The BOARD OF GOVERNORS OF THE COLORADO STATE UNIVERSITY
SYSTEM ("Board"), whose legal address is 309 Administration Bldg, Fort Collins, CO 80523
County of LARIMER, and State of COLORADO, for good and valuable consideration, the
receipt and sufficiency of which are hereby acknowledged, in hand paid, hereby sell(s) and
convey(s) to THE CITY OF FORT COLLINS, a Political Subdivision of the State of Colorado
("City"), whose legal address is 300 LaPorte Avenue, Fort Collins, CO 80521, County of
Larimer and State of COLORADO, the following real property ("Property") in the County of
Larimer and State of Colorado, to wit:
SEE EXHIBIT "A" ATTACHED HERETO AND INCORPORATED HEREIN,
with all its appurtenances, and warrants title against all persons claiming under the Board subject
to general property taxes and assessments for 2008 and all subsequent years and other easements,
interests and restrictions of record, with the following special requirements:
1. The improvements to be constructed upon the above -referenced Property have been designed
per the drawing and specifications dated 8/19/2008, as approved by the City's Engineering
Department.
2. Colorado State University will provide the maintenance and repair warranty, including repair
and/or replacement of any damaged areas on the improvements so constructed on the
Property, for a period of two (2) years from and after the date of the Notice of Acceptance of
said improvements by the City.
3. The City will assume all repair and maintenance of the improvements from and after the end
of the two (2) year period provided in paragraph 2. above and Colorado State University shall
have no responsibilities for such thereafter, except as described in 5, below.
4. This Deed is subject to any rights -of -way or other easements now existing on, over or under
the Property above described.
5. The Board reserves the right for Colorado State University to install and maintain utilities of
any kind for its own current and/or future purposes on, over or under said Property forever,
which right is subject to Colorado State University's obligations to (a) install any and all such
utilities in accordance with all applicable provisions of the Code of the City of Fort Collins,
including acquisition of any required permits and payment of any fees; (b) coordinate all
work on the Property with the City; and (c) repair and restore to its prior condition any part of
the Property damaged or disturbed by Colorado State University's utility installation
activities, as required by applicable City Code provisions or standards. This reserved right is
not assignable by Colorado State University without the consent of the City.
6. Colorado State University will coordinate all current and future work in the ROW with the
City, and all work to be done will be to current City standards.

A strip of land Twenty (20) feet in width being part of the Northeast Quarter (NEI/4) of Section
Seventeen (17), Township Seven North (T.7N.), Range Sixty-nine West (R.69W.) of the Sixth
Principal Meridian (6thP.M.), County of Larimer, State of Colorado, and being more particularly
described as follows:
COMMENCING at the Northeast Comer of said Section 17 and assuming the East line of said
NEIM as bearing South 00°10'18" West, being a Grid Bearing of the Colorado State Plane
Coordinate System, North Zone, North American Datum 1983/92, a distance of 2639.77 feet with
all other bearings contained herein relative thereto:
THENCE South 00°10'18" West along said East line a distance of 435.70 feet to the Southeast
comer of that parcel of land described as Parcel I in Bargain and Sale Deed recorded September
27, 1973 in Book 1573 at Page 288 of the records of the Larimer County Clerk and Recorder
(LCCR);
THENCE North 89°49'34" West along the South line of said Parcel 1 a distance of 30.00 feet to
the West Right-of-way (ROW) line of Overland Trail, said point being the POINT OF
BEGINNING;
THENCE South 00°10'18" West along said ROW line a distance of 433.67 feet;
THENCE North 89°49'42" West a distance of 20.00 feet;
THENCE North 00°10' 18" East along a line being parallel with and Twenty (20) feet West of said
