Re: Meadows East - Timberline Road Design
In response to the request of your client, Mr. Earl Stafford, of yesterday,
we wish to reiterate the following facts:
1. This office requested that you provide us with sufficient data
to allow us, jointly, to examine the finished grades you proposed
as they relate to existing curb and gutter to the south and as
they might relate to Planned Development of Timberline Road to
the north and Drake Road to the east.
2. After repeated requests for this information, on Friday, May 12, 1978,
you returned the prints showing how you proposed to discharge the
surface drainage from the west side of Timberline at the south end
of your development (which we requested) but we did not receive
any of the additional data which we requested. You stated that
you did not feel it was your responsibility to show anything
beyond the limits of your client's boundary.
Jack, we have no intentions of requiring you or your client undue expense
in developing the utility plans for Meadows East. However, we do feel it
is the responsibility of a professional engineer to investigate all reason-
able aspects which his design has on surrounding areas. In recent years,
this has been particularly iE-portant relative to drainage and this was
our reason for the requested information.
Since the information was not provided, we scheduled our survey crew to
acquire this data for us. our survey crew provided the information to this
office at 4:15 P.M. yesterday, May 16, 1978. We have plotted this in profile
and have found that your design for Timberline Road to be acceptable.

Some months ago I spoke to you about the trees we began to plant last
fall in conjunction with the completion of our Meadows East subdivision
at Timberline and Drake Roads. Light and Power personnel objected to the
fact that the required trees were directly over one of their duct banks.
At the same time, because the right of way on this roadway was widened
after the original plans were approved to accomodate an eventual six lane
street, there is now nowhere else to put the required trees. At this
point I can see only two choices. We can either leave the trees over the
duct bank, or we can take them out and delete their requirement from the
plans.
We are about at the time of year when our landscapers will be able to
begin final work on this area. We need your help quickly so that we will
know how to proceed with these final landscape constructions.

We regret that you and your client feel that we have been extreme
in our demand for additional information resulting in delayed approval
of your utility plans for Timberline Road. However, in our role as
professional reviewers for the public, we would be remiss in our
duty to that public if we did not review the "whole picture".
As a result of this added information made available by our survey
crew, we can now approve the utility plan for Timberline.
We would like to remind both you and your client that the interior
utility plans were approved and released to you last week in an
effort to reduce the delay of this project. In addition, your
client had the option of constructing Timberline Road at a later
date pending completion of the design, but elected not to do so.
If you have further questions and/or comments, please feel free
to call on us.

It has come to our attention that the 16-inch water lines in Drake Road
and Timberline Road which supply the Meadows East Subdivision have a
repay agreement on than. our records indicate payment of this repay
has not been made. It was apparently overlooked by City Staff at the
time the subdivision agreement was written.
According to the plat of Meadows East, the frontage on Drake is 1056.50
feet and the frontage on Timberline is 2648.49 feet for a total of
3704.99 feet. The repay rate is $2.7664 per lineal foot for a total of
$10,249.48. Please contact us as soon as possible concerning payment
of this amount so that the City may fulfill its obligation to the
builders of the water main in question.

Dear Bob:
Our survey crew has checked the grades, and I have inspected
the site of the detention pond in the Meadows East Subdivision.
The pond is constructed to the grades as shown on the utility
plan. The pond outlet catch basin and pipe from the inlet on
Timberline are to be completed as Timberline Road is constructed.

Re: Street paving
Meadows East 1st Phase
Dear Dennis:
In Bob Zakely's letter of June 13, 1979 you were informed of street
pavements in certain areas of the 1st Phase Pleadows East Subdivision
which do not meet City specifications.
These areas are:
Custer Drive: west of Sagebrush to Adobe Drive
Abilene: from east cul-de-sac west to Adobe Drive
This street will be visually checked and all areas showing signs of
inadequate subgrade or other forms of deterioration will be repaired
as necessary.
Please be informed that these streets will not be accepted by the City
until such time as their repaired condition conforms to City specifications.

I have verified that the Meadows Fast detention pond has been
built according to the City approved utility plan and will be
accepted for maintenance by the City.
As you are aware, the detention system is not coiplete until
such time as the drainage swale on the south side of Drake Road
has been constructed. It is possible after the storm drainage
study for this area has been completed the City may reTAre this

This letter will confirm your telephone conversation yesterday with
Marc Engemoen regarding the maintenance of the Meadows Fast detention
facility. I informed you by letter dated September 30, 1980 that the
Meadows East pond had been constructed according to appro-red utility
drawings and was therefore accepted for maintenance by the. City.
However, you are aware that the Parkwood East detention pond outlet
was never constructed per approved plans and has not been accepted
by the City. In particular, the present pumping of groundwater into
the storm sewer is not an acceptable permanent situation.
I know you are aware that the groundwater being pumped frcim Parkwood East
is flowing into the Meadows East pond. You m rationed yesterday that this
groundwater cannot flow freely out of the pond because of some settlement
around the outfall, and is pending. This of course prohibits our maintenance
of the facility. In light of this situation, I must advise you that the
City cannot maintain this facility until this problem has been resolved.
Inasmuch as your activities in Parkwood East are the direct cause of this
problem, it is apparent that both the responsibility for resolving the
problem and the interim maintenance rest with Everitt Enterprises.
The City certainly desires to provide any assistance they can in arriving
at an acceptable solution to this situation, but as the developer, the
initiative must rest with you and your consulting engineer. I hope we can
make some progress before we run into problems with the issuance of
additional building permits or certificates of occupancy in Meadows East
as well as P.arkwvod East.

Dear Jack;
Everitt Enterprises, Inc, will maintain the 8" sanitary sewer main
between Lots 56 and 57 in the Meadows East Subdivision until such
time that a manhole is constructe3- fFis manhole will be part of
the utilities which will be put in with City approval on the north
half of the New Hampshire Subdivision. The manhole will be at the
south end of the 8" sanitary sewer main which runs between Lots 56
and 57.
If there are any questions, please don't hesitate to get in touch
with me.

Re: Landscaping at Meadows East Subdivision
Dear Mr. Zakely:
In recent weeks it has come to our attention that the landscaping adjacent
to Timberline and Drake Roads has not been installed. Please be advised
that in researching the Development Agreement and Utility Plans, we found
the landscaping of these areas is required. We also understand that this
work could not be completed until such time as the improvements to Drake
and Timberline had been completed. However, the street work is complete
and it is now time to install the landscaping as detailed on page 15 of 16
of the Meadows East Subdivision Utility Plans dated May 5, 1978.
The intent of this letter is to serve notice that the City now wishes the
completion of the landscaping along Timberline and Drake Roads. It is my
interpretation of the Development Agreement for the Meadows Fast
Development, dated May 11, 1978, that Everitt Enterprises is responsible
for the installation of landscaping as well as its maintenance for a two
year period. I'm sure that the lack of landscaping for this development
was just an oversight and we appreciate your cooperation in correcting this
situation.
