contain language concerning the excess drainage
problem and an agreement that subdivision devel-
opers would agree to share in the expense of down
stream channelization on the basis of cost or by
a development fee or charge. This policy was to
be implemented immediately. The final method for
distribution and assessment of these costs and ex-
penses would be developed and as approved by the
Fort Collins City Council.
It was further discussed and agreed that planning and
development could commence within the Hill Pond area
reserving as a maximum corridor for channel improvement
the improvement channel corridor as determined by the
Interim Flood Hydrology Report for Spring Creek. The
minimum corridor for channel improvement would be that as
required by the current F.I.A. map and study. As a fur-
ther part of our discussions and agreements, it is intended
and was discussed that any channel improvements would not
be commenced immediately or required by the City prior to
planning and development in the Hill Pond area.
If this summarization of our agreements and discus-
sion is not accurate, please respond in writing.

Re: Spring Creek Flood Improvements
Gentlemen:
Pursuant to your discussions at the last Storm
Drainage Board meeting of August 17, 1979, I am enclosing
a rough draft of a proposed agreement between Victoria
Limited, a Colorado limited partnership, as owner -developer
of property situated in the Spring Creek Basin.
On behalf of Victoria Limited, it is our intention by
this proposed agreement to provide a mechanism by which
Victoria Limited as owner -developer can commence development
of its property in the Spring Creek Basin without being
initially required to install and complete flood plain
improvements pursuant to the requirements of the Interim
Flood Hydrology Report for Spring Creek. It is further
intended by this agreement that Victoria Limited acknowl-
edges its responsibility for the cost of installation of
flood plain improvements pursuant to the requirements of
the current F.I.A. map and study. It is further intended
during this interim period prior to preparation and receipt
of a final hydrology report for the Spring Creek Basin,
that Victoria Limited as owner -developer can commence
development of its property in the Spring Creek Basin area
provided assurance is given to the City for a corridor to
accommodate channelized storm and drainage waters as may
be required by the final study and an agreement by the
City of Fort Collins that the cost and expense of accepting
and accommodating storm and drainage waters attributed to

upper basin development and basin importation of water by
the City will be allocated between City and upper basin
developers pursuant to process and procedure to be adopted
by the City, vis-a-vis potentially a storm drainage utility.
As further assurance that Victoria Limited intends
and will. pay for the cost of flood plain improvements
required by the current F.I.A. study and map, this is to
advise that Victoria Limited has applied for and is in the
process of obtaining a surety performance bond in the
amount of 150 percent of the cost for said F.I.A. required
improvements on Victoria Limited's Spring Creek Basin
property.
on behalf of Victoria Limited, we would request that
Victoria Limited be permitted to commence development of
its property in the Spring Creek Basin reserving thereon a
corridor for flood plain improvements without the require-
ment of the complete installation of flood plain improve-
ments potentially required by the Interim Hydrology Report
as adopted by the City of Fort Collins.

Storm Drainage on Hill Pond Development
Lucia, in order to obtain FHA approval for his proposed Hill Pond
Development, Steve Van Lear has indicated he needs to obtain an
agreement with the City regarding storm drainage on this site.
I have drafted the attached agreement which basically spells out
the terms and conditions we've been discussing with Steve over
the past few nonths. Tt is intended that this agreement would
outline t]ie general conditions for development of the site,
and that the details of which hTrovements would be installed when,
where, eb:!. would be worked out in the utility drawings and
subdivision agreements for individual filings.
I have sent a draft to Steve to review with FHA. Fbuld it be

the Army Corps of Engineers.

RE: Revised sewer services at Hill Pond single-family
Date: June 16, 1981
on this day I was contacted by Tarry Stanton to inquire with the.
City (Jim Hibbard) as to whether we could 'service the proposed
single-family units from the existing eighteen (18") inch sanitary
sewer. He inquired as to why in the past we did not recon[nend
using this line. I informed him that it was the advice of the
City not use it because it was to capacity and the condition of
the line was questionable. Therefore, on our plans we recanrend
the use of the new Spring Creek interceptor sewer (21") which
was deeper and had much larger capacity. A problen arose with
the contractor (Jerry Palmer) Palmer Construction, in that the
high ground water was making the cost of each sewer service
extranel.y high. It was requested then to contact the city
to inquire as to the tapping of the existing eighteen (18") inch.
In talking with Mr. Hibbard he informed me that they had no problan
under thine ci-rcumstances to allow tapping the eighteen (18") inch
instead of the twenty-one (21") inch as originally designed.
I reminded Mr. Palmer of the thirty (30") inch water line and he
in turnreccuniended that they go over the top of the existing
thirty (30") inch water and encase than as per City of Fort
Collins Standards for less than eighteen (18") inches of clearance.
Therefore, in summary, due to the high ground water condition
at Hill Pond single-family, we will be allowing the contractor
as per acceptance by the City (Mr. Hibbard, City of Fart Collins
Sewer and Water Department) to tap into the existing eighteen.(18")
inch sanitary sewer as is feasible for each service line. The
units to the south should have'no problem as the interceptor
line (21") is much lower and therefore, the sewer services will
be able to maintain a minim= of three (3') foot of cover from
the main to the lots themselves. In addition, the proposed six
(6") inch water line will go over the top of each of the services,
thus proposing no problan to the south. The units to the north will
have no problan with the proposed six (6") inch water line as it
will lie to the south of the services.

We are transmitting a copy of the Subdivision Agreement as well as the
Utility Drawings for Hill Pond, 1st Filing, in answer to your letter
of June 24, I.981.
The Utility Drawings indicate the extent of the developer's requirements
for improvements to Shields Street. The ordinance (Article 99 - adopted
6-6-68) stipulated the developer's responsibility and the City's
responsibility for oversizing.
Since much water has passed through Spring Creek since these instruments
were signed, I suggest we sit dawn and renegotiate an agreement for the
orderly improvements to Shields Street to present design criteria and
standards.
I assume that you are out -of -than, (by the tone of your letter) so I will
contact you again early in the week of July 6th to try to set up such a
meeting.

The following information is being sabm tted for your review as per your request in
the letter sent to the attention of Mr. Robert W. Smith, dated June 25, 1982, a copy
of which is attached.
First, I'd like to explain that contrary to what you indicated in your letter, the
Spring Creek Channelization Project at Hill Pond is almost 100% complete. All that
needs to be completed is the seeding and the landscaping. The concrete diversion
structure along with all of the earthwork is complete and built according to the
construction plans prepared by Tri-Consultants, Inc. and sent to you on June 3, 1982.
I will address each of your numbered requests in the order that you presented them.
1. A copy of the printout for the hydraulic computer model representing the un-
encroached 100--year profile run for conditions existing at the time the
currently effective floodway was developed is included. The printouts are
labeled Existing Flows: 2, 10, 25, 50, 100 & 500-year, original HEC-II printouts
for Spring Creek Major Drainageway Plan, prepared by Gingery Ass-ociates, Inc.
2. A copy of the printout for the hydraulic computer model representing the floodway
run for conditions under which the currently effective floodway was developed is
included. The printout is labeled Floodway Run, Developed 100-Year Flows,
original HEC-II printouts for Spring Creek Major Drainageway Plan, prepared by
Gingery Associates, Inc.
3. Revised hydraulic computer model for the 100-year flood and the proposed floodway
configuration which reflects the proposed improvements and are tied into the
original model both upstream and downstream are included. These are actual printouts
and not photo copies. They are labeled Existing 2, 10, 25, 50, 100 & 500-year
flows and Developed 2, 10, 25, 50, 100 & 500-year flows.
Please note that the elevation datum used for the Gingery Associates, Inc. HEC-II
computer models is based on 1974 aerial maps borrowed from the City. Since 1974 the
City datum has changed and this change is reflected by the elevation shown in these

revised hydraulic computer models. Gingery's HEC-II elevations are approximately
211-' higher than the revised HEC-II printouts prepared by Tri-Consultants, Inc.
4. Certification from a registered professional engineer that the proposed
floodway configuration does not produce surcharges in excess of the allowable
maximum as measured from the existing 100-year profile is included. It is
dated September 23, 1982 and is signed by Charles E. Brannan, P.E. from
Tri-Consultants, Inc., Denver, Colorado.
5. Design plans and profile of the structural measures, or a design report,
in sufficient detail to address the full area affected by the measures.
Enclosed are sheet 1 and 2 of a topographic map labeled Floodplain Data for
the project Hill Pond -Fort Collins, prepared by Tri-Consultants, Inc. showing
that the full area affected by the structural measure is contained within the
channel.
The only areas which will become inundated after rechannelization by the
100-year and 500-year developed flows are at the east end of the project
where the prepared grading is matching existing conditions at the Arthur Ditch.
6. Evidence that the community has agreed to maintain the adequacy and level of
protection provided by the structural measures.
Enclosed is a copy of an agreement between Gandolf Partnership, current owners
of the Hill Pond property. The Arthur Irrigation anipany, owners of the
Arthur Ditch and the City of Fort Collins dated November 5, 1981. The agreement
stipulates that the City will be responsible for maintenance of the diversion
structure and for the operation of the structure during high water times.
As for maintenance of the floodway within the drainage easement, the City
has agreed to provide that as shown on the enclosed landscape and site plan
by Gefroh Assa iates.
7. Where permanent structural measures include construction of a levee, the
following is also required:
a. Statement as to who will own the levee system.
That portion of the levee outside of the drainage easement is located
on private property and will be owned and maintained by the owner of the
property. That portion of the levee within the drainage easement will be
owned and maintained by the City.
b. Certification that the minimum freeboard criteria has been met.
At this time Tri-Consultants, Inc. does not have as -built elevations of
the berm. When these are obtained and checked with the construction plans
then the certification will be sent to you by Tri-Consultants, Inc.

c. Statement of the degree of human intervention and the operation of
any closures.
The concrete diversion structure located at the east end of the project
was designed and built with the assumption that the structure will be
overtopped during a major storm event. No human intervention and
operation of any closures will be necessary.
d. Identification of interior drainage problems including a map of
suitable scale and topographic definition to provide reassurable
accuracy identifying any residual 100-year flooding within the levee
system plus accompanying hydraulic calculations.
Please refer to sheet 1 and 2 of the topographic map indicated in
Item #5. Only those areas at the east end of the project could become
inundated as shown on the map.

regarding this submittal. Would you please send me another copy of FEMA's "Levee
Policy" as I have misplaced the 1st copy you sent me. Thank you.

Re: Damaged fence at Hill Pond - South Shields Street
Dear Mr. Simpson:
The City Risk Management Division has recently received a complaint and
request for compensation from Mr. Dennis Nix. Mr. Nix states that when the
water line was installed for the Spring Creek Professional Park P. U. D., a
portion of the fence at Hill Pond was removed and was not replaced
correctly. Consequently, it has fallen over and is in need of additional
repair. In investigating this claim our field inspector, Steve Biegler,
noted that il: appears a fence post was sawed off below ground level and
later repaired in a make -shift fashion. That is, by scabbing a piece of
lumber to the post sections, creating a band -aid type of repair.
The City has refused Mr. Nix's request for compensation for the fence
damage on the grounds that it is a result of your construction and the
damage was created during the installation of the water line with the
development. However, we are concerned that the fence be repaired properly
and we ask your cooperation in contacting Mr. Nix and satisfying his
concerns.
It is my understanding that Mr. Nix represents the Hill Pond Homeowners
Association and is only asking that the fence be repaired, that the fence
post be replaced correctly and the fence be reset. He can be reached at
493-1555.

The utilities for Hill Pond on Spring Creek, 1st Filing,
within the City of Fort Collins, which includes water lines,
sewer lines, curb, gutter and sidewalk, paved streets, and
storm drainage facilities, are inspected during construction

Dear Roy,
As a result of our meeting with you and your staff on March 6, it was
agreed that the following would be acceptable proceedure in the on
going submittal of parcels to planning and zoning and City Council.
1. By March 15 we would submit areas 7 and 8 and the eastern half
of area 9.
2. We would submit it with a temporary cul de sac ending near the
east end of the property and ending on Spring Creek in area 7.
3. We would assume limited access through Sheely Drive on the north-
east with subsequent access being provided in a construction
road built to city specifications giving access to Shields St.
through area 5. (This would releive the necessity for limiting
Certificate of Occupancies as we understand it in areas 7 and 8.
4. Submit 9 with landscaping plans in the eastern ' (approximately)
as submitted to conceptual review and wait for other action on
the remainder of 9 until such a time as a final determination
has been made by the city as to the flood plane and related
matters.
Given these stipulations it is our understanding that we would have staff
support as we ;o before Planning and 7.oning on the 15th of March.

This letter will confirm the results of the discussion in our offices
yesterday regarding drainage improvements required in conjunction with the
development of Hill Pond. I believe we agreed to the following points:
(1) The minimum requirement will be that the Developer provide for the
passage of the flood designated by the F.I.A. study through his
property in accordance with the City's floodplain ordinance. If
the present channel is improved to confine this flood, such improvements
shall be designed and installed at the sole expense of the Developer,
subject to review and approval by the City. However, if additional
information developed prior to the construction of any channel im-
provements indicates that flood flows in excess of the F.I.A. flood
will pass through the subject property, the City may require the
Developer to provide for these revised flood flows at his expense.
(2) The Developer will provide a corridor within his development of suf-
ficient width to allow for the construction of an improved channel
capable of passing the flood flows developed in the Interiam Flood
Hydrology Report for Spring Creek. This corridor shall include the
proposed channel recommended in the canal importation study.
(3) The City will continue its present study of the canal importation
project and the final analysis of Spring Creek in a timely manner; and
(4) The Developer will agree to participate in the cost of improvements
required in conjunction with the results of those studies to the
extent determined by the City Council.
If I have left anything out, or if you are in agreement with the points of
our discussion as I have summarized them above, I would appreciate a written
response to that effect at your earliest convenience. Please feel free to

I have reviewed Mr. Engemoen's letter of July 3, 1979,
concerning the agreements reached between the City of Fort
Collins and Victoria Limited at a June 27, 1979 meeting in
your offices. The meeting was conducted to discuss and
clarify various requirements concerning drainage improve-
ments in the Hill Pond Development area as a result of the
F.I.A. study and the City of Fort Collins Interim Flood
Hydrology Report for Spring Creek. I believe the following
points were agreed to at our meeting:
1. The minimum requirement will be that
the Developer provide for the passage of flood
wafers through its property pursuant to the
current F.I.A. map and study as required by the
City's flood plain ordinance. If the F.I.A.
map and study floodway is channelized and improved
to confine the floodway, such improvements shall
be designed and installed at the expense of the
Developer subject to review and approval by the
City.
2. So that planning and potential develop-
ment may commence, the Developer will provide a
corridor within its development of sufficient

width to allow for the construction of an improved
channel capable of passing the flood flows
developed in the City of Fort Collins Interim
Flood Hydrology Report for Spring Creek, which
study includes drainage basin importation and
additional drainage flows resulting from
development in the upper portion of the Spring
Creek Basin. The corridor width shall be determined
by the guidelines proposed in the Interim Flood
Hydrology Report for Spring Creek.
3. The City will continue its present
study of the additional flows in the Spring
Creek basin as a result of drainage basin
importation project and upstream drainage basin
development. In the event this study determines
that such drainage basin importation and up-
stream interbasin development will result in
flood flows in excess of the present F.I.A. map
and study, channel improvements sufficient to
handle such excess flood flows, developed
pursuant to the guidelines of the Interim Flood
Hydrology Report for Spring Creek, must be
constructed with the cost for such improvements
to be shared between the Developer, the City of
Fort Collins, and upstream interbasin developers
(at a minimum and potentially all developers) to
the extent determined by City Council.
The agreement relative to this last item was designed
to allocate the costs of channel improvements associated
with excess flood flows passing across Hill Pond property
as a result of upstream interbasin development and drain-
age basin importation. It was discussed and understood at
this meeting that the complete data and facts were not yet
available to conclude that the additional flood flows
indicated in the Interim Flood Hydrology Report for Spring
Creek in excess of the flood flows determined by the
current F.I.A. map and study would occur.
4. It was further agreed that the City of
Fort Collins, in recognition of the problem of ex-
cess drainage caused by upstream inter -basin develop-
ment,, would review and implement a policy that, for
new subdivision development in the spring Creek
upper basin, the subdivision agreement would have to
