I have reviewed the information you sent to Western Gas Supply Company
(WestGas), formerly known as Western Slope Gas Company regarding the above
referenced development.
I find no immediate conflict between this proposal and WestGas' existing
facilities, however; please note that WestGas has an 8" high pressure natural
gas pipeline which runs east -west in Horsetooth Road (Larimer County Road No.
62) and turns south on Shields Street (Larimer County Road No. 17). WestGas
must be given 48 hours notice of any proposed activity in the vicinity of our
facilities. All crossings which might involve our pipeline, must be
coordinated with WestGas, well in advance of construction.

RE: Sidewalks in the Horsetooth Commons P.U.D.
To Whom It May Concern:
Having looked at a plat of the aforementioned area, it is my opinion that under
current City requirements, TRACT "B" of that certain Planned Unit Development
would not be required to install sidewalks unless the owner would apply for a
change of use and or intensify the use by rebuilding or redevelopment of TRACT
B
Please be informed that this letter does not override or amend those conditions
as stated in the covenants for the Horsetooth Commons Planned Unit Development.

Dear Bob:
This is to certify to you that on August 16, 1988, I checked the detention
pond and the drainage systems at the new Grease Monkey located on Tract
"A", Horsetooth Commons P.U.D., Fort Collins, Colorado. The pond was
built substantially in accordance with the plans prepared by our firm
and approved November 17, 1987.
A sepia showing the ",As Built" elevations is enclosed for your records.
The been meets or exceeds the planned elevation and the size and elevation
of the pond are basically the same as approved. The area inlet was
constructed basically as planned. The orifice plate was being installed
the day we surveyed the pond.
If you have any questions concerning the grading or drainage system for
this project, please call.

RE: Request for vacation of pre-existing rights -of -way
within Horsetooth Commons P.U.D.
Dear Mike:
I am requesting that certain existing public rights -of -way within the recently
approved Horsetooth Commons P.U.D. be vacated. These rights -of -way are no
longer necessary and are in conflict with the recently approved plat.
They are as follows:
Jane Street (see attached deed of dedication)
Legal Description:
A tract of land in Sec. 27, Twp. 7 N. Range 69, W. 6th P.M.: Considering
the East line of the SE 1/4 as bearing North and with all bearings herein
relative thereto, contained within the boundary lines described as:
commencing in the Southeast corner of Section 27, Township 7 North, Range
69 West of the 6th P.M., and run thence N. 563.25 feet; thence N. 89°44'16"
W. 30 feet to the true point of beginning; thence N. 89°44'16" W. 790.01
feet; thence S. 50 feet; thence S. 89°44'16" E. 790.01 feet; thence N. 50
feet to the true point of beginning.
2. Two pieces of street right-of-way at the intersections of Shields and
Richmond Drive, and Horsetooth and Richmond which lie outside the platted
right-of-way of these streets. These areas consist of approximately 14.45
sq. ft.

Regarding: Horsetooth C rmons P.U.D.
Dear Sir:
On March 24, 1988 you addressed a letter to our firm regarding
items not completed at Horsetooth Commons. Of the four items
listed, we feel only two are our responsibility. These are:
1. To adjust the four valve boxes on Richmond Drive.
2. To regrout manhole adjustment rings on Manhole S-5.
We feel the cracked asphalt pavement at Station 3150 on Richmond
Drive is due to trench settlement around the valve boxes. The
utility work was not done by our firm.
We also feel the damaged curb and gutter was not caused by our
forces. Other contractors were working in the area also.
We hope to complete the two items I previously mentioned in the
near future.

Dear Mrs. Bensen,
We have completed our as -built survey for the above referenced site in
order to complete certification requirements of the City of Fort Collins
Storm Water Utility. The attached plan indicates the existing contours
that we picked up in the field. There is a low area which would
potentially fill with runoff prior to overflowing at the current apparent
overflow elevation of 19.71. The ultimate overflow design elevation is
80.20 which would also be the detention pond high water elevation. The
detention pond outlet shown on the approved design drawings was not
constructed. The outlet would consist of an inlet at the pond low point
and an B" pipe to convey water to the existing 36" storm sewer located
along Shields Street. The pontential pending of water without a release is
called stormwater retention.
I contacted Susan Hayes of the City of Fort Collins Storm Water Utility
regarding the current situation. Susan indicated that unless there was a
development agreement specifying project phases and indicating that the
outlet did not need to be installed with Phase 1, then a stormwater outlet
must be installed according to the design plans approved and on record
with the City of Fort Collins. Retention, the holding of runoff without an
outlet, is not allowed in the City of Fort Collins according to Susan
Hayes. We have not been able to locate a development agreement. We had
asked Kent Goodman to get us a copy of the development agreement if there
was one. Kerrie Ashbeck at the City Planning Department indicated that
there was not a development agreement for this particular project.
Susan Hayes indicated that if an outlet was provided, we could provide an
interim certification for the Phase which has been completed. I feel that
in order to resolve this issue, you may want to call Susan Hayes at the
City of Fort Collins Storm Water Utility and discuss her requirements with
her directly. We may all want to sit down and discuss a course of action
to resolve this. I cannot certify what was constructed at this time since
construction has not met the requirements of the approved storm drainage
design. The City Storm Water Utility would not accept it.
Please call me at 226-5334, so we can further discuss an appropriate plan
of action.
