2. A floodplain use permit including a $25 permit fee is required for any work done on the
property including remodels, fencing, handicap ramp, etc.. Please contact Marsha
Hilmes-Robinson at 224-6036 to discuss the permit requirements.
3. if the cumulative value of improvements/remodel work to either of the existing
structures exceeds 50% of the market value of that structure, that structure must be
brought up to the current floodplain code (i.e. floodproof or elevate non-residential
structures, elevate residential structures).

1. Mulberry is considered a constrained arterial with a total ROW of 102'. This project is required to dedicate enough
ROW to bring their half up to standard: 5 1 ' from the centerline of Mulberry.

3. 9' standard utility easement along Wayne.
4. 8' utility easement along the alley.

toward the house so that a car parked there will not overhang and block the sidewalk. Can the manhole be lowered to
achieve this? What is the manhole for? If 19' cannot be provided, then this parking space and curb cut need to be
removed.

City staff's primary concern is the parking for this proposed "place of assembly" for
meetings and other gatherings. The Planning Objectives do not sufficiently describe
the type, amount, and frequency of groups of people that will assemble or gather here.
Therefore, it is very difficult to evaluate the potential parking impacts and conflicts
that may occur.

The existing vegetation on the property (trees, shrubs, etc.) must be identified as
such. An additional new street tree is needed in the parkway area between the 2 curb
cuts on Wayne Street. Are all the existing fences shown on the Site Plan?

The parking variance, as submitted, is insufficient to ensure adequate parking for this
"place of assembly" (especially since the information about the gatherings is very
vague). The referenced sites to be used for parking, generally, are too remote and
require crossing of one or more arterial streets. Also, have these sites given
permission for your guests to use their parking spaces?

City Code recognizes only 2 parking spaces on the property. The 8' wide concrete drive
from Wayne Street to the front door of the residence at 1024 West Mulberry Street
is too short to be considered as an off-street parking space. A minimum of 19' depth
behind the sidewalk is necessary to prevent parked cars from overhanging onto the
sidewalk, thereby restricting pedestrian movement on the sidewalk. Cars stacked front
to back, as they would have to be in the garage and driveway of the existing carriage
house at 520 Wayne Street, do not count as 4 off-street parking spaces as 2 cars
would always be blocked and their movement encumbered.

Sprinkler Requirements for an A3.
Stairways: An automatic sprinkler system shall be installed in enclosed usable space
above or over a stairway. Buildings that are required to be fire-sprinklered shall have a
minimum 6-inch fire line unless hydraulic calculations can support a smaller fire line.

I am concerned about having adequate parking available. I need more information as to
number of spaces required and number of parking spaces actually available per the
variance request. It would be helpful to know more about the types and sizes of group
meetings to be held at this location to help determine adequacy.

The proposed use is classified as a place of assembly. This must be stated on the Site
Plan.

Their "contextual site plan" (8 1/2 x 11 sheet) has two properties marked with an
asterisk. One is the subject property, the other is Dunn Elementary. They have
labeled the Dunn property as the cultural center. They need to label the correct lot as
the cultural center. I believe their "parking" narrative is a request for alternative
parking compliance, so the contextual plan should be a part of the alternative
compliance request, and it should label the school site, the insurance site, and the two
pedestrian cross walk light locations so that the request can be adequately reviewed. I
would say that the 7/11 and Gilsdorf Garage should not be included in the request
because of their remote location. Between the school and the insurance office, they
should be able to provide more than adequate parking. Additionally, they should include
some sort of letter of agreement from the school and the insurance office stating that
they agree to make: parking available.

The site plan should contain additional information relevant to the square footage in
order to determine: how many parking spaces are required. For example, how much of
the 1326 s.f. main floor will be considered to be meeting room(s)? The required
number of parking spaces will be based on the square footage of the meeting rooms.
This square footage should not include kitchen, bathroom, halls, closets, etc. Required

parking is 1 space for every 4 "seats", Since there won't be fixed seating, it is based
on building code occupancy as determined by the square footage of the meeting room -
1 person for every 15 square feet. For instance, a 500 s.f. meeting room results in on
occupancy of 33 people. Parking is then determined by dividing 33 people by 4, which
equals 8.25 parking spaces (rounded up to 9). Also, the site plan lists the floor area of
the building as 1327 square feet plus 612 square feet. Where is the 612 square feet?
Is it in the basement, or on a second floor?
There are several significant comments that must be addressed prior to this item
going to a Planning and Zoning Board public hearing. Another round of review is
considered to be necessary. This proposal is subject to the 90-day revision re -
submittal requirement (from the date of this comment letter, being September
22, 2003) as set forth in Section 2.2.11(A) of the Land Use Code. Be sure and
return all of your red -lined plans when you re -submit. The number of copies of each
document to re -submit is shown on the attached Revisions Routing Sheet.

RESPONSE TO STAFF REVIEW

After a telephone conversation on November 20, 2003, in which
we requested that the city would not require us to dedicate
the Right of Way and easements, Katie Moore said they would
discuss the matter. She called us on November 25, 2003 and
told us that it would not be necessary to dedicate the ROW
and easement on Mulberry Street.

therefore we will not lengthen the driveway. The manhole
was a coal delivery chute for furnace coal. It has been
sealed.

would be left as -is. If the driveway is not to be used, it needs to be closed, the concrete removed, and new curb and gutter
installed along the street to match the existing curb and gutter. Please show this on the plans.
