O. Box 805 Pranktown, CO 80116-0805 Telephone: (303) 663.8875 Telecopier: (303) 663-8701 You had previously been working with Jon Beyer, Land Specialist for Tri-State Generation and Transmission Association, Inc. who has now moved into another position with the Company. I am a consultant to Tri-State and have assumed many of Jon's projects such as the Timnath Tap Project near Fort Collins. The purpose of this letter is to comply with Colorado law concerning notification of surface development to owners of severed mineral interest. Through your conversations with Jon and others at Tri-State, you know our plans for the expansion of the Timnath Tap site as well as we do and know that we will only be expanding the existing facility to the one additional acre that Tri-State acquired from you earlier this year. The law is actually intended for larger parcels, however this was a requirement by the City of Fort Collins Current Planning Department. Our application and plans will be submitted to the City Current Planning Department in the near future with construction to begin this summer. Thank you for your assistance with our project in the area and please do not hesitate to contact me at the address and telephone numbers listed above with your questions. Sincerely, Jerome J.
