Dear Ms. Robinson:
Staff has reviewed the request for final P.U.D. and final
plat for Sunstone
Village Fourth Filing and offers the following comments:
I. Outlot A should show a sidewalk that will be constructed with the Fourth
Filing. The City has had discussions with American
Continental Homes
regarding the sidewalk opposite the drainage/bikeway in
the Fox Meadows.
It was decided that the best sidewalk would be concrete
from fenceline to
fenceline. This would keep maintenance and repair to a
minimum.
2. It will be required to provide water and sewer stubs
to Tract A from
Stoney Creek Drive.
3. You are reminded that a repay exists on the Warren Lake Trunk Sewer
Line. This repay, however, may have been satisfied as
part of an earlier
filing.
4. The cover sheet for the P.U.D. site plan needs a signature block for the
Secretary of the Planning and Zoning Board.
5. The same cover sheet also needs a legal description. R-
6. The design for the improvements to Timberline should be included with the
utility plans.
7. If any signage is anticipated with the Fourth Filing, it must comply with
the sign code.
8. Since the City will be - ssuming maintenance of Tract A after the establish-
ment period, there are some comments related to the landscaping.

These comments arc as follows:
A: The proposed plantings should be listed in a table describing exact
specie type, quantity, and size. Also, please include groundcovers.
B: Please add the note to the final site plan: "All plant material must
meet specifications of the American Association of Nurserymen (AAN) for
number one grade. All trees must be balled and burlapped, or equivalent."
C: Also, please add this note to the site plan: "All landscaping shall be
installed prior to issuance of a certificate of occupancy on any portion of
this Planned Unit Development or secured with cash deposit, irrevocable
letter of credit, or performance bond for 125% of the estimated cost of the
landscape improvements as determined by a minimum of three bids."
D: Also, please add this note to the final site plan: "The developer/owner
of this Planned Unit Development shall provide continued maintenance and
replacement of landscape improvements for a period of two (2) years after
installation or until such time as the City of Fort Collins Stormwater
Utility accepts the landscape improvements for purposes of maintenance."
E: It will be necessary to provide edging for the proposed shrub beds. This
will assist in maintenance of the groundcover by mowing equipment. It is
not clear what is meant by "free form edging". Please address the edging
treatment on the site plan.
F: It is suggested that the shrub beds be consolidated so that a narrow
strip of groundcover is not left on the opposite side of the concrete walk.
These narrow strips will be difficult to maintain. In these areas, it may
be preferable to put a shrub bed on both sides of the walk.
G: Staff recommends adding some deciduous shade trees for seasonal vari-
ety to Tract A. These could also be clumped and treated with mulch and
edging to facilitate maintenance.
9. Comments from the Stormwater Utility will be under separate cover.
10. Architectural elevations were not submitted with this Filing. If there are
to be no substantial changes from the previous filings, then please provide
a one sheet mylar at the time the final documents are due.

This concludes Staff comments at this time. Please note the deadlines for the
August 22, 1988 Planning and Zoning Board hearing:
Plan revisions are due on August 3, 1988.
PMT's, colored renderings, and 10 final prints are due August 15, 1988.
Final documents are due on August 18, 1988.

RE: Sunstone Filing 4 Development Agreement
DATE: August 17, 1988
The following represents the summary of the meeting held with Glen Stephens
and Dave Shupe regarding the details of the Development Agreement for the 4th
Filing of Sunstone Village P.U.D.
STORM DRAINAGE ISSUES:
L The final Drainage Report and drawings are not complete. They must be
revised to show the basins extending out to the center line of the adjacent
public streets, particularly Timberline Road. Shupe was not aware of this.
2. The drainage information on Tract A is not complete. It is not clear how
the site will accept upstream drainage and how it will be released off the
Tract. The Report must account for the additional flows since the basin
will be extended to the center line of Timberline Road. Shupe will make
the necessary adjustments.
I The Development Agreement must contain an Exhibit B for regional drain-
age improvements. There is no way the City can reimburse for regional
improvements without a development agreement. Stephens was concerned
about slow paybacks from the City and that this was an administrative
cost. Schlueter explained the process could be speeded up. It should take
no more than two weeks to cut a check to Stephens provided all the
invoices are reviewed and approved by the City with sufficient lead time.
4. Exhibit B would be for design of a storm sewer line on the east side of
Timberline Road upstream (south) of Caribou Drive to collect flows from
the Chandler (Sp?) sump. The design must also include a crossing of
Caribou from south to north. A construction easement from G-T Land
would be needed but this does not appear to be a problem. This line is
anticipated to be about 1,000 feet.
5. Stephens is concerned about a possible lawsuit from the local irrigators who
would claim some violation of water rights. He has heard these irrigators
are extremely upset with the City. Schlueter is willing to put into the
Development Agreement that the City would indemnify (hold harmless)
Stephens from any liability associated with the project. According to the

City Attorney, the project is on a sound legal basis.
6. Stephens asked if money was available for the regional improvements that
would be descr6ed on Exhibit B. Schlueter replied that money is avail-
able now and not subject to any budgetary action by City Council. Money
will also be available next year.
7. Exhibit B will be added to the Development Agreement in the form of an
amendment. It was agreed that December 31, 1988 would be a generous
deadline and that this date should be put into the original language of the
Development Agreement. Shupe said it should be complete by September
30, 1988 but Herzig explained it takes about three weeks to officially
amend the agreement and go through the proper channels and procedure.
TIMBERLINE ROAD DESIGN AND IMPROVEMENTS:
1. Herzig stated that Timberline Road must be designed and improved as an
obligation of Filing Four. Stephens asked if these improvements
could be postponed and tied to Tract A. Herzig responded that this would
not be acceptable. Design must include sidewalk, curb, and gutter and the
appropriate pavement width and thickness. Design must be logically
related to beyond the property line. City Code states that this distance
beyond the property line could extend as far as 1,000 feet if necessary.
2. Stewart Engineering has done some design work for that portion of Timber-
line Road that fronts Bill Tiley's property. Shupe was informed to contact
Dick Rutherford for details. Stephens warned that the out parcel between
Sunstone and Tiley is owned by an uncooperative seller who is asking a
very unreasonable price for his land.
3. In order for Shupe to do the design, Herzig must provide some detailed
information on the design parameters. Herzig acknowledged that he would
do this.
4. Shupe provided a letter, with documentation, that the widening and surfac-
ing of Timberline Road acceleration and deceleration lanes that was
associated with Sunstone Filing One has already received some reimburse-
ments from the street oversizing fund. Herzig said he would check with
Matt Baker as to what remains to be done. After checking with Baker,
Herzig will contact Shupe as to what improvements are to be designed and
obligated for in Development Agreement for Phase Four. Shupe will then
perform the design work immediately and submit to Herzig for review and
revisions.
PLANNING AND ZONING BOARD HEARING OF AUGUST 22, 1988:
There will not be a signed Development Agreement in time for the P & Z Board
hearing. Ted Shepard, Project Planner, decided that there was sufficient
agreement in principle among all the parties to keep the item on the agenda. It
was further agreed by all the parties that utility construction mylars would not
be signed off by the City until the Development Agreement had been executed
by all the parties.
It was further agreed that there will be no recording of the plat and the P.U.D.
until the Development Agreement was finalized and executed by all the parties.
Jim Faulhaber stated that the utility mylars are in good shape and that Valerie
was making the latest revision as of this afternoon.
All additional design for the Development Agreement will become part of the
utility plans to be fully reviewed by all pertinent City departments. Revisions
and re -design will be as with any set of plans associated with a final plat and
P.U.D.
Ted Shepard stated there will be no reason to pull the item off the consent
agenda.
