All damaged existing (or damaged during construction) curb, gutter, and sidewalk shall be replaced prior to � the acceptance of completed improvements. • Engineering may require revising the General Notes for this project to not reference a development agreement and require all engineering and stormwater related facilities to be in place prior to the release of a certificate of occupancy for this site. This is dependent on whether other departments feel u, the need for a development agreement, which has not been determined but will be shortly. Please contact Engineering prior to mylar resubmittal. If it is viewed that a development agreement is not t needed, General Notes 91 and #13 should be revised as follows: L. 1. All street, sanitary sewer, storm sewer, and water line construction shall conform to The City of Fort Collins standards and specifications prior to the release of a certificate occupancy for this site. Any construction occurring three years alter the approval of the Utility Plans shall require re-examination of the plans by the City Engineer who may require that they be made to conform to the standards and specifications current at that time. 13. Prior to final inspection and acceptance by The City of Fort Collins, certification of the drainage facilities, by a registered engineer, must be submitted to and approved by the Stormwater Utility Department. Certification shall be submitted to the Stormwater Utility Department prior to the release of a certificate of occupancy. • With the proposed I of right-of-way dedication along Lemay and Riverside Avenue, the project has dedicated less than the required amount (1'7.5') for a 4 lane arterial. However, because of the infill nature of the site with existing site limitations, the acquisition of additional right-of-way to meet the 115' of full street width would prove to be detrimental, if not infeasible. As the City has a modified arterial standard in established areas, this development has proposed to dedicate I of additional right-of-way. This additional dedication meets the modified arterial standard and is viewed as sufficient. It should be noted that this does not establish precedence for other development proposals as each site may have its own unique circumstances and each is evaluated individually. • It appears that all comments have been addressed. Although the language is not needed, the language is noted as follows: SIGHT DISTANCE EASEMENT RESTRICTIONS The area within sight distance easements is restricted to the following: 1. The sight distance easement is an easement to protect motorists' visibility for the safe operation of their vehicles. As a guideline for level grade, visual clearance shall be maintained free of any structures and landscaping elements over twenty- four (24) inches in height within the sight distance easement. Fences shall not exceed forty-two (42) inches in height and shall be of an open design. Deciduous trees may be permitted to encroach into the easement provided that the lowest branch of any such tree shall be at least six (6) feet above grade. For non -level Fade locations, the aforementioned criteria shall be modified to protect the motorist's line of sight. The Land Use Code in section [3.3. 1 (C)(1)] states that a developer is required to dedicate right-of- way for public streets and in the instance where any part of an existing road is in the tract being platted, the developer is required to dedicate additional right-of-way as needed to increase the roadway to the minimum width required. Lemay and Riverside Avenue are both classified as 4 lane arterials. The plat is required to dedicate the half street width necessary to bring Riverside and Lemay to current standards (115' of total width.) As such, an additional 17.5' of right of way (along with a 15' easement) is required along both streets. It was discussed that a modified arterial of 102' (needing I V of right-of-way instead of 17.5') may apply in this situation because of the infill nature of the roadways; however, a variance request needs to be submitted, addressed to the City Engineer, requesting the reduction in right-of-way width dedication requirements. Utility Plan: • The proposed building should be relocated outside of the needed right-of-way and easement dedications.
