Dear Mr. Butler: The intent of this letter is to recap our conversation of July 17, 1995 concerning the issuance of certificates of occupancv in the Indian I lills Village development_ As you are aware, the Code of the City of Fort Collins requires that all public improvements arc to he completed prior to issuing C:.O.'s in a project. Ilowever, the Code does allow for the escrowing of funds with the City (escrow may be Cash, Letter of Credit, or Bond) for those items which are not complete. It is my understanding you m e presently considering the option of obtaining a bond to cover those public improvements which may not be complete at':he time of the first C.O. This is acceptable to the City. Following are the key points of our discussion: 1. Certificates of Occupancy will be issued for up to 18 lots until such time as the storm water detention and drainage system is complete and functioning_ An exception to this, will be the escrowing of funds for the completion of the under ground piping along the west boundary line of the projectprovided it does not impact the drainage from the existing development just south of this project. 2. Regardless of the type of escrowing arrangement you choose, the amount of escrow is to be based upon the value of the incomplete work plus fifty percent (50%). 3. The Engineering department will not require that the southern portion of Indian Hills Drive from approximately the northeast corner of lot 43 to the middle of lot 34 be escrowed at this time However, it is to remain open and accessible at all times for emergencv vehicles. 'Ibis portion of street is shown as work associated with the Indian I hlls Village P.11 D. Replat, under City review at this time. 4. Type III barricades are to be installed at the termination of the current first lift of asphalt pavement at both ends of Indian [fills Drive_ These obstructions may he on skids to allow construction and emergency access to the roadway. 5 ]'he maintenance and incurred costs for any needed repairs of all the public rights -of -way improvements associated with this project are the responsibility of the developer and his subcontractors. The City will not participate in any manner 6. 24 flours prior to requesting the release of C.O.'s on this project, please call our inspection office at 221-6609 to request an Engineering inspection. Our inspector will check the water curb stop boxes, sidewalk and street for damage which has oCCWTCd. If repairs ve not required, then the inspector will sign off the building permit card and notify Building Inspection that the address is okay from an Engineering concern. Box 580 Fort Collins, CO 80522 Dear Mike: This is a request for variances for residential streets in the proposed Indian Hills Village located at the intersection of East Stuart Street and Stover Street. The variances are as follows: 1. A variance of the right-of-way width of a Local Street from 54 feet to 43 feet, and the flow line to flow line width from 36 feet to 34 feet, Table 1, Page T-1. The reduction would be in the parking width from 8 feet to 7 feet and the driving lanes would remain 10 feet wide. The utility easements on either side of the street would be widened from 9 feet to 14 112 feet. The 7 foot wide parking area will be delineated by being concrete, with 10 foot wide driving lanes being asphalt. The standard cannot be met with the garages in the rear of the lot which is desirable in order to not have the street scape be all garage doors. There should not be problems in handling the traffic since the driving lanes remain 10 feet wide. 2. A variance of the Local Access Street right-of-way from 54 feet to 34 feet and the flow line to flow line width from 36 feet to 29 feet, Table 1, Page T-1. The street would have parking only on one side of the street. The A.D.T. for each street where this section is proposed is 600. The standard cannot be met with the garages in the rear of the lot due to added land needed for width of the garage access drive. The street would have parking on one side only, and no parking signs will be provided by the developer. The lots on the Local Access Streets are within 150 feet of the residential street and therefore do not cause a problem for fire fighting. 3. A variance of the southeast Local Access Street allowing a public hammerhead turn -around at the end designed to meet City of Fort Collins alley hammerhead specification. The justification for this is the low amount of traffic which will occur and will require turn -around for this street. Fire department access requirements are met because this Local Access Street is less than 150 feet long and no fire department equipment will be proceeding down it or required to turn around at the end of same. A variance of the northwest Local Access Street whereby egress loop will be permitted by means of connection to private driveway lane provided a) a public easement shall be granted for such use, b) all maintenance of private driveway lane shall be responsibility of Indian Hills Village HOA, and c) visual differentiation in paving shall be provided at connection point between the Public Street and the private drive. The justification for this is the low amount of traffic which will occur and will require turn -around for this street. Fire department access requirements are met because this Local Access Street is less than 150 feet long and no fire department equipment will be proceeding down it or required to turn around at the end of same. 5. A variance of curve radiuses at the entrance permiting less than the standard 240 feet (30 mph design speed). This is justified by the design of the project which encourages and requires that traffic proceed at a low speed not to exceed estimated 10 - 20 mph in this area. Specifically northboud traffic exiting from project will be slowing and coming to a complete stop here prior to exiting onto Stuart Street, and southbound traffic into project will have slowed and come to a stop prior to entering. After measuring the black top pavement, I found we have a 20' drive aisle. Therefore, we will not require any additional changes. 1 did note that the southern most street had only 19' 8" of pavement between the curb and gutter and will have to be replaced. In addition, the project manager, Jeff Butler stated he would sign the area "No Parking" "Fire Lane" and insert language making the homeowners association responsible for enforcing parking in the subdivision. Granting this variance will not adversely affect the public health, safety or weltare and in fact will result in a project that is equal or better than it otherwise would be. 4 A valiance for curve radiuses permitting less than the standard 240 feet (30 mph design speed) is requested as follows- The design speed for this project is 15 rnph which is dictated by a) a right-angle turn is required to enter project, b) a complete stop is required to exit project, c) vehicles proceed on the internal streets on a relatively narrow 20 toot wide asphalt roadway, d) vehicles proceed on the perimeter streets on a relatively narrow 16' asphalt and 4' alternative surface roadway, e) landscape offsets occur regularly both on the right and left-hand side of street requiring vehicles to travel at design speed of 15 mph or less, f) right-angle turns around circle loops and undulating character of these right-of-ways require traffic, and g) the two dead end Local Access streets are less than 150 feet long- This variance is required by the pre-existing constraints of the project as described above Granting this variance will not adversely affect the public health, safety or welfare and in fact will result in a project that is equal or better than it otherwise would be. Granting this variance will not adversely affect the public health, safety or welfare and in fact will result in a project that is equal or better than it otherwise would be. 5 A variance for curve radiuses permitting less than the standard 240 feet (30 mph design speed) is requested as follows Radius #1 variance from 240 feet to 100 feet, radius #2 variance from 240 feet to 100 feet. radius #3 variance from 240 feet to 100 feet, and radius 412 variance from 240 feet to 165 feet. The design speed for this project is 15 rnph which is dictated by these right-of-way curve radius constraints. This design speed of 15 mph will not be exceeded in this project for the following reasons a) a complete stop and / or right-angle turn is required to enter project requiring vehicle speeds of less than 15 mph as you enter project: b) vehicles proceed around the circular right-of-way on a relatively narrow 20 foot wide asphalt roadway which limits vehicle speeds to under 15 mph:. c) landscape offsets occur regularly both on the right and left-hand side of street requiring vehicles to travel at design speed of 15 mph or less, d) four right-angle turns around circle loop and undulating character of this right-of-way require traffic to proceed at 15 mph or less: and e) the two dead end Local Access streets are less than 150 feet long requiring traffic to proceed at 15 mph or less. Accordingly, the design speed of this project will not be exceeded. This variance is required by the pre-existing constraints of the project as described above. Granting this variance will not adversely affect the public health, safety or welfare and in fact will result in a project that is equal or better than it otherwise would be.
