PERFORMANCE REQUIREMENTS OF THIS PERMIT:
1. The Permittee shall be responsible to require their Project Engineer to incorporate into
all design drawings and specifications the certification of all materials testing by an
Engineer. The Permittee shall have an Engineer prepare revised design drawings and
secure City approval for all revisions to the Utility Plans and related documents. The
Permittee shall have an Engineer represent, as required by the City in the Development
Agreement, that the improvements are constructed in conformance with the approved
Utility Plans and the standards and specifications of the City. The Permittee shall provide
Aas-constructed plans prepared by an Engineer prior to the City's acceptance of the
constructed public: improvements. (All references above to the terms "Project Engineer
and Engineer shall mean a Professional Engineer licensed in Colorado.)

This Letter of Credit is intended for the completion of Tract D, The Homestead P.U.D., ("A
Development Project") for the assurance of the completion of the Public Infrastructure in
connection with the aforesaid development project and its associated development agreement and
development cornsnuction permit Funds under this Lctter of Credit are available to you for one
or more drawings prior to the close of business on March 5, 2005. against sight drafts in an
aggreuate cumulative amount not to exceed $668,000.00, dated the date of presentment, drawn on
our ottice retbrred to above, referring thereon to the number of this Letter of Credit and
accompanied by Your written certificate siumed by you and acknowledged as therein provided in
the form of Exhihit 1 hereto.
Presentation of such draft and certificate shall be made at our office referred to above.

2. Work Hours
Work hours shall be 7:00 A.M. to 6:00 P.M. Monday through Friday. No work will be permitted on
weekends or holidays. More restrictive hours of operation may be in place for off site improvements
depending on the location and nature of the off site improvements being constructed. I ,

Vehicle Tracking Pads must be constructed and maintained at all construction entrances to the
project.
5. Construction within Larimer County Right of VVay (ROM')
No construction is permitted within the ROW of Larimer County roads that are external to and or
adjacent to the subdivision or development construction project except those improvements that are
shown in the approved construction drawings. Landscaping within the ROW of Larimer County roads
that are external to and or adjacent to the subdivision or development construction project shall be
limited to placement of approved ground cover such as native seed mixes and the like. Signage. such
as subdivision entrance signs, wili not be allowed within the RO'J' of Larimer County roads that are
external to and or adjacent to the subdivision or development construction project. Please note that all
signs tnat are not a pan of the approved construction plans will require a separate sign permit from
the Larimer County Building Department (970-49S-7700).

6. Access and Utility Permits
Access permits will be required for any outlets or other access points that are not shown on the
approved construction drawings.
Utility Permits (for construction in Larimer County Right of Way) will be required for all utility
installations that are not shown on the approved construction drawings (i.e. phone, cable, gas, other
dry utilities).
To obtain Access or Utility Permits please contact Marc Lyons (Latimer County Access and Utility
Coordinator) at 9-110-498-5709.
7. Street Cut Fees
Fees will be charged for road cuts made in Larimer County Roads for utilities that are shown on the
approved construction drawings. These fees will be paid prior to issuance of the Development
Construction Permit and are a part of the DCP issuance procedure.
8. Projecti�lanager
Latimer County vrill not be providing ongoing management, monitoring inspection or supervision of
this project to insure compliance with the approved construction drawings. and County and project
standards and specifications. The responsibility of managing. monitoring, inspecting and supervising
this project to insure compliance with the approved plans. and all relevant standards and
specifications falls upon the developer. his managers, engineers. and contractors.
Latimer County will be periodically performing random quality assurance checks on this project to
insure that the developer. his managers, engineers, and contractors are monitoring, supervising. and
inspecting this project to insure compliance with the approved construction drawings, and all relevant
standards and specifications. Additionally, Larimer County will require extensive documentation to
demonstrate that this project is in compliance with the approved construction drawings. and all
applicable standards and specifications. This documentation shall include but not be limited to:
material testing records and reports, inspecting engineer's field reports, inspecting engineers
certification of compliance, and as -built draw ngs.

9. Design Changes
All design chanties and deviations from the approved plans must be approved by the Latimer County
Engineering Department. Minor changes may be approved by the Latimer Count' Development

Construction Inspector in the field. Major changes must be approved by the Larimer County review
engineer for the project.
In general a major design change would be any change that would require a new or revised drawing
for the construction of the item to be changed. It shall be the responsibility of the developer, his
engineers, and or contractors to consult with the Larimer County Engineering Department to
determine if amp particular design change is a minor or major design chance and what nee of review
and approval is needed to incorporate this change into the approved construction documents.

Asphalt density tests for asphalt pavement
Asphalt gradations and oil content tests for asphalt pavement
Concrete (slump and air content) tests and cvlinders taken for curb and gutter, sidewalks, crosspans,
aprons, pavement.. inlets and other concrete structures
Please see the Larimer County Road Manual (or the Urban Area Standards if applicable) for a more
complete description of testing frequencies and requirements.

15. Asphalt Coring (For Densih, Correction, Lift Thickness, and Aggregate Thickness)
The proiect materials testing engineer shall take asphalt cores. These cores shall be take to establish
the asphalt density correction factor, veni'v asphalt laver thickness. and the thickness of the age euate
base course.
Asphalt coring should be performed on each asphalt layer prior to placement of the next asphalt layer.

3. Construction tirne restrictions: Normal Work hours
4. The applicant understands that additional permits maybe required for this development
project and the applicant shall secure those permits directly from the issuing departments.
5. This permit, along with a complete set of all approved plans and documents for this
project (utility plans, site plan, landscape plan, development agreement, soils report,
pavement design, traffic study, drainage report, plat easements and any other official
documents), shall be kept on the development site available for use by City staff doing
inspections.
6. Permit Expiration (in accordance with Section 29-12 of the Transitional Land Use
Regulations or Section 2.6.3(K) of the Land Use Code, whichever is applicable):

b. In addition, this permit shall expire one year from the date of issuance. The
applicant may apply for an extension by reapplication at least two weeks priorto the
expiration elate. Such application shall contain information sufficient to justify the
granting of the extension. An extension may be granted for up to six months.
7. Building permits and certificates of occupancy will only be issued when all conditions
contained in the Development Agreement and Sections 3.3.2(C) and (D) of the Land Use
Code or Sections 29-678 and 29-679 of the Transitional Land Use Regulations, whichever
is applicable, are met. If the Development Agreement does not specify times for
completion of public improvements, or if there is no Development Agreement, then
the

improvement requirements specified in Section 24-95 of the City Code shall apply,
provides that construction of all improvements shall be required prior to the time of
issuance of the first building permit.
8. Acceptance by the City of the public improvements shall be after (1) final inspection
has been conducted by the City; (2) punch list items from the final inspection are
completed and accepted by the City; and (3) required certifications from the licensed
professional engineer that improvements are completed to City standards, specifications
and approved Utility Plans; and the Aas-constructed@ plans have been received and
accepted by the City.
9. The warranty on street improvements is for five (5) years from the date of acceptance
by the City of the completed improvements, in accordance with Sections 29-13 and 29-14
of the Transitional Land Use Regulations and/or Sections 2.2.3(C)(3)(g), 3.3.1(C)(2), and
3.3.2(C) of the Land Use Code, as applicable.
16. Review of Testing Results by Inspecting and Certifying Engineer
The inspecting and certifying engineer shall be responsible for reviewing all materials testing reports
that pertain to the item that they are certifying and inspecting. Any deviations from Larimer County
and or project specifications shall be duly noted and described in the engineer's certification letter.
17. Bound Packet with copies of all Test Record, Inspection Reports and Certification Letter
The engineer's certification letter should be a part of a bound packet that includes all of the inspecting
engineer's field inspection reports and all relevant materials test reports.

20. Mix Design
Mix designs for all asphalt that is to be used as a part of the project must be submitted to Larimer
County for review and approval. All asphalt mix designs should be submitted to the Larimer County
Engineering Department Submit mix designs to Andrew Barnebey (Larimer County Development
Construction Inspector), 970-498-5729.
Please allow one week for review, of asphalt mix designs.
21. Survev Monument Boxes in �ty ROW
When improvements are made to Larimer County Roads such as paving of unpaved roads all survey
monuments (section corners, quarter corners, and the like) must be improved and upragded per
Latimer County and State of Colorado standards. This may include, but is not necessarily limited to,
raising and upgrading monuments and the placement of a range box at each monument.
22. Soil Sterilization
Larimer County requires soil sterilization prior to placement of asphalt.

23. Documents Needed Prior to Placement of Aggregate Road Base
Prior to placement of age egate road base the following documents must be submitted to the Larimer
County Engineering Department:
Soil density tests for all utility baekfill within ROW
Proofroll report for road subgrade
Soil density tests for scarified and recompacted native undisturbed road subgrade
Soil density tests for all fill material placed in roadway.
Letter from materials or inspecting engineer stating subgrade has passed proofroll, all native
undisturbed subgrade has been scarified. recompacted and passed density tests, that all fill material
placed in the roadway, has passed soil density tests, and that the subgrade is ready for placement of
aggregate road base.
This letter should also state that the moisture specifications made in the soils report have been used as
the pass/ fail criteria in all soil density tests. that over excavation of road subgrade and other relevant
areas has been made as per the soils report. that all required soil swell consolidation tests have been
performed in order to assess the amount of over excavation required in road subgrades and other
areas, and that all other relevant recommendations made in the soils report have been followed. This
letter should describe the areas and extents of all over excavations of unsuitable materials in the
project. This information should be presented in a spreadsheet form if the areas and depths of over
excavation are extensive and variable throughout the project.
Larimer County will review this material and approve or reject placement of road base within 24
hours of receipt of all of the above documents. In order to insure that Larimer County has the full 24
hours to review these documents the Larimer County Development Construction Inspector must be
notified by telephone that the above documents have been delivered to Larimer County. The. 24 hour
review period shall begin after all documents are received and the Larimer County Development
Construction Inspector has been verbally notified of the delivery of these documents (for voice mail
messages the 24 hour period shall begin after the Larimer County Development Construction
Inspector returns your call to acknowledge receipt of the required documents). If you are unable to
contact the Larimer County Development Construction Inspector the Larimer County Development
Review Engineer for this project shall act as backup to review the required documents and approve or
reject placement of road base.

24. Documents Needed Prior to Placement of Asphalt
Prior to placement of asphalt the following documents must be submitted to the Larimer County
Engineering Department:
Proofroll report for aggregate road base.
Density tests for aggregate road base.
Letter from materials or inspecting engineer stating that the aggregate base course has passed a
proofroll, that the aggregate base course has passed all density tests, and that a soil sterilization agent
has, or will be placed immediately prior to paving (if soil sterilization agent is to be applied
immediately pnor to paving this shall be documented in the inspecting engineers field inspection
report and be a pan of the final certification packet).
Latimer County will review this material and approve or reject placement of asphalt within 24 hours
of receipt of all of the above documents. In order to insure that Larimer County has the full 24 hours
to review these documents the Larimer County Development Construction inspector must be notified
by telephone that the above documents have been delivered to Larimer County. The 24 hour review
period shall begin after all documents are received and the Larimer County Development
Construction Inspector has been verbally notified of the delivery of these documents (for voice mail
messages the 24 hour period shall begin after the Larimer County Development Construction
Inspector returns your call to acknowledge receipt of the required documents). If you are unable to
contact the Lanrrer County Development Construction Inspector the Larimer County Development

30. Issuance of Development Construction Permit and Start of Construction
The following conditions must be satisfied before a Development Construction Permit may be
issued and construction may begin:
Construction Plans must be approved and signed by Larimer County and all relevant
districts and entities_ Two must be provided to the Larimer County Engineering Department.
Final Plat must be recorded by Larimer County.
Development Agreement must be signed by the developer(s) and Larimer County. One
copy of signed development agreement must be provided to Larimer County Engineering
Department.
Construction Collateral must be in place.
Geotechnical Report. One copy of this document must be provided to the Larimer County
Development Construction Inspector.
Construction Schedule. One copy must be provided to the Larimer County Development
Construction Inspector.
Checks for Permit Fees.
Developer's Engineers. The engineers the developer will be using to provide certification of
road and storm drainage improvements must acknowledge their involvement in this project
and their understanding of Larimer County requirements with regard to certification.
Additionally the materials testing engineer and civil engineer for the project will need to be
identified.
31. Building Permit Release Schedule
Building permit release shall be as per section 25 of the Development Agreement. Any deviation
from this building permit schedule will have to be approved and authorized by the Larimer County
Planning Department. Engineering Deparment, and the Board of County Commissioners (via an
amendment to the Development Agreement)

32. Collateral/ Construction Loan
The following categories will be recognized by the Latimer County Engineering Department for
Construction Loan Releases:
Waterline
Sewerline
Earthwork and Storm Drainage (One combined category)
Road construction
Other (other will have to be identified and approved at the pre -construction meeting; examples
include bridge and box -culvert)
All of the above categories may have an onsite and off site component (i.e. onsite road construction is
one release item and offsite road construction is a separate and distinct release item)
Release Requirements
If we will not have the 1 15% collateral for the particular item to be paid with the construction loan,
then engineering will have the following requirements prior to release of any monies:
The item to be released must be in such a condition that we are prepared to accept this item into the
warranty period at the time money is released (no items will enter into warranty on an individual
basis, the warranty will be for the project as a whole).
The item must be 100% complete.
The developer's inspecting and cenifying engineer must submit the following:
Certification of the item to be released stating that the item is 100% complete, and that the work is in
compliance with the approved plans, and the standards and specifications of Larimer County.
Field Inspection Reports - copies of these reports of field inspections made by the developer's
inspecting engineer to be provided to Latimer County.
Material Testing Records - copies of all relevant materials tests must be provided to Larimer
County.
Opinion of Probable Costs - an engineers cost estimate for the entire project stating the developer's
engineer's opinion of probable costs for all aspects and phases of the project.
Formal Draw Request - a letter and spreadsheet clearly showing the item(s) that are being requested
for payment, the dollar value of those items, and the total dollar value and allotment for the entire
construction loan.
After we have received the above items from the developer's engineer we will review them and if we
find every_ thins to be in order and acceptable we will recommend release of the appropriate amount of
monev.

approved design to be shown in red by hand adjacent to the original approved design.
The as -built drawings should contain at a minimum the following information:
Road horizontal and vertical alignment.
Storm drainage inven elevations for all culverts and other drainage structures.
Detention/ Retention Pond spot elevations used in pond volume calculations
Spot elevations throughout project to illustrate that all drainage features function as designed.
Spot elevations throughout project to illustrate that all roads were constructed as designed

10. The City Erosion Control Inspector must be notified at least twenty-four (24) hours
prior to any planned construction on this project. All required perimeter silt fencing and
other erosion/sediment control best management practices (BMP=s) that can be installed
prior to construction must be in place and inspected by the City Erosion Control Inspector
before any land disturbing activity begins.
11. No work (including grading) shall be started in State Highway right-of-way until a
permit is issued by the Colorado Department of Transportation to allow such work to begin.
