Fort Collins Department of Public Works Municipal Building Fort Collins, Colorado Attention: Mr. Liquin Dear Sir: Pursuant to the conversation our attorney, Mr. Williams, had with you on Monday, October 16, regarding the Emigh Street approach to the paved portion of Prospect Street, this letter is to confirm the arrangements discussed as follows: It is our understanding that because Prospect Street paving is according to county rather than city specifications, it will in due time be paved to city specifications. In the meantime, Highlander Heights is developing along five streets which inter- sect Prospect Street as follows: Yount, Luke, Patton, Welch ,and Emigh, and suitable asphalt paved approaches to Prospect Street must be constructed as each of these streets is put into use, until Prospect Street is improved, as any attempt to pave to the middle of Prospect Street would be unsatisfactory be- cause grade and paving would ;iot match up. We understand you have agreed to permit Highlander Heights, Inc., to construct asphalt paving approaches to Prospect from each of the above streets in consideration of which we agree to pay our share of paving Prospect Street at such time as the en- tire street can be paved which will be either at the time we are ready to construct the fifth approach or at any time before or after such time when the city is ready to pave Prospect Street with asphalt. Colorado 80521 Dear Mr. Williams: On August 6, 1971, a letter was sent to you requesting installation of the 12 inch stater main in Prospect to serve Highlander heights Subdivision. This line is not yet installed. Tile City Suidivision Ordinance requires a developer to install water mains and hydrants prior to obtaining building permits. We must, therefore, advise you that no futner building permits will be issued for highlander Heights until this water main is installed. Sincerely, Roy A. I refer you to your letter to us of December 8, 1970, a copy of which is attached. We have been proceeding accord- ing to this letter in every respect and consider it to be a commitment by the City relating to the 12th Subdivision. Miss Honstein has sought to get a contractor on this water line For some time inasmuch as Highlander Heights would benefit from it. My notes on a phone conversation with Mr. Hilgenberg on December 14, 1970, are "Mr. Hilgenberg assures me houses will be connected when wanted but we are to complete water line at or before completion of last house". I ask from you only the same fair dealing you have always gotten from us.
