Gentlemen:
This letter is to evidence our agreement with you that you
will issue a certificate of occupancy, upon our agreeing to do
the following things in regard to our property on South College
Avenue, as soon as is reasonbly possible:
1. Install the required guard rails on the bridge.
2. Repair the presently damaged curbs on the frontage
road and Mason Street.
3. Adjust the manholes and valves as required.
4. Do the necessary back fill work on the South side
of Foothills Parkway.
It is our understanding that upon your receipt of this letter
agreement to do the above, that we will receive our certificate of
occupancy. If you have any questions in this reaard, I would
appreciate your contacting me as soon as possible.

There is a proposed revision of the dock ramp at Steele's Market in the
Mourning Subdivision. The original dock ramp was planned to be 12 feet
wide, and the proposed ramp is to be 20 feet wide. The ramp is to be con-
structed with a catch basin in the bottom for storm water, and it is also
used for storm water detention. The 12-foot wide dock had a volume of
2376 cubic feet to a depth of 3.3 feet, and the new dock will contain the
2376 cubic feet with a reduced depth to 2 feet.
This revision will have negligible affect on the drainage quantities,
and it is an advantage to the detention water depth.

Dear Richard,
The staff has reviewed the application for preliminary and final approval
of the warehouse expansion to the Steele's Market in the Mourning Sub-
division and would offer the following comments:
1. Loading :zones should be clearly indicated on the site plan.
- Warehouse loading zones appear to conflict with the movement
of other vehicles in the parking lots. The staff would like
to work with the applicants to resolve this problem.
2. The sidewalks along McClelland and Foothills Drive should be
indicated and the width dimensioned.
3. Utility plans and drainage reports will be necessary. Please
submit items to staff as soon as possible.
4. The City standard is that parking should be setback a minimum
of 50 feet from the flowline of adjacent public streets. The
design of the parking lot at the entrance to McClelland does
not appear to meet this standard. A variance request will be
necessary.
5. The applicant should contact the Light and Power Department
regarding removal of existing electrical utilities. All costs
of removal or relocation will be paid by the owner.
6. The staff would recommend that the 21 foot aisle alona the west
edge of the proposed warehouse be eliminated and landscape
screening be substituted.
7. The staff is concerned about the potential negative visual impact
of the 195 feet of block wall area along McClelland Street. The
staff would recommend that the applicant re-evaluate the plan in
terms of utilizing a more visually interesting wall material and
landscape screening to break up this area.

8. The staff would like to work with the applicant in terms of
providing additional landscaping in the parking lot in order to
break up the large expanse of pavement and to better channel 7e
vehicles in the site. Please see me r,,,r, detail,.
9. The staff questions the energy savings being achieved as noted
on the site plan. The staff would like to work with the appli-
cants to better clearify intent of the criteria and r,roject.
10. On Monday, November 14, 1983, signed mylars of the site plan,
landscape plan and building elevations, in addition to a signed
copy of the Site and Landscape Covenents should be delivered
to this office. Also, on that date, 81-," X 11" PMT reductions
and colored renderings should be submitted.
I would recommend we meet as soon as possible to discuss the above comments.
On Monday, November 7, 1983, revisions to the plans reflecting the above
comments should be delivered to me. If you should have any questions,
please feel free to call.

Dear Bob:
Please let this letter serve as a request for variance in the
storm drain pipe sizing for the proposed Columbia Savings at
the northwest corner of Foothills Parkway and the South College
Avenue frontage road.
We are recommending that a 12" R.C.P. be installed from the
parking lot storm drainage inlet to the inlet at the frontage
road for the following reasons:
1. Owner will maintain storm drainage system
2. Lower pipe cost
3. Lower hydro -brake cost
Please notify me as to your decision in this matter.

In reviewing the plat of ?burning Subdivision and in checking
on the utilities constructed in the field, T find that Steel's
Grocery did not tap onto the sewer line constructed by Mr.
Deines, in that Lot I is not adjacent to said sewer line.
to order to serve the Market, it was necessary to plan a
manhole on the sewer line and extend a line north to Foothills
Drive t_> serve the property.
')'here is no repay to Mr. Deines until such time as Tract A
may connect.

The primary issue raised by this proposal is also parking. Normally, if this
site were being developed as an entity, 50 off street parking spaces would be
required for a 10,200 square foot building. Only 23 spaces are actually shown
on the site plan, however.
fhe rationale for this is first that the bank facility proposed is primarily
for drive through traffic and thus has significantly reduced parking needs,
and secondly, that this development is part of an overall planned unit develop-
ment and that parking should be shared. The fact is that Steele's Market has
1.L9 spaces more than would be normally required. This is more than enough
to handle any spill over from the Fort Collins National Bank site.
Staff Recommendation: approval upon the following conditions:
1. There be a statement on the site plan that all owners in the P.U.D.
agree to pool their parking.
2. The site plan indicate a pedestrian cross walk connecting the bank
with Steele's parking lot.
3. Plant secies and locations be changed on the landscape plan as per
the City Arborist's recommendations.

RE: Sewer Main Extension - Deines/Steele
I have your memo regardin� the above matter and have
reviewed the map and Chuck Liquin s comments. I agree with
Chuck that we have handled reimbursement contracts on a front
foot basis; however, I have always felt this is inequitable
and that a square foot reimbursement would make much better
sense. The instant case is a perfect example since it appears
obvious that no one will ever use the sewer in connection with
Tract A, and yet the sewer did undoubtedly benefit the Mourning
Subdivision. Basically, this appears to be a problem of how
the agreement was drawn and I have not reviewed the agreement.
From an equitable standpoint I would feel that the Mourning
Subdivision should pay a share of the cost of the line since
it is making use of the line. I feel this entire subject is
a subject which should be discussed between your office, my
office and the City Manager, and hopefully we can avoid this
problem in the future. On this immediate case, I assume that
Mr. Steele has already connected to the line and that no charge
was made at the time of connection. Therefore, it will un-
doubtedly be very difficult to collect; however, I recommend
that we contact him and make attempts to collect an equitable
amount for reimbursement to Mr. Deines.

Dear Mr. Franc
As per your correspondence of October 25, 1983 in regards to the subject
project, we are submitting this letter as a formal request for a parking
variance. As pointed out in your letter, we are not in conformance with
the City Standard requiring a minimum setback of 50 feet from the flow —
Line of traffic at the McClellan Street entrance.
The present parking and driveway design has been serving the public since
1974 when Steele's Market was formally opened to business. The owners have
never been made aware of any traffic problems resulting from the present
Iles 1 gn.
