We received the original drawings on this work back from your
office on October 15, 1974 with the tracings not approved.
Also, there was a note from you concerning the utility boxes
sitting above grade at the intersection of Farmtree Road and
Sheely Drive.
Your note states that the Light and Power Department has looked
at these utilities and that they feel they can be moved but at
the developer's expense (estimated at $197) --- you further re-
quested our investigating the matter and submitting a design
for the intersection to provide adequate sight distance.
The history of the project, as I remember it, is that the City
has requested that Hill Pond extend Farmtree Road paving from
the hill Pond Subdivision through Sheely Subdivision to the
intersection of Sheely Drive all at Hill Pond's expense. We
are assuming that the City will be installing a stop sign for
Farmtree Road traffic at the "T" intersection with Sheely Drive.
Don McClelland and I drove to the site and can see no major
sight distance problem caused by the utility boxes. Further,
would it not be reasonable to assume that if the City wants
this road extended and the utility boxes are owned by the City
and if the City is concerned about the sight distance that it
would be the City and not the developer who would move their
boxes to achieve the results they desire?
Also, once the boxes are moved what happens to the trees and
bushes around that intersection that could block vision over
the years?

I have reviewed Mr. Engemoen's letter of July 3, 1979,
concerning the agreements reached between the City of Fort
Collins and Victoria Limited at a June 27, 1979 meeting in
your offices. The meeting was conducted to discuss and
clarify various requirements concerning drainage improve-
ments in the Hill Pond Development area as a result of the
F.I.A. study and the City of Fort Collins Interim Flood
Ilydrol.ogy Report for Spring Creek. I believe the following
points were agreed to at our meeting:
1. The minimum requirement will be that
the Developer provide for the passage of flood
waters through its property pursuant to the
current F.I.A. :.map and study as required by the
CiLy's flood plain ordinance. If the F.I.A.
map and study floodway is channelized and improved
to confine the floodway, such improvements shall
be designed and installed at the expense of the
Developer subject to review and approval by the
City.

width to allow for the construction of an improved
channel capable of passing the flood flows
developed in the City of Fort Collins Interim
Flood Hydrology Report for Spring Creek, which
study includes drainage basin importation and
additional drainage flows resulting from
development in the upper portion of the Spring
Creek Basin. The corridor width shall be determined
by the guidelines proposed in the Interim Flood
Hydrology Report for Spring Creek.
3. The City will continue its present
study of the additional flows in the Spring
CreeK basin as a result of drainage basin
importation project and upstream drainage basin
development. In the event this study determines
that such drainage basin importation and up-
stream interbasin development will result in
flood flows in excess of the present F.I.A. map
and study, channel improvements sufficient to
handle such excess flood flows, developed
pursuant to the guidelines of the Interim Flood
Hydrology Report for Spring Creek, must be
constructed with the cost for such improvements
to be shared between the Developer, the City of
Fort Collins, and upstream interbasin developers
(at a minimum and potentially all developers) to
the extent determined by City Council.
The agreement relative to this last item was designed
to allocate the costs of channel improvements associated
wi.th e.cccss flood flows passing across Hill Pond property
as a result of upstream interbasin development and drain-
age basin importation. It was discussed and understood at
this meeting that the complete data and facts were not yet
available to conclude that the additional flood flows
indicated in the Interim Flood Hydrology Report for Spring_
Creek in excess of the flood flows determined by the
current F.I.A. map and study would occur.
4. It was further agreed that the City of
Fort Collins, in recognition of the problem of ex-
cess drainage caused by upstream inter -basin develop-

contain language concerning the excess drainage
problem and an agreement that subdivision devel-
opers would agree to share in the expense of down
stream channelization on the basis of cost or by
a development fee or charge. This policy was to
be implemented immediately. The final method for
distribution and assessment of these costs and ex-
penses would be developed and as approved by the
Fort Collins City Council.
It was further discussed and agreed that planning and
development could cormience within the Hill Pond area
reserving as a maximum corridor for channel improvement
the improvement channel corridor as determined by the
Interim Flcod Iiydrology Report for Spring Creek. The
minimum corridor for channel improvement would be that as
required by the current F.I.A. map and study. As a fur-
ther part of our discussions and agreements, it is intended
and was discussed that any channel improvements would not
bo commenced immediately or required by the City prior to
planning and development in the Hill Pond area.
If this summarization of our agreements and discus-
sion is not accurate, please respond in writing.

conversation yesterday. I must apologize for the poor quality of
the Spring Creek bridge drawing. unfortunately, we do not have a
copy of this drawing on a reproducible medium, so this sheet was
printed from a paper copy. Hopefully you can distinguish the
figures and notes well enough.
Also, I am enclosing the revised flows from the Canal Importation
Study update. We expect these revisions will be adopted by the
City Council at their regular meeting this evening.
Finally, I have not yet been able to find another benchmark in

The Hill Pond 2nd Filing P.U.D. is conceived to fulfill several objectives.
The main objective is to establish an exclusive single family development
within the flavor of the overall Hill Pond Master Plan whose orientation lends
itself well to passive solar, custom home designs. As well as seeing the need
for this sort of development in the overall Master Plan, using this single
family as a buffer to the existing single family to the north seemed appropriate.
Existing utilities governed the street layout.
Active open space will occur in the flood plain area which is currently being
designed as a "people place" with landscaping and bicycle paths for active
recreational enjoyment. This plan will be submitted seperately soon as a
comprehensive landscape plan of the entire floodway area. Pedestrian access to
this space occurs between lots 33 and 34 through a 30' wide green belt area
with sidewalk.

completed per our discussions.
Below please find responses to your comments dated June 26, 1980- The res-
ponses are consistent with these discussed during the meeting with yourself
and the engineers. If you do have any further questions, please do not
hesitate to contact our office.
X 1. Spring Creek will be improved to City Standards. Final engineering
drawings are now being completed relative to the re-channelization
of Spring Creek. These drawings will be submitted at final.
?(2. Existing flood plan is as shown on the submittal.
iC 3. The g-'ade for Farmtree Road has been discussed with the engineering
staff. Final design drawings will reflect an appropriate grade which
is acceptable to the staff.
x 4. Farmtree Road as well as River Meadows Drive have been reduced to a 28'

Farmtree Road and Rivermeadows will be designed at 900. The applicant

X 9. Three legs of the northern outer boundary do not agree with the existing
plats to the North. All bearings shown on the submittals are based on the
outer boundary as presented in the original plat of this property. An
engineering review shows that the line bearing S OOo 17' 35" W, 116.67
is needed to close the plat and connect the adjacent plats. This is
different than shown on the Spring Valley Plat as it never connected with
the hrthur Sheely Subdivision. This line descrepancy will be corrected
when the ROW discussed in Item (6) is resolved.
Twoother interior angles on the north boundary line are off by

00 00' 01" each. Again the bearings shown are consistent with those
on the original plat. These descriptions will be resolved in final
submittals.
Relative to the current boundary dispute to the North, Mr. Van Lear has
contacted property owners to the north and has informed them of the
situation. To date, no comments have been received. It is the intent
of the developer at this time to develop to the full extent of his
boundaries. This is consistent with legal review.

Comments:
1. If possib-e, the crossover structure" for the bicycle trail adja-
cent to South Shields Street should allow for a minimum 50 foot
radius. Perhaps a bridge slightly downstream that would span the
trickle channel and float to one side during a major runoff event
would be satisfactory.
2. Subsequent plans need to ensure the floor of the "7'-0" way under
Shields Street" would be free of water during everyday operation.
3. The statement concerning cost sharing of the bicycle trail should
be clarified in the following respects:
a. The City is to share in construction costs of only the
main trail. Construction of side paths is to be the
developer's responsibility.
b. The City share will be funded by the Open Space and
Trails 7 year capital fund, not Fort Collins City
Council.
c. We need to know if the 3 homeowner associations plan to
maintain the main bicycle trail.
4. Use of C.S.U.'s existing track on the east end of the project is
subject to approval by C.S.U. A written statement of approval
from C.S.U. should be required.
5. The alignment is considerably different from the proposed tempor-
ary trail that is currently under contract for construction. Will
a new right-of-way need to be established for this permanent trail?

RE: Arthur Ditch At Spring Creek
Dear Mr. Stover:
Transmitted herewith are three sets of construction drawings for
improvements to the Spring Creek flood plain between Shields Street and the
Arthur Ditch. These improvements will be constructed by Mr. Stevan Van Lear
of Victoria Limited.
As indicated on our drawings, a reinforced concrete headwall with three
48" diameter sluice gates is proposed to be installed in place of approximately
thirty lineal feet of existing headwall and weir section. These sluice gates are
designed to convey the 2-year design storm with a peak flow of 480 cubic feet
per second. All other flows from larger storms will spill over the headwall
section, as they do presently.
A modification or addition to this proposed headwall section will be
necessary to retain water upstream from the headwall at a designated elevation,
as proposed in the landscape plans by Gefroh and Associates (these plans will be
forwarded to you by Mr. Tony Hughes).
This addition may take the form of a drop inlet intake or improved spillway
over or adjacent to the pipe sections. We would appreciate your review and
comments on these proposed alterations at the Arthur Ditch.

Date: October 27, 1980
We met on this date to discuss Farmtree Road at Hill Pond Single Family. The
topic of discussion was the vertical alignment of Farmtree Road at Hill Pond
Single Family. When Hill Pond Single Family went through as a preliminary,
there was some discussion and feedback from the City with regards to the slope
of proposed Farmtree Road at Hill Pond. At that time, we told them when it
came final that we would meet with them again. The City requires a maximum of
two percent (2%) for two hundred (200) feet out of an intersection. However,
when this standard is applied to Farmtree Road, the side slopes are approximately
forty to fifty percent (40-50%). In addition, the amount of fill in this area
ranges from three to seven (3-7) feet. The excessive side slope is a result of
the existing homes built on both the north and south sides of this right-of-way.
Therefore, the following designs and recommendations were agreed upon by the above
people at the meeting.
1. We would maintain a two percent (2%) slope towards the west from
the center line of Sheeley Drive for a distance of seventy five
(75) feet.
2. We have agreed that we would maintain two percent (2%) grade for
fifty (50) feet on either side of the P. C.'s for the ninety (90)
degree intersection of Farmtree Road and River Meadows Drive.
3. We would maintain a four to four and a half percent (4-42%) grade
between 'the ninety (90) degree intersection and the center line of
Sheeley Drive with the exception of items 1 and 2.
4. We will :submit cross sections of Farmtree Road to better exemplify
our design.
It was agreed upon by the above people that this was a buildable design which
could be lived with by the City. In addition, Josh Richardson brought up the
idea of possibly eliminating sidewalk on one (1) side to leave some the vege-
tation and trees intact. At this time, he did not know which side it would be
and would be getting back with me. Rick Ensdorf then mentioned that if the
sidewalk were eliminated on one side, the other side should be enlarged to
better provide a sidewalk type access through Hill Pond Single Family area
towards the west to Shields Street.

We are requesting a variance from the standard 54 foot right-of-way,
36 foot flow -line to flow -line width for River Meadows Drive in Hill Pond
on Spring Creek 2nd Filing. The owner has requested the street be narrowed
as much as possible to increase the lot sizes in the project site. The
City of Fort Collins planning department has given a favorable comment
on the narrowing of the street which they feel will add to the planned
unit development by adding square footage to the proposed single family
lots. We generally feel that because this is a planned single family
area, the size of the lots will be a factor in providing a pleasing
development.
By granting this variance and reducing the street to a 40 foot right-of-way
and a 28 foot flow -line to flow -line distance, we will in turn provide the
City of Fort Collins an improved single family planned unit development.

RE: "Hillpond" Arthur Ditch at Spring
Creek
Dear Bob:
In response to our conversation on Thursday, December 11, 1980,
concerning the alternate design of the spillway structure on Spring Creek at
Arthur Ditch, we hereby request the design storm flow of approximately 480
C.F.S. be reduced and/or eliminated, and the three 48 inch diameter sluice
gates, previously shown on our detail sheet for the "Hillpond" project, be
eliminated.
In lieu of the above, and if acceptable to the Arthur Ditch Company and
Mr. Steve Van Lear, we propose to:
1. design a reinforcement to the existing spillway structure with rock
and concrete, which will provide an inclined spillway to convey the
trickle flow over the present structure;
2. locate a 24 inch C.S.P. with sluice gate at a low point in the proposed
pond west from the spillway structure; and
3. design two weir structures at each end of the Arthur Ditch as it
enters the proposed flood plan of Spring Creek. These structures are
to be designed to allow water to enter Arthur Ditch for irrigation
purposes, while eliminating flood waters to enter when the
gates/boards are closed or in place. The north side structure will
have a gate and pipe to discharge storm water when the ditch is not
being used for irrigation.
This design concept will be more efficient, as it will provide:
1. a tie in point for the shoulders of the proposed channel and thus,
better protect the property west of the Arthur Ditch;
2. greatly reduce the vertical and horizontal fluctuations in the
proposed pond; and

3. upgrade the irrigation structures on the Arthur Ditch, which at
present are on the verge of collapse.
On the other hand, a major flood flow may damage the existing spillway
structure. The extent of damage is unknown.

We have rece v d your request for reducing the width of River
Meadows Driv n Hillpond on Spring Creek 2nd filing from a
54' row with 6' flowline to flowline to 40' row and 28'
flowline to flowline.
It is not the policy of the Public Works Department to reduce
the width of a street so that a developer may increase the
lot sizes. As you are aware the size of this street has
previously been verbally approved by the Public Works Depart-
ment though long negotiations. We will confirm our past
verbal approval but let us remind you that future requests
must address the design merits of a project and our correspond-
inq standards and/or guidelines.

We are requesting this variance for the following reasons or circumstances:
- Farmtree Road; existing property owners to the north and south
have mature landscaping (trees, bushes, lawns) which would be
favorable to leave,
- Farmtree Road; existing slope vs: City of Fort Collins design
standards creates an excessive amount of fill in the area, by
narrowing the pavement width we are able to minimize the amount
of disruption to existing landscaping in matching existing grades,
- River Meadows Drive; by providing an easement for access along the
northern lot lines of lots 1-8, Block I, the amount of buildable
square footage for those lots is reduced. By reducing the required
right-of-way, the lot sizes do not witness as large of reduction
in square footage.
- River Meadows Drive; due to the 100 year storm floodplain (Spring
Creek Improvements) along the south, the lot sizes are affected,
by reducing the required right-of-way the lot square footages are
allowed to increase without pushing these lots into the floodplain.
- River Meadows Drive; existing utilities in Hill Pond 2nd Filing,
(6" & 30" water, 6",8",18", & 21" sanitary sewers) Arthur Ditch
and Spring Creek floodplain, dictate the lot configurations and
therefore., their respective sizes, by reducing the right-of-way
the lot sizes are able to recover some of the square footage other-
wise lost.,

This letter is in response to your inquiries on Monday; October 30, regarding the
recluiremrnts for public improvements for the second filing of Hill Pond subdivision.
As you probably know, the plat for Hill Pond Second Filing was approved and recorded
in May of 1974; however, the utility plans for this subdivision never obtained the
final approval of the City. Prior to our approval of the utility plans at this time,
certain revisions will be required to bring the subdivision into conformance with
current engineering standards and specifications.
The channel for Spring Creek will have to be improved in conjunction with the
develoixnent of this filing. The Interim Flood Hydrology Report for Spring Creek,
dated October 1977, should be used as the criteria on which the design of these
channel improvements should be based. In addition, this development must provide
a detention system which will detain the difference between the 100-year developed
runoff and the 2--year historic runoff from the site, with a release rate not in
excess of the 2-year historical rate. The engineering data and calculations re-
quired to adequately evaluate the design for the channel improvements, detention
facilities, and other storm drainage lines should be presented to the City Engineer
for his review and approval in conjunction with the submittal of the utility plan
revisions.
Another question which must be addressed on this development concerns the size of
the bridge on Spring Creek, and whether or not the City will participate in the
cost of that construction.
There is a problem with using Sheely Subdivision as access for construction traffic,
and this may require the installation of the improvements on Fasmtree Road between
Shields Street aril the Hill Pond Second Filing in conjunction with this development.
Finally, any revisions which might be required to bring the plans into compliance
with the current standards and procedural requirements of the Planning Division,
Water and Sewer Department, or other municipal departments should be addressed.

we are in full agreement with the variance request for Farmtree Road
for the reasons given in your request.
The variance for River Meadows Drive does pose sane problems. The City
Engineering Staff supports the idea of a developer achieving the best
use of his land and thus reducing the price per unit to the haneowner
as long as it is not detrimental to the functions of the area.
.To evaluate this variance we went to our Administrative Policies for
28 foot streets. River Pleadows Drive does maintain an ADT below the
750 vehicles/clay and does not provide through vehical travel. River
Meadows Drive also does not provide for a connection between two
arterial or collector streets. River Meadows Drive is a loop street
but does connect two different city streets. The functions on the
two city streets on which River Meadows Drive enter are fairly minor.
This reasoning along with past statement made by the staff and giving
recognition to your reasons for this variance, we hereby grant the
variance. in the future request of this nature must address the
merits of the project in respect to the guidelines and standards
applicable.

RE: Revised sewer services at Hill Pond single-family
Date: June 16, 1981
on this day I was contacted by Larry Stanton to inquire with the
City (Jim Hibbard) as to whether we could 'service the proposed
single-family units from the existing eighteen (18") inch sanitary
sewer. He inquired as to why in the past we did not recommend
using this line. I informed him that it was the advice of the
City not use it because it was to capacity and the condition of
the line was questionable. Therefore, on our plans we recommend
the use of the new Spring Creek interceptor sewer (21") which
was deeper and had much larger capacity. A problem arose with
the contractor (Jerry Palmer) Palmer Construction, in that the
high ground water was making the cost of each sewer service
extremely high. It was requested then to contact the city
to inquire as to the tapping of the existing eighteen (18") inch.
In talking with Mr. Hibbard he informed me that they had no problem
under these circumstances to allow tapping the eighteen (1811) inch
instead of the twenty-one (2111) inch as originally designed.
I reminded Mr. Palmer of the thirty (30) inch water line and he
in turn recommended that they go over the top of the existing
thirty (30") inch water and encase then as per City of Fort
Collins Standards for less than eighteen (18") inches of clearance.
Therefore, in summary, due to the high ground water condition
at Hill Pond single-family, we will be allowing the contractor
as per acceptance by the City (Mr. Hibbard, City of Fort Collins
Sewer and Water Department) to tap into the existing eighteen.(18")
inch sanitary sewer as is feasible for each service line. The
units to the south should have no problem as the interceptor
line (21") is much lower and therefore, the sewer services will
be able to maintain a minimum of three (3') foot of cover from
the main to the lots themselves. In addition, the proposed sip;
(6") inch water line will go over the top of each of the services,
thus proposing no problem to the south. The units to the north will
have no problem with the proposed six (6") inch water line as it
will lie to the south of the services.

We have had a long history of providing land For the Agricultural Research
Service. They recently have been dispossessed from land southeast of
Fort Collins which they were renting for sugar beet disease research.

campus which has adequate land but most in the next several years be
subjected to development activities which will limit its usefulness.
We are facing a severe problem in the maintenance of a farming operation
on the south. cam,ous. The irrigation ditch to the southwest (old dais;
area) part of the property (CSURF) seemingly cannot provide adequate -
water to maintain crop growth. We are now the last and only users on the
ditch. The headquarters of the farm operations will he roved from that
location in the near future. The remaining piece of land which can be
irrigated ise:.55-acre piece (in two fields) immediately west of the
hospital and dairy. To cultivate this area will require moving !.arming
equipment across the city. We would like to concentrate our pro3uction
efforts on the agri7ultura_ campus and the north agricultural canous.
We propose that the 55-acre piece be made available, beginning with the
1982 cropping season, to ARs for their research activities. The land is
physically close to their headquarters and land they are currently using.
Since the Uni^ersity will ultimately develop the land, the lease will, of
necessity, have to he on a year-to-year basis .ar.d should includa details
as to costs o water, disposition of crops etc. By maintaining the 1aq:l

Physical Plant cannot approve these documents. Appropriate legal easements
are required.
There are several steps required to obtain an easement. If you wish
to further explore this option please get your proposal to us as soon as
possible so the required staff work and agenda schedules can be arranged.
At the very ]east, a legal easement requires a minimum of three months to

Dear Mr. Smith:
Pursuant to the visit that you had to Dr. Young's property
on Sheely r)rive and the examination of the location of the
Tombaugh and other drains which feed his property and,
subsequently, exit to the south and east of his property, I am
requesting that your office formally inform Mr. Van Lear, or any
other appropriate person of the Hill Pond Development, of the
existence and location of the drains crossing the property due
south of Young's property. During our conversation with
Dr. Young he indicated that he had a discussion with Mr. Van Lear
about the drains and Mr. Van Lear stated he knew of their
existence. I seriously doubt if he knew of their location, but
perhaps he knew of the relationship of the gates located
approximately 20 feet north of the discharge point into Sprinq
Creek and the total drainage system. I belive it would be far
more appropriate for the City to inform the developer, since the
construction of the subdivision has to comply with municipal
requirements and conditions.
Upon my return to Denver, I contacted our engineer with
Leonard Rice and Associates and requested that he run several
tests at the time that you open up the drain on the west side of
Shields. When you have your date set, please let me or Dr. Young
know. It is a pleasure working with you on this matter and
hopefully your investigation of the drain will provide sufficient
capacity to carry off the seep water from the little duck pond
located across Shields from the watts' property.

I have developed the attached proposed schedule which I have

sluice gate level. I feel that the schedule might be a little
tight as shown, but the project should have no problem of being
completed by the April 15, 1982 deadline.

1904 Sheely Drive April 25, 1979
Approximately 40 neighbors gathered to hear about plans for this area.
Stevan Van Tear, Broker, and Dan Wilson, representing Victoria, Ltd explained
their developmen- concepts for Hill Pond. They emphasized their environmental
interest, their concern for quality development of the area, and stated that they
haven't any specific proposals for development at this time. There is quite a lot
of work to be done for the floodplain designation adjoining Spring Creek, and both
Steve and Dan ex'Dressed support for the bike paths planned by the city and
explained that their support is financial as well as intellectual.
At this time, only two streets are platted between Sheely Drive and South
Shields; Farm Tree Road, which goes East from Shields and connects to Sheely
just North of the Ware's house at 1801 Sheely, and River Meadows Drive which
parallels Sheely starting behind the Ware's house and dead ends behind the Vail's
house at 1925 Sheely Drive.
Max Hoffman explained that he has purchased the 19 lots on the North side
of River Meadows Drive, with the intention of building his own personal residence
and developing the others as high quality patio homes. This follows the plat
that was approved as part of the Hill Pond second filing in 1973. However, there
are some problems regarding the utility approval and changes in floodplain
designation (some of which Max learned about this evening) so he is not intending
to break ground right away!! Victoria., Ltd. owns the remaining 26 lots in this plat.
.Toe Frank and Bob Smith, representing the City of Ft. Collins explained that
the sewer which is presently being laid across the fields is a sanitary sewer which
is a trunk line needed generally for the Southwest part of Ft. Collins. It is
part of a long-range plan and not specifically related to any current development
plans.
Joe also described the plans for Rolland Moore Park on Shields St. It will
certainly be an addition to the area, and will be located South of Foothills Apts,
behind the big yellow house,with 12 lighted tennis courts, baseball diamonds, etc.

Dear Steve:
The Parks and Recreation staff and Storm Drainage staff have again reviewed
the plans that relate to the bike/jogging trail through Hill Pond. We
feel that the construction of the floodway should accommodate the trail as
shown on the landscape and site plans. The fact that the shelf or bench
that would have accommodated the paved trail was not built during your
floodplain construction is not the fault of the City. The site plan was
referenced in the construction drawings.
We would like you to have the bench established as the plans indicate. If
you think this is not feasible, there are alternate solutions.
On the east half of your floodway project, the trail can be built on top of
the south berm leading to and from the bridge that is shown on the plans.
Another solution would be to use approximately half of the width of the
south berm, excavate 16" or 18" deep and build up the downhill edge.
In any event we will have to use the bridge in the center of the project
to cross Spring Creek, as shown on the plans_
We haven't discussed the bridle trail that is mentioned in our easement
agreement. There is no accommodation for that either in the way the flood -
plain is built.
I know that we would both like to resolve this issue soon so that we can
get on with our respective projects. Please let me know how you want to
handle these situations.

The purpose of this letter is to inform you of the intentions of Victoria
Ltd. for Hillpond Single -Family.
As discussed in the meeting between myself, John Payne, Mark Ingemoen and
yourself, the reason for the less than desirable condition of the sub -base
on the piece of street knovm as River Meadows Drive is due to the inability
of the storm sewer to pass water. This is the result of the rise of the
water surface elevation in the dam adjacent to the property. It was a
design error by the consultants who prepared the plans for the dam in not
considering the effects of raising the water level.
This continuous 'level of water does not allow for the sub -base material to
dry properly. The means by which we will eliminate this problem is
currently under design by our office. We are looking at continuing a storm
sewer to the east beneath Arthur Ditch emptying into Spring Creek. This
will allow the water surface to be lowered and therefore dry the sub -base
material.
However, due to the inability to construct such a storm sewer due to the

Dear Steve:
The staff has reviewed the application for preliminary subdivision and P.U.D.
plat approval and would offer the following comments:
1. Spring Creek must be improved to City standards prior to building permit
issuance. All foundations in the flood plain must meet the City's Flood
Hazard Area requirements (1'0" freeboard over 100 year flood level).
2. Existing flood plain must be shown on the plat.
3. The staff is concerned with the steep grade of Farmtree Road as it
approaches Sheeley Drive. The maximum permitted grade is K. Please revise
drawings to meet this standard.
4. The staff would recommend that Farmtree Road pavement width be reduce to
28 feet in order to save as much of the existing vegetation as possible. If
there is any vegetation to be removed, the work will be done by the applicant.
5. The intersection of Farmtree Road and Rivermeadows Drive should be designed
at 900 or less. The applicant will be responsible for signing of these
intersections.
6. the applicant should provide evidence as to the ownership of the 50' of
R.O.W. of Farmtree Road.

S. Legal description on plat should state "True Point of Beginning". Please
correct.
5. The proposed plat does not agree with interior angles of existing sub-

12. A portion of the rear lot line dimension for lot 29 is not shown. Please

13. The portion of land between lots 33 and 34, and Tract A should be dedicated
as public access easements and labeled on both the plat and site plan as such.
14. Tract A should be shown on the site plan as well as subdivision as open
space area to meet the 30% P.U.D. requirement. The City's bike path and
landscaping thereof should also be shown.
15. The staff questions the buildability of lots 23, 21, and 4. The applicant
should provide evidence to justify their suitability.
16. The site plan should indicate location of fences if any; maximum height
of structures; statement of planning objectives; development schedule; statement
of future ov.nership of open space areas; number of bedrooms per unit; proposed
coverage of structures; net residential density; 100 year floodplain; and
existing significant vegetation.
17. Either building elevations must be submitted at this time or applicant
must agree to Planning staff review of building elevations prior to building
permit issuance.
Before the staff can proceed with processing the application for development
approval, a revised P.U.D. site plan, reflecting the above comments, will be
required. For those items that cannot be shown on the site plan, a letter
from the applicant resolving these issues should be submitted. The above
materials should be delivered to this office no later than July 9, 1980. I
would urge you to contact me before that deadline date to discuss these
ccments or review your changes before you submit a formal revised plan.
Also, on July 18 a rendered set of the site plan and architectural drawings
and an 8" x 11" PMT positive of the plans must be submitted. If you have
any questions, please feel free to call.

The bike path being planned by the City will eventually connect with
and be similar to the present one that goes from Taft Hill to Overland Trail
through the Brown Farm area. It will also connect with the bike path going to
the East part of the city.
There are no plans at this time to extend South Whitcomb Street, but it
could be a possibility for the future. It could connect with one of the Hill
Pond streets. We will keep abreast of any plans.
We had a great deal of discussion and spirited visiting, and reminded
ourselves we have a neat neighborhood full of individualists.
Ella Shawver described the early development of the area in 1954. She
was the oldest (only in length of time in the Sheely area, not in years or
spirit) resident- present for the meeting.
The newest residents are Sally and Arlen Goodwine (at 1905 Sheely Dr.)
and Mary Ontivares and Bill Burt (at 1901 Sheely Dr.). We were happy to
welcome them to the area.
Thanks to all of you who came to the meeting, and who contributed your
knowledge of the area and ideas. We are glad the big white Birky farm house
will he retained and enjoyed.
There are two nice houses for sale in the area at 1913 Sheely Drive
and 708 Birky Place. Both these families are anxious to move to their new
homes, so if you know someone who has wanted to move to this area, be sure
to contact me, and I'll do my best to keep good neighbors coming in as well
as leaving us.

This letter will confirm the results of the discussion in our offices
yesterday regarding drainage improvements required in conjunction with the
development of Hill Pond. I believe we agreed to the following points:
(1) The minimum requirement will be that the Developer provide for the
passage of the flood designated by the F.L.A. study through his
property in accordance with the City's floodplain ordinance. If
the present channel is improved to confine this flood, such improvements
shall be designed and installed at the sole expense of the Developer,
subject to review and approval by the City. However, if additional.
information developed prior to the construction of any channel im-
provements indicates that flood flows in excess of the F.I.A. flood
will pass through the subject property, the City may require the
Developer to provide for these revised flood flows at his expense.
(2) The Developer will provide a corridor within his development of suf-
ficient width to allow for the construction of an improved channel
capable of passing the flood flows developed in the Interi.am Flood
hydrology Report for. Spring Creek. This corridor shall include the
proposed channel recommended in the canal importation study.
(3) The City will continue its present study of the canal importation
project and the final analysis of Spring Creek in a timely manner; and
(4) The Developer will agree to participate in the cost_ of improvements
required in conjunction with the results of those studies to the
extent determined by the City Council.
If I have left anything out, or if you are in agreement with the points of
our discussion as I have summarized them above, I would appreciate a written
response to that effect at your earliest convenience. Please feel free to
contact our office if you have any additional questions regarding your
development.

RE: Spring Creek Drainage
In 1971, Black and Veatch prepared a drainage study for the
City which has since become the foundation for subsequent
drainage work. Black and Veatch proposed in that report
three detention facilities on Spring Creek, one of which
was located at Moore Park. Also included in the report
was the assumption that the irrigation canals could be
utilized in the transportation of storm runoff to Spring
Creek. Preliminary investigations showed that it was cost
effective to transport storm runoff through the canal
from the west side of Fort Collins rather than through
the developed older section of the City.
In 1976, to follow up on the recommendations from the
Black and Veatch Study, the City directed Land and Water
Consultant, Inc. to perform a detailed design of the deten-
tion facility at Rolland Moore Memorial Park. The report
concluded that. such a detention facility was not cost
effective based on the benefits. As in the Black and
Veatch Report, it was assumed that canal importation of
storm runoff t:o Spring Creek was feasible. Since the Moore
Park Study demonstrated that the detention pond at that
site was not economically feasible, it appeared advisable
for the City to consider an alternative solution.
In 1977, the City hired M.W. Bittinger and Associates to
review all previous studies and make a recommendation re-
garding what :improvements will be required on Spring Creek
based on two assumptions. As in the past, it was assumed
that importation of storm water into Spring Creek was
feasible. From a curcory review of the canals, it was
estimated that a 25 year storm could be imported into
Spring Creek. It was also assumed that it would be more

favorable to project flows for future development based on
the idea that in the future detention would not be required
for new developments. However, this assumption was not
consistent with the idea that if improvements to the Creek
were not made and an individual received damages because
of development upstream the City would have some liability.
As a result, the City has continued to require detention
in the Spring Creek Basin on an interim basis.
After the completion of the Interim Report in 1978, the City
selected Resource Consultants, Inc. to do a detailed analysis
of the importation of storm water through the irrigation
canals to Spring Creek. It was necessary to review this
proposal in detail because of the substantial input it had
on the overall master plan for the Spring Creek Basin.
The preliminary draft of this report is presently being
reviewed by the ditch companies involved and the Storm
Drainage Board. The report shows that it would be
economically justificable through detention and sorting
of flows to transport storm runoff to Spring Creek through
the improved canal system. Also, the report shows that
the estimated flows from the canal system would be approx-
imately 1700 cfs, a reduction from the 2200 cfs in the
Interim Report.. A more detailed analysis of the hydrograph
of the peak flows is in progress, which may result in an
even greater reduction.
Once the Canal Importation Study is complete, the next
phase will be a final plan for Spring Creek based on the
results of the Canal Importation Study. This spring,
the Colorado Water Conservation Board was approached
informally as to the possibility of sharing the funding
of such a study. At this time, the CWCB has indicated
they are virtually certain that funding would be available,
but not until after the start of the fiscal year in July.
To date, the City has not officially heard if the funding
was approved. Once funding is approved, a comprehensive
scope of work would be drafted and mailed to qualified
consultants, taking approximately five months. Then the
proposals would be reviewed, followed by a formal intor-
view process, and contract negotiations are expected to
take approximately four months. Because of the complexity
of the Spring Creek Basin and the public hearing prOCGoo
involved, the length of the actual project would be
approximately eight or nine months, making the expect�
completion time in approximately one and one-half ;g_
after the project has received funding. .'.
There are two possibilities for obtaining inform
Spring Creek runoff sooner:
1. Use all City funds rather than one-half

would require an additional $25,000 in City funds
and would probably reduce the time by about three
months.
2. Hire an engineer to prepare an interim -interim plan.
This would cost about $3,000 and take about six to
eight weeks, and result in a rough analysis of the
effects of importation and detention in the Spring
Creel: Basin. We anticipate that there would be
some reduction in the peak runoff; however, it
would still be necessary to complete the Spring
Creel; design in cooperation with the Colorado
Water Conservation Board.
