Re: Willow Grove Development Agreement
Gentlemen:
In May 1984, Metcalf, Ltd. entered into a Development Agreement with the
City of Fort Collins for the develOPwmt of Willow Grove Village. Part of
that Development Agreement called for improvements to be made to "Phase H
of the Cunningham Corner Master Plan".
In September 1985, Metcalf, Ltd. entered into another Developwnt Agreement
for Five Oaks Village covering Phase H of the Cunningham Corner Master plan
or "Tract D of Chestnut Village", as it was then legally known. This new
develgpment reconfigured and platted this parcel of land and contained it
within this new develcpnent for Five Oaks Village, Tracts A, B & C.
The City's Storm Drainage Department states that the completion of the
storm drainage improvements is a function of the building construction.
Therefore, both the Five Oaks Village and Willow Grove Village Development
Agreements are still in effect. The responsibility for completion of the
drainage improvements will be triggered by whomever constructs the number
of units as outlined in each agreement.

Gentlemen:
We have reviewed the development greements for the Five Oaks Village PUD
and the Willow Grove Village PUD. We have also inspected the detention pond
presently constructe on arce "C" of the Five Oaks Village PUD. The
detention pond has been rough graded.
The landscaping and fine grading of the detention pond area (Tract "C" Five
Oaks Village PUD) are integral to the Five Oaks Village approved utility and
landscaping plans. The final landscaping of this area is to be completed by
the developer of the Five Oaks Village PUD with the construction of the
units in the Five Oaks Village PUD. The final landscaping shall be required
with either the development of the adjacent units to the pond or prior to
the issuance of the building permits for the final phase of the Five Oaks
Village.
The City will not look to the developer/builder of the Willow Grove PUD for
the final grading and landscaping improvements in this pond area (Tract "Cu
Five Oaks Village PUD). The developer of Willow Grove will, however, be
responsible to the City to provide certification prior to the 4th building
permit to the City that the pond is built to the approved utility plans
contained within the Five Oaks Village PUD. Said certification will include
the condition of the pond and the improvements in place. Prior to the
issuance of the fifteenth (15) building permit in the developer of the Five
Oaks Village PUD shall be responsible for the modifications, if any, as are
necessary to bring the pond into conformance with said plan.
This letter supercedes that letter dated May 3, 1989 to Shields Street
Corporation from David Stringer. If this meets with your approval please
initial and return a copy for our files. Thank you for your assistance in
