This letter is to inform you that the public right-of-way
improvements as required by the City for the Matterhorn Planned
Unit Development project have been completed and initially accepted
by the City. Therefore, the Public Improvement Funds may be
released as per the Construction and Disbursement Agreement.

This letter is to inform you that all of the improvements in the public right of way have been
completed per the approved plans, specifications and requirements by the City of Fort Collins
on the above referenced P.U.D.
Per the First Amendment to Construction Escrow and Disbursement Agreement, the Public
Improvement Funds may not be disbursed or released by Escrow Agent until Escrow Agent
shall have received written authorization of the disbursement by an engineer or attorney for
the City of Fort Collins, Colorado. The Escrow Agent's address is as follows.

This letter is to inform you that the street improvements on
College Avenue adjacent to the Matterhorn P.U.D. project which have
been completed to date have been inspected and initially accepted
by the City.
Please be informed that this letter does not relieve the developer
or contractor of their obligation to complete the public
improvements as required by the utility plans, State access permit
and Development Agreement issued for the Matterhorn P.U.D. project.
