OF THE PLANNING AND ZONING BOARD
OF THE CITY OF FORT COLLINS
VACATING A PORTION OF THE DRAINAGE EASEMENT
ON LOT 3 OF THE HARMONY SAFEWAY MARKETPLACE P.U.D.
WHEREAS, Section 2-353 (4) of the Code of the City of Fort Collins authorizes the
Planning and Zoning Board to vacate certain rights -of -way, by resolution or by approval
of replats containing notation of such vacation; and
WHEREAS, the Owner of Lot 3 of the Harmony Safeway Marketplace P.U.D. has
requested that the City vacate a portion of the drainage easement on Lot 3 of the Harmony
Safeway Marketplace P.U.D. as more particularly described on Exhibit A attached; and
WHEREAS, the vacation request has been reviewed and approved by the pertinent
City and private utilities, and they report no objections.
NOW, THEREFORE, be it resolved by the Planning and Zoning Board of the City
of Fort Collins, that a portion of the drainage easement on Lot 3 of the Harmony Safeway
Marketplace P.U.D. as more particularly described on Exhibit A, attached hereto and
incorporated herein by this reference, be and is hereby vacated.
Passed and adopted at a regular meeting of the Planning and Zoning Board of the
City of Fort Collins held this 41h day of February A.D. 1999.

That portion of Lot 3 of HARMONY SAFEWAY MARKETPLACE P.U.D., being
in the Southwest Quarter of Section :31, Township 7 North, Range 68
West of the 6th P.M., City of Fort Collins, County of Larimer,
State of Colorado and being described as follows:
Considering the West line of said Lot 3 as bearing North 00°20'00"
East and with all bearings contained herein relative thereto.
Commencing at the Northwest Corner of Lot 3 of said HARMONY SAFEWAY
MARKETPLACE P.U.D.; thence South 74°13'03" East, a distance of
215.99 feet to the True Point of Beginning; thence North 28°00'01"
Fast, a distance of 28.29 feet; thence South 61059'59" East, a
distance of 171.82 feet; thence South 00°25'34" West, a distance of
28.88 feet; thence North 61059'59" West, a distance of 172.13 feet
to the beginning of a curve tangent to said line; thence
northwesterly and westerly a distance of 13.43 feet along the curve
concave to the south, having a radius of 33.00 feet and a central
angle of 23"18143" to the Point of Beginning. Containing 0.105
