Attached for your review and comment are sketches showing Lot 46 of Cottonwood Ridge,
located west of Shields Street and South of Harmony Road. A portion of the building was built
into the sidelot easement and as such that portion of the 5 foot utility easement is proposed for
vacation, as shown on the attached drawings.
Please sign and return any comments to Sheri L. Langenberger in the Development Review
Center by August 1, 2007. If we do not hear from you by this date, we will assume you have no
objections to the proposed vacation. Please call Sheri at 221-6605 if you have any questions.

Dear Sheri:
During a recent closing at Cottonwood Ridge, we discovered the foundation for a home
built by PLS Homes on lot 46 was inadvertently placed within the 5' side lot setback and
utility easement. The attached legal description and drawing shows the encroachment
and we are requesting an easement vacation as shown on the drawing. The homeowners
are aware of the situation and Peter Barnes granted a TCO until we resolve the conflict
with the utility easement. Once the easement is vacated, a full CO will be granted.
Please let me know if you have any questions or if you need additional information to
process this request.
