Re: Damaged Concrete
Dear Katie,
On Wednesday March 19. 2003 1 observed a City of Fort Collins employee using
a skid steer loader to remove snow on the North West corner of Olive Street and College
Avenue. Ile was working quickly and did not use much caution with regard to the new
sidewalk. A few days latter I observed numerous locations where the equipment
damaged the concrete and paving stones. I am submitting photos of these for your
review.
As you know I am currently in the process of re -developing this property. You
indicated to me that I would be responsible for repairing damaged concrete on the site as
part of the city's development requirements. I am concerned that I will be responsible for
paying for damages caused by The City of Fort Collins and the negligence of their
employee. This sidewalk was quite new and did not have any major damage to it prior to
the incident on March 19.
Please advise me of your impression of this matter. I would like assurances from
the city that I will not be held responsible for these damages.

RE: Rehabilitation of the New Mountain Empire Hotel, 249-261 S. College Avenue
Dear Ms. Moore:
As staff to the Landmark Preservation Commission, I would like to convey to you their strong
support that the doors be allowed to swing out on the Olive Street commercial storefronts of the
New Mountain Empire Hotel, 249-261 S. College Avenue.
On April 23, 2003, during their regular meeting, the Commission approved conceptual
rehabilitation plans for the building that included the Olive Street storefront doors swinging -out
over the right-of-way. Historical photographs show that this was the way they were originally
designed_ The only other option to the building owner would be to recess the doors, and this
was never the historical configuration on this side of the building. The general consensus was
that the sidewalk is wide enough in this area, and that the basement entrance stairwell would tend
to guide passers-by further away from the building.

the Landmark Preservation Commission's mission to follow the Secretary of the Interior's
Standards for the Treatment of Historic Properties, and their recommendation for this building.

Re: Item J, pg. 30, appendix E, LCUASS
Dear Katie,
I am requesting a change in the language of the following statement that 1 am
required to annotate on the cover sheet of the Utility plans for 259 S. College Ave. "The
Empire Hotel"- The statement as required reads:
`9 hereby affirm that these final construction plans were prepared under my direct
supervision in accordance with all applicable City of Fort Collins and State of Colorado
standards and statutes, respectively; and that I am fully responsible for the accuracy of all
design, revisions, and record conditions that I have noted on these plans."
I would like to change the statement to read as follows:
"I hereby affirm that these final construction plans were prepared under my direct
,'supervision in accordance withICity of Fort Collins and State of Colorado standards and
statutes applicable to this property, respectively;(and that I am responsible for the
accuracy of the design noted on these plans."
I am requesting this change in language because the subject property is an
existing building. As such, there are many existing underground utilities and site
conditions that have been previously designed, constructed, and revised without the
benefit of supervision, input, or design assistance from my civil engineer Richard S.
Beardmore, P.E..
Please; let me know if this change in language is acceptable in light of the unique
nature of this submittal. I have spoken with Paul Eckman about this matter. He indicated
he would defer to the Engineering Departments decision regarding this matter. I can be
