We hereby request a waiver from the requirement to provide a 9' utility easement along
the Hemlock Street frontage. Our justification for the request is as follows:
The Hemlock Street right-of-way is more than adequate to provide access for
utilities adjacent to the property. More specifically, there currently exists 32 feet
of undeveloped ground between the southerly curb and gutter and the southerly
limits of right-of-way.
Due to the small dimensions of the site for the proposed development we would
like to place the proposed building 1 foot from our north property line.

Dear Brian,
This letter is in response to the variance request letter sent to me dated August 6, 2007 regarding a variance to the
required 9 foot utility easement behind the right-of-way along the Hemlock property frontage .
The variance request to waive the requirement of a 9 foot utility easement behind the Hemlock R.O.W. along the
property frontage as required by Figure 7-61' of the Larimer County Urban Area Street Standards (LCUASS) is
approved.
This variance request approval does not set a precedence or change the application of our design standards in other
