Dear Mr. Woodland:
Since your crews began utility line work on the Overland Trail Farm Subdi-
vision in Fort Collins, City inspectors have noted several construction practices
which are not in keeping with our specifications for the construction of water
and sewer mains. These poor construction practices have reached the point where
immediate action is warranted.
The following is a list of items which must be corrected:
1. The water main valves at the intersection of Knollwood and
Crossbar are not located on the tee fitting as required in
Section 6.06.3 of the Water Main Specification, that is,
not less than 18-inches or more than 24-inches from the fit-
ting.
2. The sanitary sewer trenches have been extensively backfil-
led with sod and other deleterious materials which cannot
be accepted as street subgrade.
3. The compactive effort made on trench baekfill throughout
the subdivision has not been made or tested in a manner
which would assure required densities have been achieved.
4. Encasements of the sanitary sewer mains have not been made
as shown on the utility plan at those locations where
water mnins pass beneath them.
s. The sanitary sewer mains are connected to existing City
sanitary sewer mains and are not blocked or plugged. This
has allowed the infiltration of large amounts of water,
mud, anA other debris into the City sewer system.

Dear Charlie -
Confirming our meeting of yesterday and the subdivision agreOnent
between Overland Trail Faxms, Inc., (the Developer),. The City of
Fort Collins; will repay the Developer for oversizing overland Trail
from local street standards to arterial street standards.
In addition,, the bikewalk was constructed to arterial standards (7 ft.
in lieu of 21 ft. width) and, therefore, the Developer is entitled to
that oversizing also.
We will process for payment upon receipt of a formal request from the
Developer. A preliminary estimate of the oversizing would indicate this
oversizing will arount to approximately $11,000.00.

Approval of Overland Trail Farm PUD Final Plan
Dear Mr. Kaplan:
The purpose of this letter is to respond to your
letter dated September 15, 1980 requesting that the Pleasant
Valley and Lake Canal Company review Overland Trail Farm
final plans and provide you with written approval of those
plans if that was the action that the ditch company desired.
L have had an opportunity to discuss this matter
with the ditch company and am authorized to send you this
letter approving your final plans so far as the ditch company
is concerned. I do so, however, with the requirement that
you note the following matters:
1. The Pleasant Valley and Lake Canal Company
has a 50 foot maintenance easement which extends 15 feet
from the center of the ditch going towards the upper side
and 35 feet from the center of the ditch going to the lower
side.
2. The area which your development is in has
historically been proven to be surrounded by a high water
table and seepage. The developer must realize that any
excavation could result in continuing or activating that
seepage.
3. The approval of this letter does not extend
to any structures which will actually cross over the ditch.

In particular, it was noted that your plans include walkover
bridges. The procedure to get the ditch company's approval
of such a structure is to apply to the ditch company For a
permit. Approval of the crossing involves compensation to
the ditch company and requires that a representative from
the ditch company oversees the actual construction.

fees associated with the construction of the Clearview detention pond.
At that time you requested some additional information to assist you
in reviewing the fees due for Overland Trail Farm Subdivision.
I forwarded the information you requested in a letter dated October 15, 1980.
Have you had an opportunity to review this matter with Mr. Arslanian
and your attorney? As we will soon be into 1981, I am anxious to
finalize these fees. Please advise me as to the status of this matter

Our office represents Double A Investments, a Colorado
General Partnership in connection with the development of the
Overland Trail Farm Subdivision.
I have reviewed your letter of October 15, 1980, as well as
your letter of December 3, 1980. As you are probably aware,
Double A Investments has now completed the sale of all of its
interest in the Overland Trail Farm Subdivision. Specifically,
lots 2 through 13 and 60 through 67 of the Overland Trail Farm
Subdivision were sold by Double A Investments to DRB, Ltd., a
Colorado Corporation.
Additionally, DRB, Ltd. has conveyed all of its right, title
and interest in and to said property to First National Bank in
connection with an Agreement entered into between DRB, Ltd. and
First National Bank. On behalf of Double A Investments, Charley
Ar_mev has discussed the storm drainar�P fee ?ttri_butahl.e to cair]
property with John Agan of First National Bank. John Agan repre-
sented to Charley Armey that First National Bank will make a
determination as to whether it owes said sum of money to the
City of Fort Collins. As of this date, I do not believe that
such a determination has been made.
The balance of the property originally known as the Overland
Trail Farm Subdivision has been incorporated into a planned unit
development known as the Overland Trail Farm P.U.D. On December
8, 1980, the Overland Trail Farm P.U.D. and lots 1 and 14 of the
Overland Trail Farm Subdivision were sold to American Development
Corporation, the address of which is 11059 East Bethany Drive,
Suite 104, Aurora, Colorado 80014.

Pursuant to the terms of the Agreement of Purchase and Sale
entered into between Double A Investments and American Development
Corporation, American Development Corporation expressly assumed
the obligation to pay $17,763.29 to the City of Fort Collins,
representing the storm drainage lines and appurtenances as set
forth in the Subdivision Agreement dated October 13, 1980.
While American Development Corporation recognizes the
assumption of the storm drainage fee in the amount of $17,763.29,
American Development Corporation has requested that they be sent
a separate statement for said amount in order to issue a check
for payment thereof. Therefore, we would recommend that you
forward such statement to American Development Corporation at the
above address at your earliest convenience.
I note that your letter of October 15, 1980, indicates that
a storm drainage fee of $9,259.31 is attributable to lots 1 through
14, and 59 through 67 of Overland Trail Farm Subdivision. Since
lots 1 and 14 were conveyed to American Development Corporation
and because I believe that lot 59 was included in the Overland Trail
Farm P.U.D., I think it would be appropriate to reallocate the
storm drainage fees attributable to these properties.

Re: Groundwater problems
Dear Mr. Norman:
As I promised during our recent phone conversation, I am sending to you
information pertaining to the groundwater problems you've been experiencing
as a result of living next to a major irrigation canal. I've enclosed copies
of the subdivision soils report, pertinent correspondence, and a typical
sub -drain design for your reference.
The City currently has no regulatory status with regard to the methods taken
by developers and builders to combat groundwater problems. Typically, a developer
will hire a soils engineering firm to conduct tests and recommend measures for
addressing potential soils and/or groundwater problems. However, it is entirely
up to each developer and builder to decide how best to protect the homes in a
subdivision from such problems. Most are reputable professionals who rely
heavily upon the advice of the soils engineer and consequently have few
problems later on.
The City similarly has no control over overlot grading practices.
Improperly sloped yards and poorly designed landscaping and sprinkling
systems result. in foundations that leak and yards that are perpetually saturated.
I doubt that the Pleasant Valley and Lake Irrigation Company would feel
any obligation to take measures to prevent seepage from their ditch.
Their argument, traditionally is that the ditch was there long before
development occurred in the area, and therefore the "late -comers" must
bear the expense associated with addressing seepage from the ditch.

All of these items have been indicated to Kelran foremen and superintendents
several times by City inspectors. There has been no positive action on any of
these items. This letter is to inform you that no further water or sewer pipe-
lines can be installed by Kelran Constructors on the overland Trail Subdivision
until all of the mains already installed have been brought within the limits
of City of Fort Collins specifications.
Any further failure on the part of Kelran Constructors to comply fully and
promptly with the City specifications will be considered as grounds for revocation
of your Utility Contractor's License.
Please contact the City Engineer's office at your earliest convenience so
that our inspection staff can help you in meeting the conditions outlined above.

Per our conversations you are aware of the problems with backfill
materials on certain portions of the sewer main trenches on the
overland Trail Faun Subdivision. Our field inspections and other
data indicate that in order to correct these problems the entire
backfill of the sanitary sewer trenches on Touchdown (Knollwo)d)
Drive from Manhole "H" to a point approximately 100 feet south
of Manhole "0", and the entire backfill of the sanitary sewer
trenches on Crossbar Drive from Manhole "G" to Manhole "E" must
be retroved and replaced with suitable subgrade materials. In
this case suitable backfill materials can be easily obtained
from the cut areas on the southern portions of the project.
In areas where water mains are to be installed, the surface should
be stripped to a depth of 6" to 12" to rerove vegetative and other
deleterious materials prior to any pipeline excavation. If this
is done, the materials which remain (if they are kept clean and
free of debris), can be used as backfill in the water main trenches.
All materials containing vegetative matter or other deleterious
materials must be removed from public rights of way and cannot
be used to construct any portion of the roadway subgrade.

Dear Mr. Hall,
Kelran Construction, has currently installed all of the sanitary sewer
mains and approximately 5% of the water mains in the Overland Trail Farm
Subdivision. These mains have been inspected by the City and will be
accepted when certain deleterious materials in the trenches are removed
and replaced, with acceptable materials, when required compaction has
been achieved in all trenches, when valves are properly located on the
main, and when all pip line grades ham been surveyed and verified as
being per design plans.
Of course, any other currently unknown problems would need to be corrected
also, before final acceptance.

of the existing water line fire hydrants.
It was observed that some corrective measures needed to be made
before these lines could be accepted by the City and Certificates
of Occupancy issued in these areas as follows:
1. F.H. and valve on the NW corner of Crossbar and Knollwood
needs a vertical extention.
2. F.H. between lots 15 and 16 on South side of Knollwood
needs a vertical extention and needs to be extended
approximately 2;' south.
3. F.H. on SE corner of Knollwood and Pleasant Valley needs
to ]be extended approximately 2'' south.
4. F.H. on SE corner of Pleasant Valley and overland Trail
needs to be extended approximately 3' south.
Please feel free to contact me if you have any questions regarding
this matter.

doing any of this work.

Dear Sir:
This letter will serve to guarantee your department that under no circumstances
whatsoever shall it be allowed that inflammatory materials be stored at any
time, or any building improvements shall be built on any of the frontage lots
adjoining to those streets now known as Knollwood and Touchdown. This guarantee
shall be in force and effective until such time as the sub -grading of the road -
base on those particular streets is completed by Flatirons Paving Company, who
are awaiting only for improved weather of two days time in which to satisfy this
requirement on the subject property.
I thank you most sincerely for your immediate attention given to approval of
building permits issuance on those lots referred to herein above.

RE: Overland Trail Farm water services
As you know, certain of the water services in the Overland Trail
Farm Subdivision are not located the required distance behind the
property lines. Some of these services are so far from proper
locations that they will have to be moved. others are close
enough to being located correctly that they could be left as is,
in that they will pose no real problem in the future.
Because your crews will be responsible for their maintenance
after they are accepted, it should be you that establishes which
services can be left and which need to be moved. As soon as you
have done this, Phil Robinson of Stewart Engineering can restake
these services for your crews to trove.
Please inforn me when you have established the services which are
to be moved. The Engineering Division will not release certificates
of occupancy to those properties until such time as the service
problem is corrected.

Dear Charley:
As you are aware, it was recently discovered that certain
portions of the 8 sanitary sewer main on Pleasant Valley
in your Overland Trail Farm subdivision lie directly beneath
the sidewalk:, curb and gutter. An "as -constructed" set of
plans showing this sewer alignment was submitted to the City
Engineer's office by Stewart Engineering, and has been reviewed
by the Development Engineer and by the Water and Sewer Department.
From this review it has been determined that the City cannot
accept for maintenance the existing sewer main on Pleasant
Valley until such time as it is installed in accordance with
the grades and alignment shown on approved utility plans.
Further, if other utilities in the same area are not located
per approved plan they, too, must be moved. Until this work
is completed the City will not be able to release any building
permits for Pleasant Valley east of its intersection with
Touchdown Drive or for Cascade Court.
