Dear Mr. Richardson:
This letter is to summarize a request for a drainage variance
for the proposed Home Federal PUD located at the northeast corner
of College Avenue and Drake Road, Fort Collins, Colorado, (preliminary
engineering drawing of June 29, 1981, attached).
As noted on the plan, the two-year historic runoff is two CFS,
100-year historic flow 6.5 CFS, and 100-year PUD runoff approximately
6.8 CFS. The new construction would involve only .44 acres; most
of the property will not be affected by new construction. Partial
runoff (to the north) from the newly constructed area would be piped
to a storm drain in Princeton Road, and the remainder to the existing
north curb and gutter in Drake Road.
Existing runoff for the remainder of the property flows north
to the curb and gutter in Princeton Road, and south to the curb
and gutter in Drake Road. A catch basin collects runoff from the
drive-in banking facility of the north, and is piped directly to an
existing storm drain.
Since the increased runoff from new PUD construction is calculated
to be minimal, and total site development area small, it is requested
that the area drain be constructed as shown, that runoff also be
drained in the new driveway and collected in the curb and gutter in
Drake Road, and that the normal detention ponding techniques be waived.
It may also be noted that existing development on the site would
make construction of a detention pond abnormally expensive, if not
impossible.

during the winter months. The attempt proved futile, since the road base was
frez.n, and the right turn lane had to be barricaded off.
- It is :come Federal's responsibility to complete the construction of the
right turn lane. This will involve developing a plan for stabilizing the
subgrade and for completing the construction. I recommend that a qualified
engineer and a qualified contractor be hired to develop this plan. PIatt Faker
will review the plan and express any concerns that he ray have, and either
approve or disapprove the plan based on City standards. It is not his or the
city's role to design this plan. His role is to inspect each step of the
construction and to either accept it or reject it.

Dear Mr. Roesser:
The following is in response to your letter dated August 2, 1981
requesting a variance in the detention requirement for the proposed
Hone Federal P.U.D. located at the northeast corner of College Avenue
and Drake Road.
As you indicated the additional runoff produced will be minimal and
will not adversely affect the existing drainage capacity of Drake Road
and Princeton Road.
A variance from the detention requirements for the Herne Federal P.U.D.
site is hereby granted thus allowing a portion of the developed runoff
to flow directly onto Drake and Princeton Roads.
It is understood that the remaining portion of the runoff will flow
to a proposed catch basin and be piped to an existing storm drain in
Princeton Road and that this proposed storm drain will he built according
to the City of Fort Collins standard specifications for storm drainage
construction.

Dear Mr. Walling:
I have been requested by Joe Roesser to inform you as to the cost
repays available to you in respect to improvements on Drake Road
adjacent to your property. The City considers Drake Road an improved
arteriai in respect to pavement 'width. According to Article 99-6IF)
the City will pay for all improvement beyond that in which would be
required for a local street except depth on collector streets.
Therefore, you may sulsnit invoices to the City for work to be
performed upon Drake Road and the City shall repay you for these
sections. We will not repay you for new drive cuts or the closing of
drive cuts, 4-foot width of.any sidewalk which does not exist or
that is substandard, trench repair for additional services or
landscaping within City right-of-way. This is not to be interpreted
that these are the only items that we shall not pay for but is added
for your convenience and should cover all items.

RE: Home Federal Savings, University Branch Office, P.U.D., College at Drake
Dear Mr. Richardson,
This letter is to confirm our phone conversation of March 15, 1982 concerning
reimbursement to Home Federal Savings for services provided regarding street
improvements. I specificially make reference to your letter submitted to us on
March 4, wherein you indicate that we may submit invoices to the city for work
performed upon Drake Road and that the city will repay for those sections. In
addition, the clarification in our conversation pertained to expenses reimbursed
for the supervision of such improvements on the street in question.
We understand through our conversation that we will be reimbursed for the super-
vision of street -improvements in addition to the actual cost of construction.
It is also understood that supervision for new drive cuts, closing of same, or the
installation of a 4 foot width sidewalk would not be included.
Thank you for your clarification concerning this matter
further discussion, please let me know.

Dear Joe:
Referencing your tlarch 23, 1982 letter concerning the final drawings for
the Home Federal Savings & Irian Association P.U.D., all items have been
revised as requested, except for item number 5.
Since there is an existing fire hydrant at the southeast corner of Drake
Road and College Avenue, and since there were no comrents from the City
requesting an additional fire hydrant installation at the preliminary
stage of approval, the request for this additional cost to the project does
not seem justified.
Therefore, the existing fire hydrant has been added to the drawings, and no
new hydrant placement is shown.

Dear John:
Josh Richardson, from Streets and Traffic, has informed me that a traffic
signal pole and controller will have to be moved as a result of constructing
the right turn lane adjacent to the Home Federal Project. Streets and Traffic
Crews will do the work and it will be paid for by the Street Oversizing Fund.
But, Streets and Traffic will have to bill the work to Home Federal and they
will then have to request reimbursement from Street Oversizing.

Dear Sohn:
Matt Baker, Construction Inspector for the City of Fort Collins, has informed
me that the contractor is having some difficulty stabilizing the subgrade for
the construction of the right turn lane. Per our previous negotiations, we
agreed that the Street Oversizing Fund would reimburse Home Federal for the
costs of excavation and pavement required for the turn lane. Oversizing will
also pay for the cost of stabilizing the subgrade. Matt is concerned that the
contractor may not be experienced at this type of work and has not properly
handled the construction of the right turn lane to date. I would like you and
your contractor to work closely with Matt to plan a method of stabilizing the
subgrade and protecting it from excess moisture until it is paved. Oversizing
will not pay for any costs caused by the contractors lack of experience or
inablility protect the subgrade until it is paved.

Dear John,
As per our telephone conversation of December 16, 1983
you asked about the City Street Department's temporary
asphalt paving of the right turn lane of Home Federal
Savings at College Avenue and Drake Road.
The temporary asphalt pavement on this project will be
removed at the City's expense, whether the City Street
Department removes it, or the paving subcontractor removes
it for later reimbursement.

Dear John:
There seems to some misconception of the City's role in this project. As a
part of the development agreement Home Federal agreed to construct the right
turn lane at the corner of Drake Road and College Avenue adjacent to Home
Federal Savings. The City's role as with any development initiated street
project is to approve the plans, inspect the project to assure conformity to
the plans and the City construction standards, and to reimburse the
development for any street oversizing costs.
- The City has already reviewed and approved the Home Federal PUD plans.
- At a meeting on October 18, 1983, we discussed the project's costs and
agreed on the costs which the Street Oversizing Fund would pay. Your letter
of October 19, 1983, accurately outlined the costs which Home Federal agreed
to pay and the costs which will be reimbursed to Home Federal from the Street
Oversizing Fund. I confirmed these costs in a letter dated October 24, 1983.
- In a letter dated November 16, 1983, I notified you that Matt Baker, a
city construction inspector, had informed me that the contractor was having
some difficulty stabilizing the subgrade. Matt was also concerned that the
contractor might not be experienced at this type of work and had not properly
handled the construction of the right turn lane to date. I stated that the
City would be willing to pay the costs for stabilizing the base and for you to
work with Matt Baker on this. I also noted that the City would not pay for
any costs caused by the contractors lack of experience or inability to protect
the subgrade until it was paved.
- In mid -December once it was obvious that the turn lane was not going to
be completed due to the winter weather, the City stepped in and paved the
right turn lane with 1" of asphalt in hopes of making the turn lane usable
