Tri-State Generation and Transmission Association, Inc., approached me last fall
regarding their proposed expansion of the Timnath Switch Station located in Section 3,
Township 7 North, Range 68 West of the Sixth Principal Meridian. Tri-State and myself
have entered into a Receipt and Option Contract for Tri-State to purchase 1.002 acres of
land from me for this expansion.
I'm writing to inform you that 1 have no problems with Tri-State's expansion
proposal. I'm also aware that my property will receive a majority of the runoff from Tri-
State's property. Again, I have no problems with this situation.

You had previously been working with Jon Beyer, Land Specialist for Tri-State Generation
and Transmission Association, Inc. who has now moved into another position with the
Company. I am a consultant to Tri-State and have assumed many of Jon's projects such
as the Timnath Tap Project near Fort Collins.
The purpose of this letter is to comply with Colorado law concerning notification of surface
development to owners of severed mineral interest. Through your conversations with Jon
and others at Tri-State, you know our plans for the expansion of the Timnath Tap site as
well as we do and know that we will only be expanding the existing facility to the one
additional acre that Tri-State acquired from you earlier this year. The law is actually
intended for larger parcels, however this was a requirement by the City of Fort Collins
Current Planning Department. Our application and plans will be submitted to the City
Current Planning Department in the near future with construction to begin this summer.

I represent Tri-State Generation and Transmission Association, Inc. who currently owns an
electrical substation and tap in Larimer County near the City of Fort Collins, Colorado and
known as the Timnath Tap. The current Tap is a one acre site in Section 3 of Township
7 North, Range 68 West, 6`h P.M. Earlier this year Tri-State acquired one additional acre
and has plans to expand the Timnath Tap site with additional electrical switching equipment
to support the substantial growth in the area.
The purpose of this letter is to comply with Colorado law concerning notification of surface
development to owners of severed mineral interest. You own the mineral estate in a portion
of the SE/4NW/4 of Section 3. Attached for your reference is a plat indicating the
boundaries of Tri-State's Timnath Tap containing two acres, more or less. The existing site
is in Larimer County and not part of the City of Fort Collins. The one additional acre that
we have acquired is within the City limits and our expansion plans are, therefore, being
submitted to the City of Fort Collins, Current Plans Department for review and approval.
Our application and construction plans will be submitted to the Current Planning
Department in the near future with construction to begin this summer.

On Monday, October 18th, 2004, at 5:30 p.m. or as soon thereafter as possible, in the
City of Fort Collins City Council Chambers, 300 LaPorte Avenue, Fort Collins,
CO.*, the City of Fort Collins Administrative Hearing Officer will conduct an
Administrative Hearing for a development proposal in your neighborhood. The project is
known as Adrian Subdivision, First Filing, Project Development Plan, File #42-03A.
This is a request for seven single-family residential lots on 1.2 acres. This is a qualified
affordable housing project. The site is located at the southeast corner of West Vine
Drive and North Impala Drive and is zoned RL — Low Density Residential.
If you have any interest or concern about this proposed project, you are encouraged to
attend this public hearing. At the hearing, you will have the opportunity to hear from the
City staff and the project applicant about the details of the project. You will also be given
the opportunity to state your views about the project.
The affected property owners list for this public hearing is derived from official records
of the Larimer County Assessor. Because of the lag time between home occupancy
and record keeping, or because of rental situations, a few affected property owners
may have been missed. Please feel free to notify your neighbor of this pending

Tri-State Generation and Transmission Association, Inc. purchased property from me for
the expansion of their Timnath Switch Station located in Section 3 of Township 7 North, Range
68 West of the Sixth Principal Meridian. I have been advised that Tri-State has submitted their
application for construction at this site and that the City Engineer needs confirmation that the
access road to the site is as shown on the Tri-State plans.
I'm writing to confirm that the access road to the Timnath Switch Station is located
correctly on the Tri-State plans and that they have the right to continue to use the road. I have no
problem with there continued use of the access road.
