Re: Harmony Village PUD, Lot 5, Minor Amendment — Drainage Easement
Dear Sheri:
As part of the Minor Amendment for Lot 5 of Harmony Village PUD, a portion of the detention pond
(fond B) from the originally approved plans is being revised. This area included some shallow ponding
in the parking lot in the area cast of the building and in the previously proposed drive through banking at
the soulh of the building. The proposed building footprint eliminates the drive through banking and
replaces it with building. In addition, the revised grading for the parking lot adjacent to this portion of the
building raises a smaU portion of the parking lot, also taking it out of the detention area.
This results in a minor reduction of the originally proposed detention volume for Pond B from the
originally proposed 0.87 acre-feet to the revised volume of 0.81 acre-feet. The original detention ponds
(combination of fond A and Pond B) had approximately 0.20 acre-feet of additional volume above the
100-year requirement. Therefore, this revision does not adversely affect the overall drainage and
detention scheme for the Harmony Village PUD.
Please find attached a copy of the legal description and exhibit for the vacation of a portion of the
drainage easement on Lot 5. It is our understanding that this needs to be approved by Planning and
Zoning. Therefore, please place it on their agenda as soon as possible.

the City's Design Control Line are the reason these lane lengths are reduced.
5. A variance is requested for the maximum flowline grade break without a vertical
curve. In several places along the medians it is necessary to have grade breaks in
the flowline to maintain existing cross slopes. If vertical curves are placed in these
areas, the flowline elevation will change and a break in the cross slope will be
needed. By Extending cross slopes the road will "ride" just as it does today with no
quarter crown.

Dear Tim:
Please consider this as the Variance Request for the centerline radius on Wilmington Drive
just west of Delany Drive in Harmony Village PUD. The proposed centerline radius of 160
feet is less than the radius required by the "Design and Construction Criteria, Standards and
Specifications for Streets, Sidewalks, Alleys and Other Public Ways", City of Fort Collins,
Colorado, City Engineering Office, July 1996, (City's Street Design Criteria) of 240 feet for a
30 mph design speed Residential Street. This standard is found on Page T-2 of the City's
Street Design Criteria.
This variance is being requested due to the alignment required for Wilmington to continue
northerly out of Harmony Crossing PUD and then turn easterly to align with Rockport Court
at the intersection with Delany Drive. This resulted in a design utilizing the City's minimum
design criteria throughout the majority of the length until the road approaches Delany Drive,
which will be a stop condition intersection.
Due to the proximity of this portion of Wilmington Drive to Delany Drive, eastbound traffic
will be slowing for the stop sign and westbound traffic will be a relatively low speeds as the
vast majority of them will have just turned from Delany Drive onto Wilmington Drive.
Therefore, it is not anticipated that any public health, safety, and/or welfare problems will be
created by the varied design.

Matt/Tim - last Thursday (5/6/99) the representatives of the Harmony Village and the Poudre Valley
Health System Harmony Campus met along with JR Engineering and The Sear -Brown Group to discuss
the improvements to Timberline Road required of both parties as a part of their pending projects.
The purpose of the meeting was to review the discussions you, Dave and I had the prior Thursday
(4/1-9/99) with respect to street oversizing, project funding, and project schedule.
Based on the options discussed, it appeared that the alternative preferred by all parties would be to
pursue having the City of Fort Collins complete the Timberline improvements through you and your
staff.
Both parties have agreed to utilize their building partners to prepare detailed estimates of the work from
the approved plans and reconvene in a meeting with you Thursday May 20`h at 9AM (if this works with
your schedule). At that meeting the agenda would be to formalize arrangements pertaining to the
Financing and schedule to allow all of us to proceed with the project.
As per my notes, the largest issues requiring discussion will include:
• SCHEDULE: Both projects share a common need to have the Timberwood entrance complete in time
for their planned openings (sometime in the fall of this year).
• COORDINATION': Both projects need to work with the City and the selected roadway contractor to
ensure interim site access is maintained throughout construction.
• COSTS: Both teams intend to provide you with detailed cost estimates of all the proposed
improvements (regardless of proportionment) so as to make appropriate capital planning decisions.
I appreciate your cooperation in all of this. So far so good with all parties, but just wanted to keep you
current as to their meeting outcome.
Please do not hesitate to call myself, Dave Klockeman or Stu MacMillan with respect to these issues.
Also, if you could let me know by phone or email if the meeting on the I9`h will work for you I will
notify everyone else.

I recently received a variance request to our street standards from JR Engineering, Ltd. Dave
Klockeman is requesting a reduced centerline radius along Wilmington Drive. The street standards
currently state that the minimum centerline radius for a residential local street is 240 feet. This standard
cannot be met because of the proposed road alignment and the location of the existing roads
Wilmington Drive needs to connect to.
After reviewing the plans and the proposed alignment of Wilmington Drive and the reduced centerline
radius in the area of the proposed variance, I feel that this variance request can be granted. The
reduced radius occurs close to the intersection of Wilmington Drive and Delaney Drive where vehicles
will be slowing to a stop condition. There would not be a safety concern to the public and the proposed
road would function adequately.
Please find enclosed an original copy of the variance request letter and a copy of the utility plans for
your review. Because the Harmony Village PUD project is on a strict schedule for completion, your
review and response to this issue would be very much appreciated.

We have reviewed staff comments dated August 12, 1998, and have the following
comments:
1. Acknowledged.

4. The applicant's Civil Engineering consultant will be pursuing signed letters
of intent prior to P & Z.
5. After discussions with our design team including our traffic engineers and
civil engineer, we have come to the conclusion that Wilmington should
remain a 36 foot wide street with parking on both sides. We believe a
narrower street (36 feet versus 44 feet) will slow traffic down and make it
easier for pedestrians to cross. We would like to set up a meeting to
discuss internal vehicular circulation, bike lanes and pedestrian circulation
with City staff at your earliest convenience.
6. Our understanding is that Eric Bracke agreed to install a median on Battle
Creek Drive that would prevent left turns on to Wilmington if the traffic
count on Wilmington exceeded 1,000 vehicles.
7. There are two "neck -downs" shown on the plans; one on Wilmington
and one on Delany.

8. A right-of-way line has been added to the Site Plan for Wilmington, Delany
and Timberwood.
9. A note has been added to the Site Plan with the requested language.
10. We don't understand what this comment means. Perhaps this can be
addressed at the meeting we have proposed.
11. We have oriented buildings to to the "main street" to the degree that we
can. We have also added an office building between the two banks to
create more visual interest. All the buildings have entrances, outdoor dining
areas, and/or pedestrian connections to the "main street".
12. Retail square footage has not been added to the theater. No retail buildings
exceed the 25,000 square foot maximum.
13. The buildings have been separated so that no building exceeds 25,000
square feet. Pedestrian space between the buildings will be further defined
during the final review process.
14. Please see revised building elevations for buildings J and K.
15. The "pass -through" spaces between buildings are accentuated with special
plantings, interesting plazas and street furniture. More detail will be
provided at final review.
16. We believe we have adequately addressed pedestrian circulation within the
center. We prefer to keep pedestrians within islands rather than taking them
diagonally through parking areas because it is safer. This can be another
topic in the meeting we are proposing.
17. A. Enhanced crosswalks have been shown in the recommended locations.
B. Six foot wide bike lanes are shown on the plans.

As we discussed on the telephone, this will confirm that Gateway American Properties,
LLC ("Gateway") has worked out an arrangement with the Dial Fort Collins I, LLC ("Dial")
with respect to expansion of the detention pond to serve Harmony Village onto Tract B of
Harmony Crossing. This letter shall serve as our letter of intent to confirm Gateway's
acknowledgment ofDial's proposed use of Tract B and Gateway's consent, subject to approval of
the plat. As part of this consent, Dial has agreed to undertake Gateway's obligations regarding
the cul-de-sac for Rockport Drive when Delany Drive is extended through Harmony Village. As
you and I discussed, we will contact Tim Blandford to coordinate a modification of the Harmony
Crossing Development Agreement with the approval of the Harmony Village Agreement
regarding this obligation_ Dial's obligations to Gateway are contingent upon the earlier of its
purchase of the property and/or approval of the plat by the City. If Dial does not purchase the
property and/or of the plat is not approved, then this consent and Letter of Intent shall be null and

the proposed buildings relationship to the originally designed detention pond and drainage easement.
Based on our review of this information, we have determined that the proposed building falls within the
originally proposed building rectangle and does not fall within the detention pond or drainage easement.

The purpose of this letter is to summarize Harmony Road access as it relates to the Harmony
Campus at Timberline Road.
Introduction
Harmony Road is Colorado State Highway 6S (SH 68). The Colorado Departrr:ent of Transportation
(CDOT) typically governs issues relating to Colorado State highways. Harmony Road is controlled
by CDOT, however several additional agencies govern the establishment of nev: access locations
along Harmony Road..
Access Plan
As a result of an Intergovernmental Agreement (IGA) between the CDOT and The City of Fort

with CDOT that this listed access is in fact only representing the North side and does not apply to
the south side at the location of this proposed access.
The Harmony Road Access Plan does include provision to consider additional right in/ right out
access points based on conformance to established requirements. Based on my current
understanding of the project and the proposed intersection, it does appear that the access may meet
the criteria allowing for a written request for an amendment to the Access Plan. Such amendments
are granted only by the agreement of all parties to the original IGA.
Federal Access Control Line
Harmony Road access is additionally controlled by the Federal Highway Administration (FHNVA)
throueh a deeded Access Control Line (A -Line). This line, generally the back of recorded SH 63
Right -of Way (ROW), constitutes the legal establishment of all recognized access points on
Harmony Road.
Both proposed PVHS access locations will require application to the FHWA, through CDOT for the
establishment or modification of the A -line.
State Highway Access Permit
The final control over the construction of any access to a state highway is the Srate Highway Access
Permit. This permit, issued by CDOT, represents the final approval for the constriction of a new
intersection on a state highway. Within the City of Fort Collins, The City has iss:!ing authority
working in conjunction with CDOT.

Schedule
Based on my most recent conversation with Matt Delich, P.E., the traffic study consultant, the TIA
document should be completed around the middle of July. Assuming contact with the City and
CDOT regarding the intentions to submit an amendment to the Access Plan are met favorably, we
could conceivably submit an application by early August. I am unfamiliar with the exact review
process in that only one amendment that I am aware of has been implemented (the Harmony
Safeway access), however I would like to think that a cooperative effort could gain approval from all
parties within a month or so. During this same period we could submit the East access A -line
package to CDOT for review. The FHWA review is rather lengthy (3 to 4 months), so most likely
the Application for State Highway Access Permit would not be filed until late fall. The access
permit turnaround is a matter of several weeks.

Re: The vacation of a portion of a drainage easement
Dear Mr. Klockeman,
This letter is in response to your request to vacate a portion of a drainage easement on Lot 5 of the
Harmony Village PUD property. After receiving your request, I routed a letter to the various departments
that this vacation would directly affect and stated your concerns. Please find enclosed copies of the
comments and concerns we received from these various departments. At the time of drafting this letter,
1 have not received any comments from U.S. West After reviewing the comments, I have concluded that
at this time the City cannot accept your request to vacate the portion of the drainage easement described
in your letter. I would, however, recommend that you contact each of the various departments to see if
you can address their concerns. If some arrangement can be made to accommodate the departments'
concerns while meeting your needs as well, we can proceed with the vacation process. I would just need
a letter from each department stating that all of the conflicts have been resolved.
If you resolve the issues of the various departments and still want to proceed with the easement vacation,
please fill out the enclosed application and return it to the Development Review department.
Should you have any further questions or concerns, please do not hesitate to contact this office.

SUBJECT: HARMONY ROAD BIKE LANE STRIPING
Dear Dave:
This letter concerns the striping of the bike lanes along Harmony Road adjacent to the Harmony
Village PUD ("Harmony Village") project. As you know, it is the City's policy to construct and
stripe bike lanes on certain streets within the City in accordance with our street standards and the
standards set forth by the City's Transportation Planning Department. Harmony Road, although
categorized as State Highway 68, is also classified under the City's standards as a major arterial
street. Because of this, the City is requiring the Developer of Harmony Village to construct the
necessary bike lanes required.
After a series of meetings and negotiations among you, your clients and City staff, it was
determined that Harmony Road would be striped as indicated on the approved Utility Plans for
Harmony Village. Because you have expressed concerns about the safety of the approved
striping plan, I want to assure you that the City of Fort Collins accepts the responsibility and
holds you and JR Engineering harmless of any wrong doing or professional negligence in the
design of the proposed bike lanes.
I hope this addresses your concerns regarding the striping of the bike lanes on Harmony Road.

I recently received several variance requests from you associated with Harmony
Village PUD. Both Cam McNair and I have reviewed the requests and have approved
items 1, 2, and 5 of your original letter. Please note that item 3 is not a City standard,
but is offered as a suggestion to provide for a more comfortable ride for the driver. Item
4 must be varied from the State Highway Access Code and is typical done by the

RE: Variance Request for Harmony Village

recently received three (3) variance requests to our Street Standards JR Engineering, Ltd.
Mike Cberlander is requesting the following variances of the Design and Construction
Criteria Standards and Specifications for Streets, Sidewalks, Alleys, and Other Public
Ways manual ("Street Standards"):
a. A variance to Section 1.02.03.09(g). The Street Standards state that the
minimum grade on a gutter shall be 0.40 percent. As you are aware, this is a
minimum value according to the City. After reviewing the variance, and
flowline and cross section design for Harmony Road provided by JR
Engineering, Ltd., I am recommending that the City approve the request to
vary the minimum flowline grade of 0.40 percent and allow a 0.30 percent
grade. Major roadway improvements would be needed to allow a minimum of
a 0.40 percent grade because Harmony Road is a State Highway and was
designed according to the State standards at the time it was constructed.
Allowing a 0.30 percent grade would also eliminate the need for a quarter
crown in the travel lane. This poses no immediate safety concerns to the
public.
b. A variance to the width of the raised median at the west entrance to the site
from 7' to approximately 4'. Referring to the cross section of a major arterial
street, the nose of a median at an intersection with a turn lane needs to be 7'
wide. This dimension allows for a pedestrian refuge for people crossing the
street. In the proposed situation, however, pedestrians are not encouraged to
cross at this location. Therefore, my recommendation is for the City to grant
this variance to the Street Standards with the understanding that this would
not have any serious ramifications to public safety.
C. A variance to Section 1.02.03.06(e). The Street Standards state that the
maximum allowable grade change is 0.40% without the use of a vertical
curve. A couple of grade changes exceed the maximum allowed per the
Street Standards. Upon examining the plans closely, if vertical curves were
required to be installed, a quarter crown is necessary in the travel lane. I
recommend that the City approve this variance request. Approval of this
request would not impose any safety concerns to the public.
Please find enclosed an original copy of the variance request letter and a copy of the utility
plans for your review. Please note that items 3 and 4 are not to be reviewed. Item three is
not a part of the Street Standards, but offered as a suggestion to maintain the driver's
comforts level. Item 4 needs to be varied from the State Highway Access Code. This is
done by the Developer's engineer with CDOT officials. Once they supply us with the
variance, we make an initial recommendation and forward it to the State for final approval (or
not). Your review and comments regarding this issue would be appreciated as soon as
possible so as not hinder the progress of this development.

Dear Tim;
JR Engineering 6s requesting variances from City Standards in several areas with
respect to the above plans. These stem from a meeting with you and Matt Baker where
it was decided that the City with its oversizing of Harmony Road does not wish to
completely reconstruct the existing roadway.
Specific areas where variance is requested are as follow:
1. It is requested that "catch curb" along the median of Harmony Road be allowed to be
built at a minimum 0.3% rather than 0.4% as per City Standards. This is needed to
most closely match the existing cross slopes of Harmony Road and facilitate
drainage to the proposed inlets. Without this variance it will be necessary to put a
quarter crown somewhere near the median. Please note that in the "CDOT Design
Guide" 0.31/v is called out as the minimum.
2. At the west entrance of Harmony Village it is requested that the raised median be
allowed to be less than 7' wide and have a 1' gutter pan on the northeast corner of
the intersection. The shape of this median was changed to try to maximize the
deterrent from tuning west on Harmony Road out of that intersection. The WB-50
turning template can negotiate this turn with this revised median shape.
3. It is requested that the minimum flowline radius be reduced from the 500' standard in
one location. Where the dual left turn lanes begin on eastbound Harmony Road the
radius along the median has been reduced to 100' to facilitate drainage in the "catch
curb". The City's detail for a bus turnout uses this 100' radius and that is why it was
chosen. Again this variance eliminates the need for a quarter crown.
4. Taper lengths and lane lengths on the left turn pockets (both directions) have been
reduced from SHAC guidelines because of the two intersections' proximity to one
another. The westbound left turn lane would be 560' with a 15:1 taper to meet SHAC
guidelines. This lane is designed with a 443' length and 13:1 taper. In this case both
the taper length and deceleration length are reduced slightly. The eastbound dual
lefts would be 700' with 15:1 taper to meet SHAC guidelines. The lanes are
designed with a 552' length and 9:1 taper. All of the reduction in total lane length in
this case is taken up in the taper. The total distance between the two intersections is
