HomeMy WebLinkAboutSOUTH COLLEGE HEIGHTS FIFTH - Filed EV-EASEMENT VACATION - 2004-02-17RCPTI # 87012688 03/05/87 10:08:21 # OF PALES - 2 FEE - $6.00 M RODE MER!ER, RECOF 'R - LARIMER COU4TY, CO S PE DOC FEE $.00 ORDINANCE NO. 30 , 1987 OF THE COUNCIL OF THE CITY OF FORT COLLINS VACATING AN EXISTING UTILITY EASEMENT ON LOTS 176 AND 177 IN SOUTH COLLEGE HEIGHTS FIFTH SUBDIVISION WHEREAS, the Council of the City of Fort Collins has been petitioned to vacate a utility easement located on Lots 176 and 177 of South College Heights Fifth Subdivision set forth in particular below; and WHEREAS, this easement currently runs under the structure erected on the property; and WHEREAS, the current owner is unable to sell the property until the easement is vacated; and WHEREAS, there is another utility easement dedicated on the east boundary of the property; and WHEREAS, all utility companies have been contacted and have no objection to the vacation; and WHEREAS, the rights of the residents of the City of Fort Collins will in no way be prejudiced or injured by said vacation. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that a utility easement located on Lots 176 and 177 in South College Heights Fifth Subdivision, set out more particularly as follows, to wit: Legal description for vacation of a utility easement on, over, and across Lots 176 and 177, South College Heights Fifth Subdivision, City of Fort Collins, County of Larimer, State of Colorado, described as follows: Beginning at the Northwest corner of said Lot 176; thence along the West line of said Lot 176 South 6.00 feet; thence East 115.00 feet to the East line of said Lot .176; thence along the East line of said Lots 176 and 177 North 12.00 feet; thence West 115.00 feet to the West line of said Lot 177; thence along the West line of said Lot 177 South 6.00 feet to the point of beginning. Said parcel of land contains 1380 square feet, more or less. be, and the same hereby is, vacated, abated and abolished. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that that certain utility easement, more particularly described as follows, to wit: The West six feet of Lot 146 and the East six feet of Lot 145, South College Heights Fifth Subdivision in the City of Fort Collins, Colorado, except the North ten feet thereof. be, and the same hereby is, abolished, vacated and abated.
