Statement of Planning Objectives (1,h)
number of City Plan Principles and Policies are advanced by the proposal including:

quality". Tidal Wave Carwash will use the latest techniques in sand/oil separation
systems to assure high wastewater quality. In addition, the project utilizes �1 wLIL':

Collins.

The landscaping plan meets the City of Fort Collins standards and creates both attrncticc

Dear Mr. McNair:
This letter is to request a variance from the above referenced Latimer County Urban Area Street
Standard.
This standard would require a 6' wide sidewalk on the JFK and Troutman Parkway sides of our
project. The sidewalk as it now exists, is 5' wide for the detached areas, while the attached
section of walkway wrapping the street corner is 6' in width.
On 1/11/2002, we received our latest round of City Staff Project Review comments relating to
the treatment of these sidewalks. Since that time we have had discussions with Ms. Susan Joy of
City Fngincering and Mr. Troy Jones, City Planner on this topic. In these discussions and in Ms.
,toy's Staff Review comment #123, it has been detennincd that the original plan of constructing a
I' wide `ribbon and joint" addition to the 5' sections of the detached walkway would result in an
ongoing maintenance problem.
In view of the above, we request that we be allowed to repair and replace as necessary all
sections of sidewalk to their original width (5' or 6') during our construction and site
improvements. We believe that this resolution fully meets the intent and purpose of the Urban
Street standards and does not present an issue with regard to public health or safety.

North Star Design Inc:., on behalf of the Developer for the Tidal Wave Carwa h project, has submitted
a variance request to the City of Fort Collins design standards. In accordan with detail 7-2F and 7-
3F, the minimum width for a sidewalk on an arterial street is 6'. The propert in question is bordered
on the east by JFK Parkway (a 4-lane arterial street) and the south by Boardwalk Drive _(a_2-lane
dewa
arterial street). The variance is for keeping the existing 5' detached silk instead of increasing
the width to 6' as required by code.
Originally, staff had requested that the applicant replace all damaged sidewalk to a 6' width. Where
the sidewalk did not require replacement, they were to construct a 1' wide ribbon and joint addition
(per detail 25-1) so that the sidewalk would have a consistent 6' width. However, the City determined
that such an addition would become an ongoing maintenance problem for the City. Staff then
requested that the 1' addition be removed from the plans and the sidewalk be left at the existing 5'
width. The applicant will still repair and replace all damaged sidewalk where necessary but to the
original 5' width.
It is my opinion that this variance can be supported based on the fact that the condition of the existing
sidewalk does not warrant complete removal and replacement to the required 6' width and the
addition of a 1' strip to meet that requirement places unnecessary future repairs on the City of Fort
Collins.

This letter is in response to the variance request dated January 21, 2002, to repair and replace as necessary all
sections of sidewalk along JFK Parkway and Troutman Parkway to their original width (5' or 6').
The variance request is granted.
This variance request does not set a precedence or change the application of our design standards in other situations.
