The Fort Collins - Loveland Water District and the South Fort Collins Sanitation District have reviewed
the above mentioned project and submit the following comments.
The water service to lots 9-12 needs to be abandoned at the main and relocated in accordance with
District requirements.
The sanitary sewer services that cross diagonally need to be abandoned at the main and relocated in
accordance with District requirements.
The design and maintenance of the access road over the sanitary sewer line needs to be submitted
for review and comment. The District may require wider easements due the proposed location.
Abandonment, liability and future responsibility of the existing sanitary sewer line needs to be
addressed.
The general notes need to be revised to indicate that water and sanitary sewer construct shall
conform to the most current Fort Collins — Loveland Water District and South Fort Collins
Sanitation District standards and requirements.
The District requires easements on the District's standard easement form for all facilities that are
not located within the public ROW.
All disturbed facilities are to be re -tested in accordance with District standards and requirements.
Are retaining walls proposed?
The curb stop typical is to be deleted. The District requires meter pits for multi -family structures.

Request for Variance - Driveways
Susan,
This letter is in regards to the Harmony Ridge P.U.D. Replat project, and in particular, to request a
variance. Our clientfor this project is Overland Homes.
The specific areas of concern are the driveways, and in particular to Section 9.4.2. Last year, the
Department of Natural resources contacted our client regarding this project, which at the time is approved.
They wanted to see if our client would break apart the approved 6 plex units into smaller 4-plex units,
reducing the building mass as viewed from the Cathy Fromme prairie. Our client is working hard to
accommodate this request, but this change has caused some new problems with the site layout, and in
particular to the driveways.
Section 9.4.2 states that In General, the entrance angle for all driveway approaches and intersections shall
be as near 90' as possible. This site layout does accomplish this, in general, for a minimum distance of25';
from the street, There are some adverse angles of approach into the garage openings, farther than 25' from
the street, in particular unit 70 and 71, but the owner has also provided additional driveway length which
can be utilized as a turnaround_ We feel this is a better solution than by providing a more perpendicular
access from another units driveway, in particular from lot 69 driveway. If the owner of Lot 69 would park a
car in his driveway, neither of the owners of Lots 70 or 71 could access their lot.
Therefore, because of the above mentioned design suggestions of City staff, we understand that we are
required to request a variance to City standards. Therefore, on behalf of our client, we are requesting a
variance from City standard 9.4.2.
As this was ajoint decision between the developer and the City staff, we feel justified in requesting the
variance. We do not feel that this variance will be detrimental to the public health, safety or welfare, nor
will it reduce the design life of Dusty Sage Loop or cause the City of Fort Collins additional maintenance
costs.

RE: Variance Request for Harmony Ridge PUD Replat
Northern Engineering Services Inc., on behalf of the Developer for Harmony Ridge Replat, has
submitted three variance requests to the City of Fort Collins design standards. The project in question is
located south of Harmony Road, just west of Seneca, with the specific lots in question located on Prairie
Ridge Drive, Dusty Sage Drive and Dusty Sage Loop within the development itself. All three streets are
designated as Residential Local Streets. The three variance requests for this project are:
1. In accordance with Table 7-3, the minimum distance between a driveway and a street intersection is
80' from centerline to centerline. Lot 90 is 65' from CL to CL, Lot 108 is 57' and Lot 63 is 60'.
Considering that both Prairie Ridge Drive, Dusty Sage Drive, and Dusty Sage Loop are all local streets
with slower speeds and lower traffic volumes, we believe that allowing the driveways to be closer to
the intersections will not adversely effect traffic, nor will it be a safety issue to the residents.
2. Table 7-3 also requires a minimum of 12' between driveway edges. Lots 67-72 are located on the
end of a cul-de-sac with driveway separations varying from 3' to 10'. The narrowness of the lot
frontages coupled with the cul-de-sac location does not allow for residential driveways to meet the
separation requirements as called out in Table 7-3. We believe that granting a variance to the
minimum separation requirements will not adversely effect public health or safety, or increase
maintenance costs for the City of Fort Collins in any way.
3. Section 9.4.2 requires that driveway approaches shall be 90 degrees to the street, plus or minus 10
degrees. After reviewing the site and the low traffic volumes projected for the local streets, we agree
with the Engineer's analysis. Any of the driveways that do not meet the standard are not significant
enough to create a hazard for vehicles traveling on Dusty Sage Loop.
I recommend approval for the above variance requests. Please let me know if you have any questions or
concerns and if you need any additional clarification.

I believe you are right. They (the ditch) is now saying they want to sign off on the plans and since the
original didn't have anything we need to get the necessaryu signatures. Otherwise they can stop the
project as it relates to crossing their ditch.

Dave... originally we told JR Engineering to make a note refering to the TST plans and that they didn't have
to fully design this ditch crossing. But if the ditch company hasn't seen these plans and/or the old plans
and they haven't signed off on anything to date, then technically we can ask for the full design, right? I
mean, the ditch company will want it and they will definately sign off on this set of drawings so they'll have
to show something more detailed.
I just wanted to confirm this because you might hear complaints.

I may or may not have a problem that one of you can help me track down. I'm writing about the ditch
crossing for the Cathy Fromme Prairie connection on this project. Originally the design called for a 12'
wide bridge and a 12' wide maintenance path that was going to double as a pedestrian sidewalk into the
prairie. The 12' requirement was made so that the ditch rider trucks and their occasional backhoe could
get into the area for their yearly maintenance. Since the first filing, the replat has changed the location a
little and the FCLW D will also need this path for their maintenance vehicles.
Now for the interesting part. The original plan said that a bridge was required, but I was told verbally that
since then, the developer (Padilla) had talked the ditch company into letting them pipe the ditch. But I can
not find any documentation that says the ditch company agreed to this. Do you know of any? Or do you
know who they spoke to at the Trilby Lateral?
This is all coming up again because the last round of review on the Harmony Ridge Replat is now showing
the ditch crossing for the first time and something just didn't look right. I called Gary Steadele (President
of the Trilby Lateral Ditch Company) and asked him if he's seen this design at all or if he was the one who
agreed to the culvert in lieu of the bridge. He said no to both questions and asked me who signed the
plans from the ditch company agreeing to this. I told him that I would check and get back to him ASAP.
After going through the plans and the project file, I can find no signature block that the ditch company has
ever signed on the plans or any document with their signature on it agreeing to this. All we have that's
officially signed off by the city is the site plan from Harmony Ridge PUD calling out the 12' bridge and the
12' maintenance road. The utility plans conflict this with a note calling out a 24" pipe and that the exact
location must be coordinated with the ditch company. Again, the ditch company did not sign off on either
one of these plans.
So .... the question is - who said that the developer could pipe the ditch instead of constructing the bridge?
And in case you haven't guessed by now, they want the bridge.

Thank you for the opportunity to comment on the #49-95E Harmony Ridge, Phase I-
Replat of Lots 16-22 & Tract 7.
Directly to the East of this tiling is a area that the Trilby Lateral has had mud flow
problems with. Below is a picture which shows the mud that was removed from the
frilhy Lateral in May 2001. This is at the end of Praire Ridge.
In the foreground you can see the silt fence that the mudflow knocked down before
Ilowing into the 'Trilby Lateral ditch. On the backside you can see the 5-10 cubic vends
of mud that was removed.
The above mud flow was several hundred feed upstream of the replat area and is the
justification for my comments which follow.
A) A culvert in the Trilby Lateral would be almost impossible to clean out if another
mud Ilow should occur. The Trilby Lateral requests that a bridge be built so that a clean
out by backhoe and shovels is possible. A bridge similar to the one by Taft ff ill Road
and the Cathy FYomme Trail has successfully been cleaned in the past and would be a
good choice. 'I he bridge needs to be able to have a pickup truck loaded with 500 gallons
of water cross it, thus at least a 10000 pound rating. This bridge provides the only
maintancc access to the Trilby Lateral to the east of it.
B) The silt fence directly adjacent to the Trilby Lateral has a silt trap on the up hill side.
The silt trap needs to have a one foot deep spec on it. Also when cleaning occurs the silt
trap as well as silt piled up on the fence needs to both be cleaned.
C) Two additional standard silt fences on the hillside are requested. The purpose of
these two additional fences is to limit the amount of silt that might reach the primary silt
fence adjacent to the Trilby Lateral.
D) The Dusty Sage Loop has a major street drain in it that if it becomes plugged will send
all of the street water down to the Trilby Lateral. Street water flowing down the hill
would result in a large amount of erosion. The Trilby Lateral requests that Frosion
Control Fabric or rip rap or some other permanent erosion control measures be taken to
guard against damage occurring from a plugged street drain.
We also request that during the construction time no gravel filter tie placed in this street
drain because that will limit the water flow to the drain and increase the likely hood of a
street overflow..
To the West of this filing is the Harmony Ridge second filing. The Trilby Lateral
worked with the developer on the Harmony Ridge Second Filing to come up with a
design that would prevent mud from flowing into the Trilby Lateral from the
development. Items B, C, and D are the same as those approved the Second Filing.

The Trilby Lateral has concerns about moving the storm water pipe parallel and only 10
feel away from the Trilby Lateral irrigation ditch.
I've attached a marked up portion of sheet 3 of 8 which shows my primary concern about
moving the storm water pipe parallel to the Trilby Lateral irrigation ditch.
Water from the Trilby Lateral will seep through 10 feet of soil to the storm water pipe.
The storm water pipe will be on a layer of gravel which will act as a path for the water to
follow. The water will flow to the point that the storm water pipe crosses the Trilby
Lateral. Where the storm water pipe crosses the Trilby Lateral a very large elevation
change occurs which will cause the water to flow fast and move soil with it. This could
cause the Trilby Lateral to be undercut and eventually a complete washout could occur.
It is very common along the Trilby Lateral to encounter very porous soils. There are
sections that have a almost shale like soil. Thus I believe that it is very likely that
significant leakage from the ditch to the storm water pipe will occur. This section of the
ditch in wet years tends to have a spring water flow which indicates a porous soil that
water can move through.
A second concern is the construction phase of the storm water pipe. During this
construction it is likely that soil and rocks will fall into the Trilby Lateral. If tile
construction is clone when water is flowing this could cause the Trilby Lateral to become
dammed and overflow it's banks. It is unknown at what point a overflow would occur.
The "I rilby Lateral is a very flat ditch and the overflow could backup all the way to the
Ridge where it could flow on to houses.
The Trilby Lateral requests that you move the storm water pipe further away from the
Trilby Lateral and to a higher elevation. The pipe should be moved enough so that the
bottom of the trench that that the storm water pipe goes into be at a higher elevation than
the lop of the Trilby Lateral. If this is done then no water flow from the'frilb_y Lateral to
the storm water pipe is possible.

On Saturday March 15, 2003 1 met with Leslie Jones at the Harmony Ridge Phase 1
Replat Site. Leslie had said that the Storm Water Pipe would be at a higher elevation
than the Trilby Lateral Ditch. From just the drawings you cannot determine this since
the elevation of the Trilby Lateral is not shown on the Storm Sewer Realignment Profile
drawing sheet 5 of 8.
This drawing does show that the storm water pipe would start at the existing ground
surface. This surface is several feet above the Trilby Lateral.
The drawing also shows that up to eight feet of fill would be added on top of the pipe.
Sec the storm sewer realignment profile that I have redlined.
After leaving the site and consulting with another Trilby Lateral board member it became
clear to us that the existing Storm Sewer Realignment Profile drawings do show the
storm water pipe mostly above the Trilby Lateral. This drawing is, however, in conflict
with other drawings.
The conflict is that the Storm Sewer Realignment Profile drawing shows up to 8 feet of
fill being added at a distance that is only 10 ft away from the Trilby Lateral. Drawing
sheet 6 of 8 shows that a silt fence and sediment trap be build in the 10 ft next to the
Trilby Lateral. I've attached a redline of the silt fence and sediment trap that shows the
profile that the Storm Sewer Realignment Profile drawing would require. These two
profiles cannot both exist in the same space.
The addition of up to 8 feet of fill in the 10 ft Trilby Lateral Easement would make
travel along the ditch impossible. This would take away from the Trilby Lateral the
ability to do maintenance along the ditch with equipment such as a backhoc.
The design along the Trilby Lateral has conflicts from sheet to sheet that are too large to
ignore. These must be resolved before acceptance.

Request for Variance - Driveways
Susan,
This letter is in regards to the Harmony Ridge P.U.D. Replat project, and in particular, to request
a variance. Our client for this project is Overland Homes.
The specific areas of concern are the driveways, and in particular to Table 7.3. Last year, the
Department of Natural resources contacted our client regarding this project, which at the time is
approved. They wanted to see if our client would break apart the approved 6 plex units into
smaller 4-plex units, reducing the building mass as viewed from the Cathy Fromme prairie. Our
client is working hard to accommodate this request, but this change has caused some new
problems with the site layout, and in particular to the driveways.
'Cable 7-3 states that the minimum distance between a driveway and street intersection should be
a minimum of 80'. This table also states that there should be a minimum of 12' between driveway
edges I would like to address each of these items separately.
This replat is located towards the edge of the entire Harmony Ridge development. The Cathy
Fromme Prairie is southwest of this site, ensuring that no additional development will occur
adjacent to this site. Therefore, Dusty Sage Drive and Court will only experience traffic that is
directly associated with these residents. In my opinion, traffic flow in this area will be very small.
Allowing the driveways to be closer than 80' to an intersection would have no adverse effect on
traffic, nor would it pose any safety concerns to the residents. Also, it will allow the developer to
meet the density requirements for this site, as prescribed ny the current City criteria.
The rational for the variance request for the second item, or the 12' separation guideline, should
also be considered because of the low volume streets discussed above. In addition, the developer
has worked hard on his site plan to combine driveways wherever possible to help minimize the
total number of driveways that access onto Dusty Sage Loop and Court.
