Dear Mr. Fisher,
This letter addresses the outstanding issues you have with the Oakridge Business Park, 32nd Filing
development and will hopefully help you proceed forward with this project. As you recall from our
meeting on May 10, 2000, you had some concerns with the access joining this property and the
property to the north. You also had some concerns with the pedestrian bridge and sidewalk that
connects with the future trail adjacent to the railroad tracts.
In responding to your first concern about the shared access with the property to the north, City staff
determined that the configuration you are currently proposing on the utility plans would be adequate.
However, we would like for you to dedicate a blanket pedestrian access/access/utility/drainage
easement on the property excluding the building envelopes. The reason for this sort of easement
is two -fold. First. staff still felt it was necessary to have the "shared access" within an access
easement. but also, the sidewalk you are proposing. which will connect Innovation Drive and the
railroad tracks, needs to be contained within a pedestrian access easement. Rather than trying to
legally describe the easement along the sidewalk, it is much easier to provide a blanket easement
on the property.
This leads to the next topic, which was the escrowing of funds for the construction of the pedestrian
bridge. As you may or may not be aware of, the City's Parks Department is planning on constructing
a trail along the railroad tracks within the next couple of years. Rather than constructing the bridge
across the swale at this time, City staff is recommending that the Developer provide the Parks
Department with what is commonly referred to as a "Contribution in Aid". Essentially this is a check
written in the amount of the bridge structure to the Parks Department. Once the Parks Department
is ready to construct the portion of trial adjacent to this property, they would use the money from the
Developer to build the bridge connection. City staff feels that both parties would benefit from this
contribution rather than escrowing the funds for the bridge construction (escrowing funds would
include the amount of the structure plus 50%). Upon doing this, however, a Development
Agreement is needed to explain this procedure. This agreement can be written so the project will
not be held up longer than it has to.
