RE: Minor Amendment for Lot 1 of the Harmony School Shops 3`d Filing

This minor amendment application seeks to amend Lot 1 of the Harmony School Shops 3`d
Filing. The 1-6-acre site is located on the northeast corner of Timberline Road and
Milestone Drive. The existing zoning is HC- Harmony Corridor. The Harmony School
Shops 3rd Filing was originally approved in July 2001 and contained a child-care center on
Lot 1 and two office buildings on Lot 2. The office buildings are currently under
construction. This request is to convert the approved child-care center on Lot 1 to a bank
facility to be owned by Capital West Bank.

The proposed building will be two stories in height and will contain approximately 5,331 sq.
ft. of bank on the main floor. There will be three drive-thru lanes plus one drive-thru ATM
lane. In addition, there will be 1,069 sq. ft. of lease space on the ground floor that may be
used for retail, office, or small service -oriented businesses such as a title company or
insurance agency. The second floor will be utilized for 5,589 sq. ft. of general office. The
building is situated to the "build -to" line along Timberline Road and Milestone Drive.
There are 46 total parking spaces on the site. If you add together the number of spaces
allowed per Section 3.2.2 for each of the uses — bank, retail, and office, the total maximum
allowed would be 38 spaces, including 2 handicapped spaces. This site contains 6
spaces over the allowed maximum. The applicant would like to request an alternative
parking ratio to allow a greater number of parking spaces for the site. The bank will have
up to 15 employees and offer a wide variety of services for its customers. The average
time that a customer spends in the building is longer, therefore justifying a greater number
of parking spaces. In addition, this is a mixed -use building, which will contain general
office uses and potential retail uses.
The plan also offers distinctive features such as pedestrian connectivity and outdoor plaza
areas on both the west and south sides of the building. The plan also minimizes visual
impacts along the public streets by placing the building on the southwest corner of the site
and the parking lot away from the public street frontages. The parking lot facing the
neighborhood will be landscaped with shrubs that will provide adequate opacity to screen
headlights from the existing houses to the north. Therefore, the visual and aesthetic
impacts of the surrounding neighborhood have not been compromised by the increase in
the number of parking spaces.
Light poles are located in the parking lot (see Site Photometrics Plan for light pole
locations). Night lights are also located under the canopy. No traffic study is required for
the project, however a trip comparison memo from Matt Delich is included. Also attached
to this letter is an Administrative Interpretation dated March 10, 2005 from Cameron Gloss
regarding the minor amendment. A neighborhood meeting was held on March 28.

SUBJECT: Administrative Interpretation #3-05 of Section 2.2.10 Step 10:
Amendments of the Land Use Code regarding the application of
rninor amendment review criteria to a proposed bank use on Lot 1,
Harmony School Shops, 3rd Filing.
BACKGROUND
The City's Land Use Code sets provisions for amending development plans
approved either under the present Land Use Code or other previously adopted
regulations. Section 2.2.10 outlines specific criteria used to determine the
development review process applicable to development plan amendments.
There are two types of development plan amendments: "minor" and "major".
Section 2.2.10 establishes the following numeric and subjective thresholds that
distinguish between minor and major amendments:
(a) For residential projects, that the minor amendment results in an increase
or decrease by one (1) percent or less in the approved number of dwelling
units; or
(b) For non-residential projects, the amount of square footage of land use or
structure of the project does not change the character of the project; or
(c) The housing mix or use mix ratio :hat complies with the requirements of
the zone district does not change the character of the project;
(d) The change does not result in a change in the character of the
development.
(e) Building additions or site improvernents, such as parking lots and
landscaping are proposed inside the boundaries of the approved site
specific: development plan.
The Applicant proposes an amendment to Lot 1 of the Harmony School Shops,
3Id Filing PDP that would replace the approved Child Care use with a 2-story
branch bank facility with a small drive -through facility. Both financial services
and child care centers are permitted with n the Harmony Corridor Zone District
(HC) subject to an administrative review.
The Applicant's written request indicates an intent to host a neighborhood
meeting to allow any potential concerns from neighborhood residents to be
addressed during the design phase.
INTERPRETATION:
The proposed request to replace the day care center with a branch bank could
be processed as a minor amendment. Al! of the applicable review criteria for a
minor amendment as outlined in Section 2.2.10 have been met. Even though the
two uses differ, the level of traffic generated to the site during peak hours and the
amount of site -generated noise may actually be lessened with the bank use. Use
of bank drive-ihru lanes during the evenings has the greatest potential for light
and noise impacts to the surrounding residence; however, these impacts can be
mitigated through the careful siting of light screening walls at selective locations
along the drivelanes.
Section 2.2.10(A) also offers additional protection to neighborhood residents
aggrieved by the change to the approved development plan. Minor Amendments
may be appealed to the Planning and Zoning Board within 14 days after the
action is taken on the amendment.

Minor Amendment — Detailed description of change and reason(s) for request.
As originally approved, development of the 3"' filing was to begin with Lot One, the daycare center. Due
to economic concerns, this did not occur. The applicant is interested in purchasing and developing Lot
Two at this time. In order w facilitate this, the following changes to the approved plans are being requested
with this Minor Amendment.
I . A reversal of phasing— Many of the notes and labels on the plan sets are tied to phasing and were
made under the assumption that Lot One would be developed first. This application seeks to
reverse the phasing while ensuring that the infrastructure necessary to serve Lot Two is still
provided.
2. Trash enclosure relocation — The approved plans call for a shared trash enclosure located on Lot
One. 'fire applicant would like to shift this shared enclosure further cast in order to reduce costs
associated with construction and more easily facilitate access.
3. .Aciditional'Relocated Electrical Transformer —Approved plans show a single transformer located
on Lot One. In working with the various city departments, the applicant has proposed an
additional transformer to serve both buildings of Lot Two. located at the northwest corner of
Building B as shown on the plans.
4. Revised Architecture — Revisions have been made to the architecture of the two office buildings to
reflect current design development by the applicant. Colors, materials, and the use of the "Tulip

3. 1 am concerned about the use of grey metal as a
roofing material in an office environment along Harmony
Road. I am concerned about reflectivity next to single
family homes. If this is a "galvalume" like on New
Belgium Brewery, then it is an industrialized look that is
inappropriate in this setting. There is already a lot going
on with these buildings with brick, vertical lap siding,
asphalt shingles. Adding a metal roof seems to create a
very "busy" looking appearance that is not found on the
original approved plans. Why can't the metal roof
simply continue the "weathered wood" roof shingle.

Need to make sure that light and power is routed and
reviews these plans.
A 15 foot utility easement needs to be provided along
Timberline Road The Utility easement should not have
been vacated with the prior plat - only the slope and
drainage easement was to be vacated.
I did not receive a new site and landscape plan for review.
Was a copy of the TIS sent to Eric Bracke or
transportation planning? They will need to sign off on and
review the TIS.
It looks like the building needs to be pushed east slightly
to accommodate the needed easement. The seating wall,
plaza and parking can be within the easement.
What does the seating wall and plaza look like? The wall
needs to be placed at least 2 feet behind the sidewalk.
The original set of plans had a fire hydrant located just
west of the driveway entry. Is PFA okay with this being
eliminated? I doubt they were routed these plans. I will
need verification from PFA that they are okay with the fire
hydrant being eliminated.
They were to replace the driveway with phase 1
construction. Did they do that?

County Clerk and Recorder" for the recording fee for the
easement document that I have received.
What is at the west end of the roof drain line?
Phase 1 utility sheet - need to include ALL the information
on this sheet to build from. Should not be referring to
another sheet for all the line lengths, types and
appearances.
Red lines can be picked up at the Planning Counter.

5. The report states that the "regional" pond provides
water quality detention for this site, to my knowledge the
regional sunstone does not have a water quality outlet
structure, please clarify to what pond are you referring to,
and if no water quality is provided downstream, then water
quality detention should be provided by this site.

intersection of Milestone and the private drive. This
hydrant is shown on the landscape and site plan but not
on the utility plans. Is the fire hydrant being installed?.
Provide all details. Clearly define the proposed fire line
tap as a 8"x6" tapping saddle with T.B. and 6" gate valve.
Clearly define all fittings and thrust restraint on the fire
line. Label and provide details for the traffic rated clean
outs. on the sanitary sewer service.

and any permanent structure. 2. Place proposed fire
hydrant between the existing curb and gutter and the front
off the proposed sidewalk. 3. Maintain the required

plans. 4. Note 26 on the original plans for Harmony
School Shops 3rd indicateds the valve in Milestone to be
removed and the stub into the site to be abandoned as a
part of this phase. Incorporate note 26 into this plan set.

05/10/2005 HLD Peter Barnes 1) The 17' parking stalls in the middle don't comply with
code. They need to be 19' deep unless they abut a 6'
wide sidewalk or landscape area (Sec. 3,22(1_)(4)).
2) This is in the neighborhood sign district. The sign
location shown on the north wall is high on the building
and is mostly visible to the homeowners to the north. The
sign location should be lowered on the north wall.
3) Show the parking lot light pole locations on the site plan.
4) What is the height of the wall in the center landscape
island. Provide a detail.
5) Since there is no such thing as a temporary principal
use, the temporary modular plan must comply with Article
3- Therefore, such things as building design, bike rack,
handicap parking, pedestrian connections, etc will apply.
Also. the 20' drive on the north side will need to be
widened to 24'to allow adequate back-up since the drive -
up lane is opposite the parking row.
6) Indicate the length of time the modular will be in place.
