If the building is moved north as we discussed for drainage purposes, then canopy shade trees will be required. If the building stays where it is proposed now, perhaps a mix of canopy and ornamental trees could be explored. Due to the proximity of the building to the street and sidewalk area, there is not adequate space for canopy trees. As the trees mature, they would grow into the building, which would be detrimental to both the building and the trees. Ornamental trees are proposed for this area, planted at an average of 20'-0" o.c. and will be up -sized from the required minimum tree sizing in lieu of the canopy trees. In previous meetings with City Staff, it was discussed that this planting area was narrower than the minimum. It was determined that the proposed design would be acceptable with the addition of the sidewalk within this area. It was also considered that the adjacent property was vacant, and the landscape area between the properties would share in the planting area. At a minimum you need a visual analysis that: a. identifies the extent to which existing views may be blocked; b. depicts in graphic form views before and after the project, utilizing photographs of the area and neutral drawings derived from at least two (2) points from which the proposal will be commonly viewed, one (1) of which should be a vista towards the foothills; and c. indicates these points of observation on an inset map or plan of the area; and Page 2 d. a summary of the key conclusions of the shadow and visual analysis, and steps to be taken to comply with the review standards set forth above. Either way, the City will need at a minimum, a letter of intent from the ditch owner stating that the ditch easement is no longer needed or desired. Future projects shall comply with International Fire Code and PFA policy, which require that buildings be addressed off the street that provides access to the site. In the future, a project such as this will receive a Birch Street address, which is the actual, accurate street that provides access onto the site. The two lots in this project at one time had Shields Street access; however, the development is starting from scratch, the property is being redeveloped, and access is not off Shields Street. PFA's emphasis on consistent addressing requirements ensures accurate, clear addressing, which enables PFA to provide emergency services as expeditiously as possible. We appreciate PFA allowing this development to proceed with 609 S. Shields addressing. TVe believe this will better serve the commercial tenants and their customers, all of which front onto S. Shields Street. Per the Larimer County Urban Area Street Standards, Fig 7-2F, a 15 foot wide easement shall be provided behind the Right -of -Way for 4-Lane Arterial streets. Also, per the Larimer County Urban Area Street Standards, Fig 7-9F, a 9 foot wide easement shall be provided behind the Right -of -Way for Residential Local streets. The proposed easements for the Hellenic Plaza Development are 3 and 6 feet behind the Right -of -Way for Shields Street (a 4-Lane Arterial) and Birch Street (a Residential Local), respectively (please see attached). This variance is being requested due to physical constraints on the site. Also, since many ' utilities are already installed along these two existing streets, the need for the easements p is reduced. The affected utility companies were contacted to get information regarding the need for additional easement. As a result, many indicated no easement requirements. The 3 and 6 foot easements for Shields Street and Birch Street are a result of utility company requests for easements. In conclusion, full compliance with the Standard Design Criteria would impose undue hardship in developing the site. It is our opinion that the proposed design will adequately meet the intent of the standards for the health, safety and welfare of the public. This will be a better solution that having the sidewalk placed up against the building (we would normally be asking for 2 feet additional sidewalk or the building to be setback an additional 2 feet to accommodate the encroachment on the usable sidewalk width). So this will make the sidewalk work better, give them 2 feet in which to do some foundation plantings and would ultimately reduce the parkway width to 6 feet (which is the minimum width we allow for a parkway). Ideally they would also place the street trees 3 feet off of the sidewalk edge, so they will fall within the ultimate parkway and not have to be located at such time as the roadway is widened. I think this is what they are going to do, but they needed to talk to Barbra and still may want to place the sidewalk where they had been showing it. They are aware that if they do that they are not eligible for street oversizing reimbursement and we would want them to escrow for the future sidewalk relocation. Shelby was also in the meeting so if you have any question next week you can talk to her as well. We asked that they resubmit plans to you showing what they decided and were going to do. If you still intend on pursuing an Administrative review rather than Planning and Zoning Board then you will need to make the portion of the building in the NCB area residential only.
