RECEPTION#: 20080075991, 12/08/2008 at 10:' 3 AM, �,..J., 1 OF j.•R $16.00 TD Pgs: 0 i Scott Doyle, Larimer County, CO I ORDINANCENO.138,2008L_ OF THE COUNCIL OF THE CITY OF FORT COLLINS ANNEXING PROPERTY KNOWN AS THE EAGLE VIEW NATURAL AREA FIRST ANNEXATION TO THE CITY OF FORT'COLLINS, COLORADO WHEREAS, in October 2002, the City of Fort Collins (the "City") acquired certain property known as the "Eagle View Natural Area" (the "Natural Area") which area contains approximately 86 acres and is located south of Kechter Road, west of Interstate Highway 25, east of Strauss Cabin Road and north of the Fossil Creek Reservoir; and WHEREAS, the City Council desires to annex the Natural Area into the City, and WHEREAS, the Natural Area is solely owned by the City and is eligible for annexation under Sections 31-12-104(1)(a) and 31-12-105, C.R.S; and WHEREAS, it is in the best interests of the City to annex said Natural Area to the City; and WHEREAS, in order to establish one -sixth contiguity of the Natural Area to the existing boundaries of the City, it is necessary to annex the same in a series of two annexations, which annexations may, pursuant to Section 31-12-104(1)(a) C.R.S., be completed simultaneously and considered together by the City Council. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the City Council hereby finds and determines as follows: a. That the property described on Exhibit "A," attached hereto and incorporated herein by this reference, is entirely owned by the City, is not solely a public street or right-of-way, and is eligible for annexation as set out in Sections 31- 12-104(1)(a) and 31-12-105. b. That, pursuant to Section 31-12-106(3), the City Council may by ordinance annex said property to the City without notice and hearing as provided in Sections 31-12-108 and 31-12-109, C.R.S. Section 2. That the property shown on Exhibit "A" is hereby annexed to the City and made a part of said City, to be known as the Eagle View Natural Area First Annexation. Section 3. That, in annexing said property to the City, the City does not assume any obligation respecting the construction of water mains, sewer lines, gas mains, electric service lines, streets or any other services or utilities in connection with the property hereby annexed except as may be provided by the ordinances of the City. That the City hereby consents, pursuant to Section 37-45-136(3.6), C.R.S., to the inclusion of said property into the Municipal Subdistrict, Northern Colorado Water Conservancy District. MayorAl city -2- EXHIBIT "A" A tract of land located in the northwest quarter of Section 10, Township 6 North, Range 68 West of the Sixth Principal Meridian, Larimer County, Colorado, the said tract is also Lot 2 of the Brown MLD 5-60-89, as recorded at Reception No. 90012796 records of the said Clerk and Recorder of the said Larimer County, being more particularly described as follows; Considering the west line of the Northwest Quarter of the said Section 10 as bearing South 00 degrees 07 minutes 56 seconds West between a 2.5" Aluminum Cap monument PLS 17497 at the Northwest corner of Section 10 and a 2.5" Aluminum Cap monument PLS 14823 at the West quarter corner of Section 10, based upon GPS observation and the City of Fort Collins coordinate base, and with all bearings contained herein relative thereto; Commencing at the said Northwest corner of Section 10; THENCE along the north line of the said northwest quarter of Section 10, South 89 degrees 04 minutes 36 seconds East for a distance of 30.00 feet to the northerly extension of the west line of the said Lot 2; THENCE along the said extended line, South 00 degrees 07 minutes 56 seconds West for a distance of 30.00 feet to the northwest corner of the said Lot 2 and to the TRUE POINT OF BEGINNING of this description; THENCE along the north line of the said Lot 2, South 89 degrees 04 minutes 36 seconds East for a distance of 600.06 feet to the easterly line of the said Lot 2; THENCE along the said easterly line of Lot 2 the following seven (7) courses and distances (1) South 63 degrees 05 minutes 40 seconds East for a distance of 132.48 feet; (2) South 16 degrees 40 minutes 08 seconds East for a distance of 52.29 feet; (3) South 03 degrees 17 minutes 20 seconds East for a distance of 94.74 feet; (4) South 01 degrees 03 minutes 42 seconds East for a distance of 194.99 feet; (5) South 00 degrees 21 minutes 56 seconds East for a distance of 367.71 feet; (6) South 89 degrees 04 minutes 36 seconds East for a distance of 542.00 feet (previously recorded as 542.34 feet); (7) South 00 degrees 17 minutes 56 seconds West for a distance of 1824.76 feet to the south line of the said Lot 2; THENCE along the said south line, North 89 degrees 25 minutes 41 seconds West for a distance of 1282.99 feet to the said west line of Lot 2; THENCE along the said west line, North 00 degrees 07 minutes 56 seconds East for a distance of 2597.63 feet to the point of beginning.
