We are submitting to you for review four copies of an Amended Master
Plan for Huntington Mews P.U.D. (formerly an Amended Master Plan for Fossil
Creek Meadows P.U.D.). Included with this submittal are three copies of
an Application for Approval of a Planned Unit Development as required by
the Larimer County Subdivision Resolution. This submittal is on behalf of
the Fossil Creek Meadows Development Group of Lakewood, Colorado.
The subdivider is aware of and agrees to all previous conditions of
approval. except for paragraph 1.B.3.c. of the Larimer County Board of County
Commissioners' agenda dated May 19, 1980, referring to the date that the
Commissioners may call for a legal description of a 20-foot trail easement
across the property. The date of April 27, 1979, relates to the approval
of the original master plan and is no longer valid. The First Filing of
Huntington Mews is at the final plat stage with an anticipated completion
date of July 1981. The remainder of the master plan is tentatively expected
to be completed in four filings by the year 1986. At this time a trail
easement will be surveyed and dedicated to the public at the request of the
County.

Enclosed is a mylar plat showing the description that has been corrected
for the Iuntington Mews annexation. Our changes do not exceed the legal
description that has been advertised and voted on. The changes do decrease
the area. slightly.
As you recall in our conversation earlier, what we actually found
were two different surveyors who had points on a 16th line. When we
originally started our survey we chose the only point that was of record
along this 16th line. One year later another surveyor set a new 16th line
and thus at the time of this annexation two 16th lines were in existence.
We have chosen to adhere to all other bounding surveys and can now assure
the City that there are no overlaps or encroachments.

RE: Dedication of Streets in the Kel-Mar
Strip Subdivision
The request for approval of the final plat of
Huntington Mews PUD and the extension of Skyway Drive to
Huntington Mews as the primary access route has given rise
to a question concerning the dedication of a 30-foot
survice road on the plat of the Kel-Mar Strip subdivision.
The Kel-Mar Strip subdivision plat was processed during
the years 1.964, 1965 and 1966 and, when filed, did not
contain a dedication of the service roads as set forth on
the plat. It is my understanding that the Kel-Mar Strip
subdivision was platted in two filings and that the second
filing did contain a dedication of the roads and streets
but that this plat was unsigned by the owners when filed.
Subsequent to that time, a ratification of the second
filing was recorded. This ratification pertained to Lots
22 through 33 of the second filing and was signed by the
purported owners of those lots, Willis R. Bonser and Sam
Brunswig. I am of the opinion that this ratification of
plat, if signed by the owners of the subject property,was
sufficient to constitute a dedication of the roads, streets
and easements in the second filing.
Accordingly, the service roads as shown on the first
filing have never been dedicated to public use, and there
has not been sufficient use by the public to justify a
claim of adverse possession or prescription in the absence
of 18 years of continuous, notorious, hostile, etc. use
as is required for prescription.
In 1970 the District Court of Larimer County ruled
in Civil Action No. 17976 that Edna V. Lynn was the owner
of a 20-foot easement for ingress and egress across the
northern most portion of the first filing of Kel-Mar Strip
subdivision. This easement is personal to Ms. Lynn and
would not be of benefit to the public.

It will be necessary for the present owner of the
30-foot service road (and Ms. Lynn) to dedicate that road
to Larimer County for public use before Huntington Mews
can utilize said road for access to the proposed subdivision.
I suspect that Edna Lynn will have no objection to such a
dedication since the public access road would be sufficient
to supply her with access to her adjacent property. If
Willis R. Bonser and Joann Bonser remain the owners of the
service road in the Kel-Mar Strip subdivision, first filing,
they should execute a dedication to Larimer County as above
mentioned. If it becomes impossible to determine who the
owner of the service road is at the present time, it may
be necessary to commence quiet title action for the purpose
of such determination.

We have requested the developer not to pave Saturn Drive from Duzne
Street to 300' east of Highway 287. This was done to speed up the
City process of pushing through Skyway Drive. As you are aware,
Skyway Drive will be the major collector between Trilby Road and
Fossil Creek Parkway. This meets both the City's and State Highway
Department Master Street and Access Plan. The plan also shows that
Saturn Drive should not access directly onto the highway.
In reviewing the subdivision, we alloyed the developer to design
Saturn Drive as a local street. our feeling is that if Saturn
Drive is completely paved now that it will exist as the major col-
lector road from now on. A rough estimate of the traffic projected
on Skyway wculd be around 10,000 V.P.D. If this traffic was to be
placed on Saturn, extreme traffic problems and hazards would exist.
Might I also remind you that using Saturn as the collector would also
cause undue traffic thru an existing County subdivision to the west
of Highway 287.
I would therefore request that you approve of the interim gravel road
across Ke_Imar Strip 2nd Filing.
If you have any problems or additional questions please contact me at
extension '735 as soon as possible.

to the County. There are two streets. One is the first 450 feet of Saturn
Drive and the other is the secondary access road.
You will note that I have sent you two sheets of Saturn Drive. One is
with the County part of Saturn Drive having a 9-inch base and no asphalt.
This is the plan that the County would like to approve. The second sheet
shows the same area but with asphalt paving, curb, and gutter. If you will
not approve the base material, please approve the county road with the
asphalt instead of the base course material. Please sign the cover sheet
with the indication as to the type of material; then call this office and
we will pickup the sheet.

Please excuse the delay in responding to our meeting of November 22
concerning your plan to develop property surrounding the Portner Reservoir.
As follow-up, we discussed the two questions posed by staff and are
prepared to offer the following reactions and/or advice.
The questions are:
(1) Would the City favorably consider an SID for the collector street
and connection to Werner Elementary school and, if so, under what
conditions; and
(2) Would the City consider using neighborhood park funds to
accelerate re -construction of Portner Lake as a first phase
leading to a community park in the future.
In regard to the first question, the Engineering Department believes that
the most significant community wide benefit in this project would be to
complete Fossil Creek Parkway from College Avenue to South Lemay. This
connection is also important for another access to the new Werner
Elementary School. The other collectors may not meet the criteria for
S.O.S. reimbursement which would mean the development would have to pay
the oversized portion to offset its impact.
Fossil Creek Parkway will need some expensive bridges and would require the
Parks Department to pay their residential street costs as an adjacent
property owner. It is our understanding that the park development may be
ten years into the future which would be a funding problem for them now.
At this time, we do not believe the benefits outweigh the potential
expenses to the City and would therefore be unable to give a favorable
recommendation to City Council for this SID request.

Relative to the second question, the Parks Master Plan has identified a
northwest portion of the lake area for a neighborhood park. It is doubtful
that there will be sufficient funds to invest in the dam to make a
difference. Furthermore, the State has advised that no additional water
may be placed in the lake until the impoundment structure is improved.
This would mean that any interim plan to use the lake would be out of the
question.
Resource Consultants, Inc. was hired by the City to prepare a dam
rehabilitation report for Portner Reservoir. This report involved flood
routing studies, reservoir water quality studies, selecting normal water
level, and typical water level fluctuations. A complete set of dam rehab
drawings and specifications were also prepared and have been approved by
the State Engineer's Office.
Park planners have advised that you may be at the point where it would be
advantageous to meet with them to discuss the City plans for the reservoir.
They have certain ideas and recommendations in the Master Plan relating to
the south shoreline, storm drainage, runoff into the reservoir, wetlands at
the west end of the reservoir, boardwalk on the south shoreline, etc.
An early meeting may be the best way to identify and coordinate respective
needs. Please contact Mr. Randy Balok, Superintendent of Planning and
Development (221-6660) to schedule a meeting.
In terms of engineering data for the reservoir, Resource Consultants Inc.
indicates a normal water level of elevation 4,914.6; 100 year flood
elevation of 4,915.2; and probably maximum flood elevation of 4,919.0.
Maximum water surface fluctuation would be 3.5 feet in a dry year. Average
water level fluctuation would be 2.5 feet in a typical year. The reservoir
would hold about 360 acre-feet of water at normal surface elevation.
We trust this information will be useful to you in your planning for
Huntington Hillls. If we may be of further assistance, or, if you should
desire additional information or clarification, please do not hesitate to
contact me.

Dear Glen:
This letter is to confirm the drainage facilities for Huntington Hills Filing 2, Phase 1 ( lots 115-132 163 and
164) are completed in accordance with the approved drawings with the following exceptions:
1. Colby Street Outlet Structure: The structure has been completed, but not accepted by the Storm
Drainage Utility. The corrections to the structure have been documented in an RCE letter to you
dated, December 9, 1993. Construction of these corrections will be conducted Spring 1994 when
the weather is more suitable. An estimate for the corrections to the structure was provided to Dave
Stringer in my December 7, 1993, letter (attached).
2. Southern Drainage Channel: The channel has been constructed in accordance to the revised plan
for the drainage channel (currently in review by the Storm Drainage Utility) except the channel has
not been reseed yet (see enclosed as -constructed drawing). The cost for this work is also
documented in my December 7, 1993, letter.
3. Brinn Court Inlet: The upper portion of the inlet was not constructed properly and the concrete
contractor has corrected the problem. Currently, we are waiting for the concrete to cure and final
inspection frorn the Engineering Department.
4. Deadends at Saturn Drive, Derry Drive and Dunn Drive: Saturn Drive deadar:s into the
temporary road constructed along the Saturn Drive alignment to edge of the project and then to the
Hahn property to the north. The drainage water from Saturn Drive flows to temporary road drainage
ditches. Dunn Drive drainage water flows to the end of the existing street and flows out onto the
open field. Drainage water from Derry Drive flows to the Phase 2 construction area. The water will
flow along Derry Street to O'Leary Street to the southern drainage channel and then to the detention
pond. The contractor will be responsible for conveying the collected water to the detention pond.
A silt fence has been constructed along the back of the lot lines along the drainage channel to
prevent silt build up in the drainage channel. The drainage from the deadend streets is very minor
and very few problems are expected from these areas.

The Colorado Division of Highways has reviewed the Fossil Creek Meadows P.U.D.,
Second Filing, with regard to the need for a traffic signal on U.S. Highway 287.
In our letter of December 7, 1977, we comranted that traffic from this development,
along with that from the other side of the highway, will eventually warrant a signal
at the Saturn Drive/U.S. 287 intersection.
We confirmed that comment in a letter on February 21, 1979, and we again ask
that honey he pldced in escrow for this signal. The estimated cost of a full -directional
t affic siyial at this location is $75,000. This signal can only be installed when
trdific volun,s at this internection increase to a level where a signal is warranted.

Huntington Mews, First Filing
Attached you will find a copy of the Subdivision Summary Form dated
March 17, 1980, conforming to the final plat of Huntington Mews, First
Filing. The land use breakdowns as indicated on this form are as follows:
106 single family lots - - - - - 23.94 acres 55%
Streets (+ ROW)- - - - - - - - - 8.98 acres 21%
Private (common) open space- - - 10.57 acres 24%
Totals - - - 43.49 acres 100%
The open space total will be less than the total on the copies of the plats
furnished to you at the time of final plat submittal. The reason for this
is when we deleted 14 lots and a portion of the open space from the original
120-lot plat, the acreage for Tract C was overlooked and not changed. The
correct figure for Tract C should be 390,122 sq. ft./8.956 acres. We have
made this change on our two mylars to be submitted to Larimer County for
approval.
Also, Everet Street north of Saturn Drive on the Huntington Mews, First
Filing, plat has changed from a temporary to a permanent cul-de-sac. This
was done because the two tracts of land that belong to Jack Hahn, landowner
to the north, now have existing buildings that he feels would conflict with
any .attempt to continue Everet Street north into his property. (See attached
drawing.)

Dear Steve:

This is to confirm our discussion regarding the coach lights at Huntington
Mews in lue of street lights.
He will require each builder'on the purchase contract to install a photo
cell nctivated coach light on each lot in Huntington Mews Subdivision. This coach
light will be located five feet on either side of the center line of each individual
lot, and a nnxinum of five feet back from the proper`�y line.
With the actLvation by photo cell there has never been a problem in other
subdivisions of not having adequate light.
These coach 'lights not only provide street lighting and an unbelieveable
aesthetic effect of low level lighting, but they also provide excellent security
for each homeowner in that their yard and driveway are constantally lighted.
