We would like to enlarge the existing restrooms at the above address to satisfy the needs of
our guests. We deem it very important (essential, really!) to provide ADA restrooms for our
customers and our staff. We should have done this years ago!
The current restrooms are located on the south perimeter of the building between our walk-in
freezer and our dining room. We are unable to enlarge the restrooms without adding on to
the footprint of the building.
We would like to build an addition of approximately 6' x 16' on the southern side of the existing
building to accommodate the new restrooms. We need this space to accomplish our goal; it's
really the only place to enlarge the building. The right-of-way and the easements on the
southern perimeter of the building would need to be vacated. It is our hope that this can be
done; otherwise, we cannot upgrade our restrooms.
Please let us know what else we might need to do. We respectfully submit this letter and
sketch that you might give our request consideration.

OF THE DIRECTOR OF COMMUNITY PLANNING
AND ENVIRONMENTAL SERVICES
OF THE CITY OF FORT COLLINS VACATING A
PORTION OF A UTILITY EASEMENT
ON LOT 2, HARVARD SUBDIVISION, SECOND FILING
WHEREAS. Section 2.1.5 of the Land Use Code of the City of Fort Collins authorizes the
Director of Community Planning and Environmental Services to vacate certain easements by
resolution or by approval of replats containing notation of such dedication, and
WHEREAS, the Owner has requested that the City vacate a portion of a utility easement
on Lot 2, Harvard Subdivision, 2Id Filing, located on the South College Avenue Frontage Road
on the west side of College Avenue, south of Harvard Street and north of Swallow Road, more
particularly described on Exhibits "A" and "B"; and
WHEREAS, the vacation has been reviewed and approved by the pertinent City
Departments, which departments report no objections to the vacations.
NOW, THEREFORE, be it resolved by the Director of Community Planning and
Environmental Services of the City of Fort Collins, that a portion of a utility easement on Lot 2,
Harvard Subdivision, 2nd Filing, located on the South College Avenue Frontage Road on the
west side of College Avenue, south of Harvard Street and north of Swallow Road, which portion
is more particularly described on Exhibits "A" and "B," attached hereto and incorporated herein
by this reference, is hereby vacated.
Passed and adopted at an administrative hearing held by the Zoning Supervisor as the
delegee of the Director of Community Planning and Environmental Services of the City of Fort
Collins this _'ELday of October A.D. 2004.

of Larimer, State of Colorado, also being in Lot 2, Harvard Subdivision, Second
Filing, a subdivision on of record in the office of the Clerk and Recorder of said
County, and being more particularly described as follows:
Considering the South line of said Harvard Subdivision, Second Filing, as
monument by a #4 rebar at the Southeast corner of said Lot 2 and the Southwest
corner of Lot 3, as bearing North 89030'00" West, and with all bearings contained
herein relative thereto:
Commencing at the Southeast corner of said Lot 2; thence along the South line
of said Lot 2, North 89030'00" West 66.73 feet; thence North 00020'00" East 3.00

RE: REQUEST TO VACATE a portion of a utility easement at the Egg and I
Restaurant, 2809 S. College Avenue
Attached for your review and comments are a vacation request and a sketch by the
Applicant showing the property located at 2809 S. College Ave. (lot 2, Harvard 2"d
Subdivision) and the portion of the utility easement proposed for vacation along the south
edge of the property. The Applicant proposes vacating a 7-foot-wide and 18.2-foot-long
portion of the 10-foot-wide utility easement along the south property line, and is requesting
the easement vacation because he would like to construct a restroom expansion on the
area. Also included with this memorandum is a copy of his request. A very similar request
was made in December of 2003, but the location and size of the proposed easement to be
vacation have been shifted somewhat, so a re-routing of the request was necessitated.

by September 27, 2004. If no correspondence has been returned by this date, it will be

Dear Katie,
We have obtained the required survey of our property located at 2809 S. College, showing the
utility easement along the south side of our building. It is our desire to be able to abandon that
easement so that we can enlarge our restrooms, as indicated, on the survey, our addition will
be partly built in that easement.
We are submitting this survey to you with the request that you now notify us what the next step
is for us as we move towards hiring a contractor to begin the remodel/addition as soon as
possible. With autumn coming, we need to stay focused so we can avoid a cold weather
project.
Please let us know what else we might need to do. We respectfully submit this letter and
