[6/1/04] The walkway in the NW portion of the site that connects to the existing facility on Timberline appears to end
abruptly at the eastern -most drive aisle (immediately south of the trash enclosure). This is problematic in that there is
no clear way for a pedestrian to proceed to the building entrance. This could be remedied by expanding the eastern
curb face radius outward, carrying the building side walkway out into the new extension, and painting/striping a
crosswalk across the drive aisle. See red -line for a visual description of this comment.

configuration as it dumps pedestrian traffic directly into the parking lot with no clearly defined route of access to any

Handicap access for the site is provided on east and south portions of the
property. The new building is totally handicap accessible. The LDS
Church is providing stairs for pedestrian access to the west from
Timberline because planning is requiring it. There is no code or standard
that says we have to provide a ramp or handicap site accessibility to three
sides of our site. The LDS Church does not want the stairs because they
will not be used. They would prefer not to build a ramp because there are
two other ways (east and south) to have handicap accessibility to the site
not to mention vehicular access from three driveways. Why does there
need to be handicap site access for more than two sides of the site?
Where is the code that says a ramp is required at this location when other
ways are provided?

landscape architect has informed me that the strip of land between the

comply with any and all Poudre Fire Authority requests. We have
accommodated the fire department by moving the fire hydrant, the "Y"
connection to the building, and moving the fire alarm panel to the north
side of the building. This all will show up in the construction drawings in
the permit review.

flows are captured in the low point.

the property I have been told that they are okay with the changes to the irrigation line. He
specifically spoke of changes to a manhole. Per the plans submitted there are no changes

so they need to be identified. It also seems that Westchase HOA is responsible for the
maintenance and liability for this line through the neighborhood. Therefore we need to have
the HOA and the irrigation users sign off on the plans or sign off on a letter that they are
okay with the changes shown on the utility plans and have reviewed them. If a letter is
provided a half size copy of the sheets they reviewed and okayed need to be provided.
Need a letter of intent from the HOA and the irrigation users that they plan to approve the
changes prior to scheduling for hearing.

EASEMENT AND RIGHT-OF-WAY DEDICATIONS
PREPARATION:
Determine to whom the easement is being dedicated. Deeds of dedication to the City must come
through the city for acceptance by Council and are recorded at the County by the City Clerk's
office. The process for acceptance of deeds is described in more detail below.
Easements between private parties such as construction easements or cross access easements are
prepared and recorded at the County by the private parties. The city may request copies of such
easements to verify that the developer has received permission from adjacent owners to do
certain work off -site, however the City does not need an original document and does not process
or record private easement dedications.
Right-of-way is a permanent dedication of land to the City for public street purposes and the
dedication statement on the deed is modified accordingly. (See the language in the sample
dedication statement handout.) The paragraph regarding maintenance is also modified since the
City does take oveir maintenance of right-of-way upon completion and acceptance of the street
improvements.
For easement dedications, insert the appropriate language for the type of easement being granted
Temporary of Permanent
If possible, on temporary easements add language to describe an event which will
trigger expiration of the easement if the future. e.g. Temporary turn -around
easement expiring upon extension of the street to another through street or upon
dedication of another turn -around easement. This eliminates the need to vacate
the easement at a later time.
Type of easement - drainage, utility, access,
Easements can be combinations of these.
Across easements should specify pedestrian and bicycle of nonvehicular public
access, emergency access, general public access, or some combination of these.

-complete and appropriate for the type of easement being granted (includes
maintenance statement)
- Blank for City Clerk's acceptance provided at the bottom (see sample deed)
-owner's signature including all lien holders and notary
Legal description included in dedication statement or attached and labeled as Exhibit "A"
- prepared by a licensed professional land surveyor
Attorney's certificate or title insurance policy attached
-Attorney signing certificate can be any private attorney (typically representing the
owner of grantor) it is not the City Attorney.

PROCESS:
Turn all development related deeds of dedication in to the Development Review Center. One
original of all documents must be submitted. Stormwater Utility, Parks, Natural Resources, ...
may request copies, but the original must be delivered to the Development Review office.
Format of the deed is checked to see if it is correct and complete. Special language added or
certain modification may require review by the City Attorney. Legal description is checked. If
errors are found, deed is returned for correction.
Once the deed and legal are correct, a vicinity map and agenda item are prepared for the City
Council Agenda. Generally, deeds are on the consent agenda under "Routine Deeds and
Easements". Upon acceptance by Council, deed are recorded with the Larimer County Clerk and
Recorder's Office by the City Clerk.
Current recording fees are $6 for the first sheet of each document and $5 for each additional
sheet. Items that are recorded include, but are not limited to the dedication statement, attorney
certification, signature pages, the legal description, and the sketch.
Checks should be made out to: Larimer County Clerk and Recorder
The first sheet of the document must have a space at the top of the page of at least 1" high x 4"
wide for the county to use for the recording process. If this is not provided an additional blank
sheet will be needed for the recording information and you will be charged the 5 dollars to record
it.

so they need to be identified. It also seems that Westchase HOA is responsible for the
maintenance and liability for this line through the neighborhood. Therefore we need to have
the HOA and the irrigation users sign off on the plans or sign off on a letter that they are
okay with the changes shown on the utility plans and have reviewed them. If a letter is
provided a half size: copy of the sheets they reviewed and okayed need to be provided.
Need a letter of intent from the HOA and the irrigation users that they plan to approve the
