The property is zoned IL, limited industrial, and consists of dpproximately 20 acres platted into 12 lots. Three lots at the northewest coiner of Lemay and Lincoln were retained by the original owners. The entire parcel was annexed to the City in 1974, and a plat and utility plans were approved at that time. Our intent is to develop a business park that will attract users with a nr-ed for storage, shop, or lab space, but would also like an office atmosphere. Building sizes will range from 10-30,000 square feet on 1.1 - 2.4 acre lots. As you are aware, the entire site lies within the flood plain of the Poudre River. After several weeks of research during which we held several discussions with you, F.I.A. employees, and reviewed both the City's ordinance and the F.I.A. basic regulations, we would like to submit a variance request for consideration by the Storm Drainage Board at its March 12 meeting. The rpi:Hnnt is to allow the first floor elevation of buildings located on lots 5-16, Lemay Subdivision, to be placed at 6inches above the base flood elevation. Our justification is based on the following factors: 11 The site is located at the easterly edge of the fringe area with an estimated depth of 24-3 feet with a mean velocity of 1.2 feet per second for a 100 year storm. It does not seem likely that at this modest rate there will be a significant hazard to life, or from wave action, floating debris, or materials being swept onto other property. 2) Insurance rates for our site do not change after a one foot increase in the floor elevation above base flood, and building owners are A n • F,,,r Ci,!li ms. In other words, there is absolutely no insurance rate benefit after the first six inches. 3) A 6-inch floor elevation raise will accomodate the projected surcharge from future development of the fringe area. 4) The F.I.A. minimum standards do not require any elevation above base flood level, so that this rolnest will not result in any administrative or certification problems for the City. 5) Based on our estimates, the cost of raising the first floor an additional one foot on the developed sites will be approximately 5150,000. We feel that this cost is an unnecessary hardship to the building owners and will not result in any additional safety or insurance benefits over the 6 inches we are proposing. While we can appreciate the need in some instances for the additional 12 i5chesof freeboard, we feel that in this case, the poten- tial benefit is very small, while the added cost is substantial. Bob, based on the flood hazard characteristics of our specific site and the other factors involved, we feel our request is quite reasonable. We have attewpted to research the matter in a serious and thorough manner and will be happy to discuss any of our assumptions and conclusions with the staff prior to the Board meeting. North Lemay Subdivision And Arterial Alternatives k ISSUE The developers of the North Lemay Subdivision are requesting approval of the replatting of the subdivision, which includes an additional right-of- way dedication for the future alignment of North Lemay Avenue in the Andersonville-Alta Vista area. The developers are requesting that the City pay for the additional 20 foot of right-of-way dedication above that shown on the original plat. The approved 1981 budget does not include an appropriation or sufficient funds to pay for the additional right-of-way. BACKGROUND The North Lemay Subdivision was originally platted in 1974; the plat included a dedication for development of Lemay Avenue as an arterial street of 50 feet in width for the west one-half. Since that time the Lemay Avenue Bridge and Extension have been constructed, which increased traffic substantially. Planning for North Lemay Avenue included identification of an alternate easterly alignment in order to eliminate the impacts of the arterial street on the Andersonville-Alta Vista neighborhoods. The question requires considerable further analysis, a public hearing and a recommendation before consideration and a decision by City Council. This analysis should proceed following the determination of the final alignment of the Fort Collins Parkway. This will happen within about two years. The developers of the North Lemay Subdivision wish to proceed with the subdivision immediately. The City staff and the developers have agreed that it would be in the best interest of both to identify the probable future right; -of -way requirement and conclude the transaction now rather than after development has occurred. This will keep both alternative alignments alive until further study. Mr. John E. Arnold May 18, 1981 Page Two The most the City can offer for the purchase is to purchase the right-of- way if funds become available later in the year, or to include the purchase as a requested item in the 1982 budget proposed. Attached is a sketch that shows the possible alternative alignments. The relationship to the proposed Fort Collins Parkway to the easterly align- ment needs careful evaluation of safety and land use potential. As shown on the cross section the westerly alignment provides for the arterial roadway to be separated from a frontage road serving the adjacent property.
