This letter of understanding is in response to our meeting on Thursday,
October 14, 1.982 regarding future planning for the Larimer #2 Canal
Extension within the Superblock area north of Harmony Road.
At such time as the future Special Improvement District for John F. Kennedy
Parkway is formed, the property owners through their engineer shall be
required to incorporate an adequate canal section, enlarged if necessary,
including all street crossings and a realignment of the existing canal
into the scope of the work for the SID. The capacty of the realigned canal
and all street crossings shall be sufficient to carry anticipated surface
water runoff along with any irrigation water that may be routed through
the canal in the future. For definition purposes the Larimer County Canal
#2 Extension is defined as commencing from the Warren Lake inlet ditch
to Mail Creek.
As indicated by Pat Mestas, the engineer retained by the property owners,
the prop-crty owners are aware of this requirement, and will include any
additional work required in the project to accomplish this purpose.
Any future improvements to the Larimer County Canal #2 Extension and
storm drainage to enter into the ditch will be required to have the
approval of the Board of Directors of Larimer County Canal #2 before City
approval for construction within the Superblock.
By your agreement with the above policy, please sign in the space provided
and return.

Lot 7, The Landings Fifth Filing
Dear Glen,
As you know, the drainage improvements located on Lot 7 of the Landings Fifth Filing, have
been modified by the home owner after obtaining the appropriate approvals for those
modifications. The side lot drainage Swale has been constructed in substantial conformance with
the swale detail provided on the Grading and Drainage Plan for the Landings Fifth Filing. The
channel has been constructed with exposed cobbles instead of being sodded or seeded.
The detention pond, which was proposed on the rear portion of this lot, has been filled in and
abandoned. Attached is a blueprint of the Landings Fifth Filing Grading Plan which has an
approval signature from John Strachan, President of the Latimer County Canal No. 2 which
indicates his approval of this modification. The approval statement reads:
"As approved by signature below, it is recognized, the storm water previously
detained in ponds A & B, will now flow directly into Latimer County Canal # 2,
without detention" .
The same print has your approval signature in the revision block for the September 15, 1992
detention pond elimination revision. Your approval signature is dated 09/18/92.
All drainage facilities are functioning properly. The general intent of the drainage design for the
Landings Fifth Filing has been met. Please consider this letter as a final certification of the
drainage improvements for this portion of the Landings Fifth Filing.

In compliance with the City of Fort Collins standards,
we are requesting a variance from storm water detention
requirements. We recommend that storm water from the Land-
ings 5th Filing be discharged into irrigation canals which
surround the project. The majority of the projects storm
water will discharge into the Warren Lake inlet canal. A
small portion will be discharged into Larimer canal No. 2.
By routing the runoff directly into these canals we will
in effect reduce the peak flows from adjacent drainage
basins. The canals and irrigation reservoir do not con-
tribute to basin wide storm water flows.
The proposed discharge into the irrigation canals is
in agreement with ditch company owners. However, at this
date we do not have a signed agreement with the owners as
they were out of town and would not be available prior to
our submittal. As quickly as possible we will submit letters
of approval from the irrigation company to you.

We are pleased to resubmit to the City of Fort
Collins, design modifications to the proposed Landings
5th Filing project. Design changes were a result of
review by various City departments. We feel that we
have addressed the comments and are in accordance with
the City of Fort Collins design criteria.
It is required by the Storm Drainage Department
to obtain written approval from any irrigation company
which will accept storm water runoff into their systems.
We have been in contact with Glen Johnson of the Larimer
No. 2 canal and B.G. Jackson of the Warren Lake Irrigation
Company and they have given the conditional approval of
the improvement plans. However, they are unavailable at
the time of this submission to finalize written agreements.
These agreements should be completed within the next week.
When the agreements are obtained, we will forward copies
to you and also have the approval signed on the cover
sheet of our drawings.
Mr. Johnson has expressed that he does not want
any drainage in the Spring Canyon lateral as he feels
that it will be abandoned as development occurs. This
also justifies our use of a C.M.P. culvert under Spring
Canyon Court, as it would be uneconomical to provide a
concrete box culvert should the ditch be abandoned in
the near future.
We understand that lot owners must contribute
$129.49/unit to the Warren Lake interceptor. This cost
will be realized in the developer's estimated develop-
ment costs. --

In the future we will show sewer plan and profile
on the same sheet as you have requested.
We apologize for the manner in which the plans
were intially submitted. We were negligent in preparing
drawings consistent with the City of Fort Collins design
standards. This was a matter of not enough time to pro-
duce a quality product. We feel now that we are in accor-
dance with the City design standards. If you have any

Concerning your request for a variance in the storm water detention
requirements for Landings 5th Filing I have the following co=ents:
Due to the relatively small size of the subdivision the developed peak
runoff is not significant. Since the runoff is channeled directly to either the
Larimer Number 2 Irrigation Canal or the Warren Lake Inlet Canal downstream
property owners will not be affected and therefore I see no problem with your
request.
Your request for a variance in the detention requirements for Landings 5th
Filing is hereby approved provided written approval from the respective ditch
company owners to accept the runoff is received by the developer and a copy is
sent to the planning department.

Design
we are requesting a variance from the City of Fort
Collins Design Criteria for standard streets, for The
Landings 5th Filing P.U.D. Specifically, the variance
is requested for reverse curves 1 and 2 and reverse curves
10 and 11 on Spring Canyon Court. As indicated, these
are reverse curves and do not conform to Design Criteria
for minimum tangent length between curves. The minimum
tangent length required for a local street is 50'.
The reversed curves were necessary due to a long
radius curve platted in The Landings 4th Filing. By
continuing the curve to the West as the plat indicated
the street geometry would reduce the size of the lots
in the West portion of the P.U.D. to smaller than desired
areas. Therefore we felt it was best to reverse the
curvature back to the East to maintain desired lot sizes.

Per request by Frank Humbert of. Osprey, Inc., I am writing you this
letter. TiL naLyprous dismassions between myself and you, we have discussed
the issue of the riprap protection for the storm drainage swales on the
Tandinqs Fifth F.ili::q project.
As we have discussed before, I can appreciate your need for wanting to
insure the riprap placed in these channels stays there and is not disturbed
by vandalism. However, as we have talked before, the idea of seeding or
soddinq these ched-incls seems rather costly and questionably functional.
Mic belief between myself and Frank. Pumbcrt is that the seed or sod will he
dee;troyed by the iq-)vement of the storm runoff in these channels. However,
the fact still remains that we need erosion protection for these channels.
Flhat Frank and you have discussed and what he has relaved to myself is
that you would be willing to allcwa the seeding in the area specified on our
drawinq entitled, "Gradi.nq :Plan", sheet 5 of 9 of the Tandincs Fifth
Filing.
This would in fact insure proper sodding and riprap in the areas most
likely to erode. This would be the inlet and outlets to culverts and where
the channel changes direction. I am in agreement with the both of you on
this topic. I will be revising this sheet to reflect the typical cross
section `or theso areas. 1 will he sending you a revised h,lar to be
substituted in your set which is held by the Cite,
