Dear Rex:
we are presently preparing an inventory of detention ponds in the
City to determine whether or not they have been properly constructed
and have been accepted for maintenance by the City. In doing so, we
have noted that the detention pond for Kensington South, First Filing
has not been. constructed in accordance with the approved utility
drawings.
The headwall at the outlet structure and the trickle channels have
not been installed. Also, the overall grading of the pond is not in
accordance with the utility plan. if you wish to go over these items
before you correct them, please contact Dave Stringer at our office.

Sidewalk Repair
It has come to my attention that a 30-day, Temporary Certificate of Occupancy
was issued for the above residence on October 19, 1981 conditional upon the
adjacent public sidewalk and surrounding pavement being repaired. As of this
date, our office has not received clearance from the Engineering Division in-
dicating that the necessary repair has been done.
I understand furl 'her that your office has been apprised of this matter by a
phone call from our office on two separate occasions with no corrective
action taken.
City subdivision regulations specifically require that all such public im-
provements be completed prior to issuance of a Certificate of Occupancy.
Because the Temporary Certificate has expired, the occupants of the above
residence are no longer authorized to remain there. Therefore, if the
required sidewalk repairs are not completed within five days of this notice,
proceedings to vacate the above residence will be initiated as agreed to by
your firm when the Temporary Certificate was issued.

Dear Mr. Miller:
I am sure you are aware that the detention pond, for Kensington South,
First Filing has still not been constructed in accordance with the
approved utility drawings. The headwall at the outlet structure and
the trickle channels have not been installed, and the overall grading
is not in accordance with the utility plan.
I brought this matter to your attention in a letter dated August 29,
1980, a copy of which is attached. You advised me in a letter dated
September 9, 1980, also attached, that the necessary work would be
completed by the summer of 1981. As we are now approaching the 1982
construction season, I wonder if you are planning to bring this matter
to a conclusion.

I realize that the present slump in the building industry has affected
your construction schedule, and that is difficult to estimate when
construction will pick up again. But I am sure you can appreciate the
concern of the homeowners in Kensington South who have endured the nui-
sance the pond creates:in its present condition for the past three years.
Please advise me at your earliest convenience when we can anticipate
the completion of this pond. Your cooperation in this matter would be
greatly appreciated. If you have any questions, please do not hesitate
to call me.

Dear Rex:
Some weeks ago you met with Marc Engemoen and myself to discuss the detention
system in the Kensington South lst Filing as it relates to building permits.
In our meeting you indicated the remaining improvements to the detention
system would be completed as soon as possible. In turn, the City agreed not
to withhold building permits in the Kensington South Subdivisions because of
the drainage system.
To date the City has released building permits for homes on Hastings,
Canterbury and Knottingham streets. However, work towards completing
the drainage system has not yet started.
The City has operated in good faith towards its portion of the agreement and
now requests the drainage system be completed.
In addition, after the pond's completion a letter from your engineer to the
Storm Drainage Utility, certifying the drainage system has been constructed
to the lines and grades shown on the Kensington South 1st Filing Utility Plans
as approved by the City Engineer must be submitted.
If the drainage system is not completed by July 31, 1983, the City Engineer's
office will withhold all building permits in the Kensington South Subdivisions.
All permits requested from now to the July 31st date will be handled on an
individual basis.
I regret the :inconvenience this may cause you, but the Kensington developments
have expam.ed to the point where completion of the pond is necessary.

This is to inform you that we have examined the detention pond on Tract "A",
Kensington South, First Filing. The concrete pan was straightened and has
been completed. Some finish grading was required to ensure the bottom of
the pond drains to the pan. The volume of the pond was not significantly
decreased; however, its actual volume was much greater than the volume re-
quired at the time the pond was designed.
The pond appears to be built as designed and will function as it is supposed
to. If you have any questions regarding the pond, please call.

Dear Mr. Miller,
I have received a letter from Dick Rutherford of James H. Stewart & Associates,
Inc. dated March 28, 1984. This letter was addressed to Dave Stringer, Chief
Construction Inspector, and indicates that certain work has been completed on
the detention pond in Tract A. From what I understand this work was necessary
prior to final acceptance of the pond by the City.
Please be informed that before the City can accept the pond for perpetual
maintenance an "as built" survey showing detailed cross sections of the pond
will be necessary. These cross sections are needed to verify pond volume
and check bottom elevations to see if there is adequate slope to insure the
bottom of the pond drains to the pan. After these cross sections are received,
reviewed and approved, a final site inspection will be completed prior to
final acceptance. If, after the site inspection we are satisfied with the
construction of the pond, you will be notified in writing of the City's
acceptance for perpetual maintenance.

Dear Mr. Miller,
As you requested I am sending you this letter to verify the Tract A, Kensington
South 1st Filing has been in the past and will be in the future used for a
detention facility for this development.
During our discussion at the site this afternoon I indicated that once the Storm
Drainage Division receives, reviews and approves the "as built" cross section
information a final site inspection will be completed. If after the site
inspection, the Storm Drainage Division is satisfied with the work, a letter of
acceptance will be sent to you and the City will assume responsibility for
perpetual maintenance.
As we agreed upon, the area to be included in the cross sections is that portion
of the pond east and approximately 10 feet west of the new concrete trickle pan
installed from the south inlet to the pond. Also that portion of the north end
of the pond from the top of sidewalk on Drake to the toe of the slope along all
of the area that was filled. As I indicated, the Storm Drainage Division
requires that all new detention ponds to be maintained by the City must have at
least a 20 bottom slope. However, based on your indication that there is not
enough fill material to satisfy this requirement, a 1.5% bottom slope for that
portion of the pond that is being regraded to drain to the pan will be
acceptable.

Dear Sir:
on June 9, 1978 the 7.0' concrete walk and bikepath was
constructed on the south side of Drake Road between Dunbar
Avenue and Canterbury Drive. It has since been noted that
the landscaping has not been completed per plan as shown
on Section A -A, Sheet 15 of 15 of Kensington South Utility
Plans. It has been observed that the drainage Swale between
the vertical curb and gutter and the 7.0' walk has not been
graded to meet the top of walk or the back of curb, thus
allowing undermining of the north edge of the walk in
numerous areas.
This landscaping should be completed as soon as possible
to prevent any further erosion in these areas and to minimize
the structural damage taking place on the north edge of the walk.
The 7.0' walk and bikeway will not be accepted by the City
until the landscaping is completed.
