Beantrees, Inc is a start up drive through specialty coffee business. We will offer a variety of
espresso based drinks, hot and cold, brewed coffee, chaff and traditional tea, steamers, smoothies,
hot chocolate and prepackaged cold drinks. In addition we will offer a limited menu of food items
that will compliment coffee drinks including breakfast burritos, specialty breads, biscotti, sweet
rolls, breads and bars, and cookies.
The business will be located on commercial zoned property located at 432 12" Street, i.e., Lot 3
of Mulberry and Lemay Crossing, first filing, just north of Supermarket Liquors and east of Super
Walmart. The building will be approximately 440 square feet located in the southwest corner of
the property. The site is located in the FEMA floodplain. The building will be elevated 24 inches
above the 100 year water surface elevation. The building's design will be drive through specific,
i.e., with a window dedicated to drive through purchases. Cars will access this window on the east
side of the building. A one way drive will be located east of the building. The entrance will be
from the existing south curb cut shared with Supermarket Liquors, with the exit to be located
north of the building, approximately half way between the entrance and Magnolia Street. A walk
up window for pedestrians will be located on the west side of the building and will be easily
accessed from the existing sidewalk. The building will have a small indoor seating area for up to
15 customers. A handicap accessible bathroom and ramp will enhance pedestrian and sit-down
traffic. The exterior of the building will be tastefully finished in an adobe look with a tiled
awning, with an emphasis on visual esthetics from all angles.
Hours of operation are tentatively scheduled for 5:30 am to 2:30 pm daily. Per an agreement with
Supermarket Liquors, employees will park in their existing parking lot or use a bike rack. No on
site parking will be available.

No commercial building can be greater then 300 feet from a
fire hydrant.
Fire hydrants are required with a maximum spacing of 600 feet
along an approved roadway. Each hydrant must be capable of
delivering 1500 gallons of water per minute at a residual
pressure of 20 :psi.

1.There are numerous items on the floodplain review
checklist that have not been included on the plans and
the drainage report. See attached review checklist for
required items.
2. The grading of the driveway is not above the BFE of 4932.
Therefore, it does not meet the dryland access
requirement. Please review and revise the grading to be
above the BFE.
3. The cross-section and BFE lines must be shown on the
plans along with a note stating the entire site is in the
floodplain.
4. All "floatable" items - bike rack, trash bin, tables,
chairs, etc. need to be noted as being anchored.
5. Please identify the elevation of any HVAC equipment on
the plans and in the drainage report. It must be 2 ft.
above the BFE.
6. A floodplain use permit and $25 permit fee are required.
7. A FEMA elevation certificate will be required after
construction in order to obtain a CO.

The following comments were expressed at staff review on
December loth
Engineering:
1. Letters of intent are needed for off -site easements if the
storm drainage is intended to go to the south and east
from this detention pond. The letters must be provided to
the City before going to public hearing.
2. An easement is needed for a portion of the on -site
detention pond.
3. A cross -access and parking agreement is needed with
Supermarket Liquors.
4. The handicapped ramp is in a utility easement behind the
121h Street right-of-way. This may interfere with some
utilities.
5. What is the status of the existing recycled asphalt drive?
Is it to remain or be eliminated?
Stormwater:
1. Staff is recommending that the site be drained to 12th
Street. Drainage can be redirected to 12th Street without
much re -grading of the pond required. Then off -site
easements from other property owners would not be
necessary.
2. No water quality box outlet detail has yet been provided
for review.
3. An easement is needed for a portion of the detention pond
on -site.
4. Erosion control is needed.

5. Please work with Marsha Hilmes-Robinson on the floodplain
comments. She can be reached at 224-6036.
6. A variance for the "dryland access" requirement is needed
from the Water Board. This variance must be done prior to
the City being able to approve and sign the final
development plans.
Light & Power:
1. Power will come from the existing electric vault in the
north porticn of this site. Please coordinate a
transformer location with Doug Martine. He can be reached
at 224-6152.
Planning:
1. Len Hilderbrand of Xcel Energy indicated that the
applicant should contact Connie Woodward, at 225-7843, for
installation of gas service. She will need load
information.
This item could be ready for a Planning and Zoning Board
public hearing if comments are addressed in a timely fashion.
Staff is tentatively putting it on the January 15, 2004 P&Z
agenda. Please see the attached Revision Routing Sheet for the
number of copies of each document to re -submit when addressing
the comments. Also, be sure and return all of the red -lined
plans when you re -submit.

This letter documents our understanding and agreement to the removal of the
existing asphalt drive bordering the south property line of Lot 3 at 432 12t'
Street, Fort Collins, Colorado as part of the sale of this property.
The purchase agreement between David G. Joyce and Stephen D. Joyce (Sellers)
and Eileen Turgeon (Buyer) shall include the following terms regarding the
existing asphalt driveway.
)> The Buyer shall be allowed to remove the existing asphalt strip to
accommodate the new driveway and landscaping requirements for the
Beantrees drive through coffee house.
The Buyer is not responsible for relocation or replacement of the existing
asphalt driveway on their property or any adjacent property.
These terms become effective upon the execution of the "Contract to Buy and
Sell Real Estate" between David G. Joyce and Stephen D. Joyce and Eileen

This letter documents our verbal agreement on property easements between Lot
3 at 432 121" Street, Fort Collins, Colorado and the property directly to the south
of this lot containing Supermarket Liquors. The purchase agreement between
David G. Joyce and Stephen D. Joyce (Sellers) and Eileen Turgeon (Buyer)
includes the following terms regarding the shared property.
➢ We agree to give the Buyer access to the property through a shared
driveway on 121h Street spanning the south end of the Lot 3 property and
the north end of the property where Supermarket Liquors is located.
We agree to let Beantrees utilize an existing trash dumpster on the north
end of the Supermarket Liquors property.

My reply: It was not chanced. Althoush since this is a vertical curve around a curb return the desi_vn

8) My comment: Future Lincoln Ave improvements - The vertical curve starting at sta 32--54.25 on the
south flowline has an incorrect K value, correct value: 93.5/L92-,44) - 68.75 This doesn't meet the min
requirements for s0-mph design (min 110). This is still incorrect.

My reply: Nothing was done to correct the value or address the tact that this curve doesn't meet
standar(s. A variance was requested for the interim desicn and was acceptable for the interim design only.

Reference is made to your letter dated July 12, 2001, of the same subject (copy attached).
The offer to which you refer was made at a meeting on May I", over 2-'h months ago. At that time, the
concrete curb/gutter/sidewalk work was underway, and the paving on East Magnolia Street had not been
done. I had made the field decision to modify the plans by substituting a concrete gutter pan in place of
the rollover curb -and -gutter on the north side of Magnolia Street. This was in response to property owner
concerns about drainage and access. I firmly believe that was the correct decision.
Had Mr. Spccht accepted m% offer at the time it was made, I would have been willing to pay for removing
a portion of the concrete gutter pan and replacing it with rollover curb -and -gutter in front of his property,
as called for on the plans. This would have been a relatively minor expense at that time However, it
would be far too cost[v to change this now that the work has all been completed. As it affects the Spccht
property, the constructed improvements allow cast' access without changing the historic drainage patterns.
I can see no reason to change what has been built.
Incidentally, curb cuts are not rcalh necessary with rollover curb -and -gutter, although many people prefer
to have the curb cut. As constructed, Mr. Specht's propertv has what is in essence a continuous curb cut
for his entire propertv frontage. This resembles the previous condition on Magnolia, and it is what the
property owners on that north side of the street asked for.

The Mulberry-Lemay Roundabout design team, led by Balloffet and Associates, assures me that
the roundabout project is on track for a September 1, 2000, bid date to construction contractors.
Your associate, Ben Drake, as well as representatives of CLC Associates, have participated in
the weekly design meetings, and I am sure that they can verify the extensive progress that has
been made to date. Right -of way plans have been completed and submitted to CDOT, and
acquisitions of the necessary properties have commenced. Environmental and stormwater issues
have been addressed and essentially resolved- The geometries of the roundabout in its ultimate
configmation have been established, and plans for interim staging are well underway. Utility
plans are virtually complete, although some additional discussions are taking place regarding the
fate of the 24-inch diameter water line- Associated elements of the project, such as the design of
the bicycle/pedestrian bridge, the creation of a public education program and the design of the
center island landscaping, are also progressing satisfactorily. I have every reason to be confident
that the City will be prepared to advertise the project to qualified construction contractors by
September I"
Accordingly, it is tlhe Citv's expectation that you will fulfill your obligation to pay the local
street portion of the intersection improvements, as well as other agreed upon costs, in accordance
with the Development Agreement dated June 22, 2000 As of today, that dual cost figure for the
developer's share is still being discussed, but it is my understanding that Ben Drake and Matt
Baker are very close to agreement on what the number should be. We are currently awaiting a
revised submittal- which needs to include the utility costs and other items cited in Exhibit D of
the Development Agreement. It appears that your obligation will be for approximately $800,000
plus the additional S200,000 which you agreed to contribute toward the design and construction
of the bicycle/pedestrian bi idge over the Poudre River. The Citv looks forward to the receipt of
these t'unds by August I5, 2000.
Also, for your information, the IGA with CDOT, which is also discussed in the Development
Agreement, has beer drafted and agreed upon by both City and CDOT statT The IGA will be

presented to Fort Collins City Council for approval at its August 15°i meeting. Assuming it is
approved, the CDOT State Engineer is expected to finalize the IGA by the end of August, 2000.
