it has recently been brought to the attention of my client,
Robert Young, that property on the corner of Shields and Prospect
has been approved for an apartment complex subject to the builder
constructing a floodway-cum-greenbelt. T would like to inform
you of the water use by Mr. Young in the B. B. Harris Drain
Ditch, Consolidated, Tombaugh Seepage Ditch No. 1, and R. R.
Harris Irrigation Pitch to icrigate approximately five acres that
he owns at 1601 Sheely Drive. Presumablv, any plans to construct
the floodwav that might interfere with the diversion, or inter-
cept the Flow in the ditches of Mr. Young's water will he incor-
porated in the construction of a structure so that Mr. Young can
continue to divert by pump onto his acreage.
I would appreciate hearing from you on this matter. Should
you have any questions or wish to discuss it, please do not hesi-

Dear Mr. Foster,
I would like to thank you, your wife and daughter for coming to the
Engineering Services office last Wednesday to talk about your property at
1015 W. Prospect Rd. and the upcoming Landmark S.I.D. project. I am
especially appreciative of the friendly informal manner in which we were able
to communicate.
During our discussions we covered many details of the project. However,
there were four main items which were of concern to you that we talked about.
These were:
1. Payment for property taken. The City will pay you, or the current
landowner for property taken at the fair market value of that property.
2. Replacement of parking spaces lost. The City will replace, on a
one -for -one basis, the parking spaces lost due to the widening of
Prospect Rd. We talked about putting these in the back of the building,
adjacent to some existing parking spaces. In lieu of this the City
will pay the value of the lost spaces. We prefer the first alternative.
3. Rebuild "level spot" in drive. The City will rebuild an equivalent
"level spot" on the west drive that goes through the 16' wide access
easement to the south side of your lot.
4. Curb cut by existing gravel parking area. The City will provide a
curb cut adjacent to your existing parking area to allow for access to
the south portion of your lot when you modify the existing landscaping.
The new curb cut, however, will probably be narrower than the existing
curb cut.
I hope I have correctly summarized the points of your concern. I must also
mention here, as I did during our discussion, that I do not speak with
"final" authority. By City Code land acquisition and many other matters must
be approved by the City Council. I can state, however, that I feel
comfortable with the four items above and do not anticipate any problems with
their fulfi:Llment.

Management Agreement drafted for Landmark Special Improvement
District #80.
The Agreement details the procedures for Landmark Apartments, Ltd.
to follow in assuming the construction management responsibilities
and the City's procedures in paying the bills.
The developer has begun construction this month and is making
significant progress. This will result in widening of a trouble-
some corner at the southeast corner of Prospect Road and South
Shields Street.
This culminates several weeks of negotiation between Tom Gathmann,
the contractor, and adjoining homeowners.

a trench across Shields Street near Prospect Road for Mountain Bell's
use. Your cooperation will allow construction on the curb, gutter
and walk to occur in a timely manner so as to provide a sidewalk
for the school children prior to the opening of school scheduled
for August 28th.
Funds for this type of emergency have been provided for in the district
and by copy oP this letter, Landmark Apartments, Ltd. is hereby
authorized to include your billing for this excavation as part of
the district's costs.

Dear Larry:
It has been brought to my attention that two manholes in Hobbit Street (part
of the S.I.D.) are in need of repair in order to meet City Standards for
sanitary sewer main construction as follows:
MH-B-1 - The original ring & cover installed by Schmidt Exc. has been removed
and replaced with a paving ring riser. The correct ring & cover
needs to be installed and adjusted to final grade and the asphalt
pavement then repaired.
MH (Proposed by Windtrail) - The same as above for MH-B-I.
MH-D-1 - Asphalt pavement needs to be replaced around the MH.
These repairs need to be completed prior to the issuance of any Certificates
of Occupancy that would place this sanitary sewer into service.
It should be rioted that the S.I.D. has not yet been final inspected by the
City. Therefore, additional corrections or repairs could be required prior
to final acceptance by the City.
Attached, for your information, please find a copy of my daily inspection
log where I noted that I had checked all the MH ring & cover elevations as
per Engineering Professional grade stakes placed for Schmidt Exc. in order
to assure that: the MH's were at the proper elevations.
Please notify me at 221-6605 when this work is being done or if I can be of
any assistance to you regarding this matter.

Re: Off -site drainage swale
Dear Rolle,
The drainage improvements for Landmark P.U.D. are nearly complete.
I visited the site last week for a brief inspection, and found the
overall drainage system to be functional, and therefore permitted
the release of more building permits and certificates of occupancy.
On Sheet 6 of 9 of the P.U.D. plans, mention is made of a drainage swale
beginning at the curb chase on Hobbit Street and running to the existing
importation canal in Windtrail P.U.D. This swale is necessary to direct
the runoff from Hobbit Street to Spring Creek and avoid ponding of water
adjacent to your development. Reference is made to a detail on the
Windtrail P.U.D. plans that show a swale with a concrete trickle channel.
I do not feel it is appropriate at this time to construct the swale as
shown in that detail because the final location of the Swale may change.
Therefore, I recommend that a swale of sufficient capacity to handle
Landmark's existing runoff be designed and constructed in the general
location shown on the plans. Since this is a temporary condition,
a concrete trickle channel is not necessary, however, I would recommend
that a small (4") subdrain be installed to minimize standing water, and
that the Swale be seeded with native, drought resistant grasses.

Since this outfall is a necessary portion of Landmark's drainage system,
it is important: that it be completed prior to the release of the last
certificate of occupancy. Larry Gomez mentioned that the seeding specified
for the importation canal would not occur until July - several months
after the project is scheduled to be completed.
The subdivision agreement for Landmark P.U.D. requires that all public
improvements be completed and accepted before the last certificate of
occupancy is released. However, the City utilizes two mechanisms to
avoid unreasonable delay in situations such as this. The first is to
establish an escrow account with the City for the work yet to be completed;
the second is to provide an irrevocable letter of credit for the work.
In both cases the dollar amount must be 150% of the engineer's estimate
of the cost of improvements. This guarantees that there is sufficient
money to complete the work, thus protecting the City, while allowing
the project to avoid delay.
I have briefly discussed the offsite swale recommendations with Mike Schmid.

Dear Sirs:
It has been brought to my attention that two sections of the six inch
vertical curb and gutter and a small area of asphalt pavement installed by
Flatiron Concrete and Flatiron Paving, respectively, have settled on
Shields Street. This failure has occurred approximately twenty feet south
of the radius on the southeast corner of Shields and Prospect. This
appears to be it the vicinity of Vine irrigation tap that was existing and
used by the cons' --ruction trailer office.
Since the initial acceptance of the public right-of-way improvements on
November 28, 1984, and the final acceptance of t'ne same on June 11, 1985,
both the concrete And asphalt pavement are still under warranty to the
City. Please accept this as official notification that these failures are
to be repaired under the warranty provision in your contract with the City
of Fort Collins.
It would be to your advantage to make these repairs as soon as possible to
prevent any further deterioration in this area due to the improper drainage
now occurring from tnis settlement. Also, please notify the City
Engineer's office prior to making these repairs so the limits of removal
can be determined and agreed upon.
If you have any questions or if I can be of any assistance to you, please

matter will be appreciated.

Staff has revi0wed the revised preliminary plan for the Landmark PUD and has
the following continents: " --
1. If active open space is included within the "development data" it should
be designated on the site plan.
2. Fire trucks must be able to negotiate all accessways within the site (40-
foot radius minimum outside and 20-foot radius inside).
3. Trash enclosures block some of the sight distance for parked cars and need
to be redesigned.
4. An agreement with Windtrail PUD must be worked out regarding Hobbit Street.
5. Fifty -foot minimum must be provided from the flowline of Hobbit Street to
the entrance of the parking areas.

Staff has reviewed the Landmark PUD, Final plans and has the following comments:
1. The landscaping plan is not adequate. Increased plantings around buildings
and along !property lines must be provided. In addition, all notes except
Number 7 should be removed from i.he plan.
2. All engineering specifications should be removed from the site plan.
The development data is to remain.
3. Building "A" NE, Building "B" Center, and Building "E" do not comply with
fire access requirements.
4. Indicate, on the site plan, radii of parking lots to ensure Fire
Department access.
5. Building "E" should be relocated.
6. Indicate handicapped ramps at street intersections.
7. Shields Street is to be per City design and not that which is indicated
on the site plan.
8. Construction and development of Hobbit Street needs to be clearly defined.
9. Indicate motorcycle and bicycle parking.
10. Building envelopes must be dimensioned to two property lines.
11. Building envelopes are to be shown on the plat.

Re: Utilities :in Hobbit Street
Dear Mauri:
Landmark P.U.D. will require underground utilities in Hobbit Street
that are not shown by Wind Trail Utility Plans. We have contacted
Steve Van Lear regarding his time table for construction -of Hobbit -
Street. He said that construction is not scheduled until after 1984.
Since Landmark is scheduling construction of utilities in Hobbit
Street for the 1983 construction season, there does not appear to be
a problem with the utility locations.
Nevertheless, we ask that you inform Building Inspection that there
will be changes to the approved Hobbit Street design.

Regarding your request for a variance in the storm water detention
requirenents for Landmark Condominiums I have the following comments.
As you stated in the drainage report for Landmark, because the peak runoff
from the site will reach the Importation Canal and then Spring Creek well ahead
of the peaks from these major drainage basins it would indeed be advantageous to
allow the onsite peak runoff to be released undetained.
Your request for a variance in the detention requirements for Landmark
Condominiums is hereby granted provided that the 100 year peak flow from the
site be routed to the Importation Canal in such a way as not to cause any
erosion damage.

Mr. Rolle Walker and I wish to thank you for allowing us the opportunity
to discuss the Special Improvement District relating to the Landmark
Apartment project.

It is our understanding that the SID can be established and can include
one-half of Prospect and Shields Streets adjacent to the Landmark
property; all of Hobbit Street including the trunk line utilities and
the on -site importation canal.
It is also our understanding that inclusion of the street work in the
SID will not negate the street oversizing reimbursement to us, nor will
inclusion of the importation canal in the SID affect the reimbursement
and easement allowance per our contract agreement dated June 27, 1983.
When we have reasonable assurance that the SID will be established and
funded, we will arrange to proceed with the work and "front" the costs
as required prior to the availability of funds from the sale of bonds.
We will be working in conjunction with the engineers in preparing the
costs and other information that will be required for the September 6,
1983, Council agenda so the resolution and first reading approvals can
occur at that time. We realize there are some drainage and other
Niiysiva.i reiucutiuli problems attendant to the project -�c Gr k. GUr
engineers will be cooperating and coordinating with your Mr. Gathmann
to reach satisfactory solutions.
Engineer Brian Shear and I will be available to you and the Council
when you present the proposal at the work session on August 9.

RE: Preliminary Agreement for Building Permits - Landmark PUD
Mr. Rick Brown of W.J.M. Associates contacted me the
other day regarding the possibility of obtaining
building permits for Landmark P.U.D. prior to the
completion of public improvements as set forth in
the City Code Chapter 99. Construction Inspection
does not have a problem with this provided an agreement
is signed by both parties setting forth special conditions.
Please find attached a copy of a similar situation
which was drafted last year. I have penciled in
some minor changes. Your input is requested before
the City Attorney's office is contacted regarding the
drafting of this agreement.

Re: Construction Drawings for Prospect and Shields Improvements
Dear Brian,
The City of Fort Collins does not provide engineering design or construction
management services for private development. Those portions of streets that
are adjacent to the boundaries of the development are also considered the
responsibility of the developer for improvement to current standards.
Therefore, in the case of Landmark P.U.D. it will be necessary for the
developer's engineer to prepare the final drawings and manage the
construction of the improvements to Prospect Road and Shields Street that
will be completed as part of the Landmark S.I.D. No. 80 project. We will
provide the preliminary plans showing alignment and grade as well as provide
the normal inspection and testing services associated with any Public R.O.W.
construction within the City.The engineering costs for the portion of
Prospect Road that is east of Landmark will be paid for by the City on a
basis prorated with developer's engineering costs.
