this development. The Poudre Fire Authority approval will take precedence over the Development Agreement for this issue. The street and the box culverts have not been designed at this time; therefore, the estimate was based on a three cell 3'x15' box culvert and a standard arterial street section.
