Dear Morey,
This letter is to follow up our telephone conversation of this
afternoon regarding the disposal of the offsite water from the parcel of
land immediately South of the proposed Wagon Wheel Filing #3 Subdivision.
As I mentioned in our conversation, I spoke with Mark Engemone earlier
in the month and explained that Melody Homes will grade its site in such
a way as to direct all the developed flows from the Wagon Wheel Subdivision
to the detention ponds indicated on the drainage study for the proposed
Wagon Wheel #3 Subdivision.
The historic offsite water has entered, and will continue to enter,
the site in the extreme Southeast corner, adjacent to Shields Street.
The flow has, historically, exited the property via a 15"CMP under Shields
Street. We propose to maintain this structure until such a time as the
property to the East of us, presently known as Cunningham Corners, is
developed, at which time we will construct an outfall pipe to connect
with the catch basins in Shields Street low point, in approximately the
same location as the existing 15"CMP. I have conversed with Larry E.
Stanton of Taranto Stanton and Tagge Consulting Engineers, who are doing
the engineering for the replat of Cunningham Corners to confirm the low
point in Shields Street, and also the pipe outfall from the same.
I hope this clears up your questions regarding the drainage study
for the proposed Wagon Wheel Filing #3 Subdivision. Should you require

Dear Mr. Peterson:
Mr. Pat Clark of Melody Homes Incorporate�4as expressed to me your con-
cerns regarding the Public sidewalks adjacent to your property.
When this sidewalk was initially constructed the Concrete Contractors and
Developers informed the City of an error with its installation. Upon much
discussion and evaluation of this problem the City decided to accept those
portions of sidewalk, curb and gutter already constructed.
This decision was based upon:
A. The Foundation height of the proposed structures was such that water
run off would easily flow over the walk and into the gutter.
B. The reverse slope on the existing walk sections averaged one -quarter
inch or less (a large portion of sidewalk was level).
C. Due to the existing terrian all surface water would flow laterially
or transversely across the sidewalk and into the street.
In order to reinforce this decision these sidewalks have been monitored
for the past several months.
It has been noted that when the sidewalks are free of snow the water does
drain. In fact due to the terrian these sidewalks are free of snow run
off sooner than the sidewalks in the flater areas of the subdivision.
It is our opinion that the present sidewalks situation does not nor will
not pose a hazard to pedestrian safety. In response to your concerns re-
garding the freezing of run off water on your sidewalk during the winter
months this is a natural occurrence. In the winter months this happens
throughout the entire city regardless of the type of curb, gutter and
sidewalk.
Even though this sidewalk does have a slight degree of reverse slope the
problems you are experiencing with it are not much different than new home
owners in other partially completed subdivisions.

Re: Shields Street Widening
Wagon Wheel Subdivision, Filing No. 1
Dear Dave:
We wish to confirm your conversation with our Mr. Mauri Rupel,
S.I.D. Coordinator, wherein you proposed to remit an amount of
$47,938.22 plus 25% ($11,984.68) for a total of $59,922.90 for
your share of constructing Shields Street to arterial standards
in accordance with the subdivision agreement for Wagon Wheel
Subdivision, Filing 1, dated August 1, 1979.
Upon receipt of your check in the above total amount, we will
combine that fund with the street oversizing fund and the
Cunningham Corners S.I.D. to pay for widening of Shields Street
from Horsetooth Road to the north property line of Wagon Wheel
Subdivision.
This payment constitutes complete payment for your obligation for
widening Shields Street abutting Wagon Wheel Subdivision under the
subdivision agreement dated August 1, 1979. Please make the check
payable to the City of Fort Collins, Colorado and mail to the attention
of Mr. Jim Harmon, Finance Director.
