is hereby granted permission to construct and use an access to the state highway at the location noted below.
The access shall be constructed, maintained and used in accordance with the terms and conditions of this permit,
including the State Highway Access Code and listed attachments. This permit may be rpvoked by the issuing
authority if at any time the permitted access and its use violate any of the terms and conditions of this permit. The use
of advance warning and cons^ruction signs, flashers, barricades and flaggers are required at all times during access
construction within State right-of-way in conformance with the MANUAL ON UNIFORM TRAFFIC CONTROL
DEVICES, Part VI. The issuing authority, the Department and their duly appointed agents and employees shall be held
harmless against any action for personal injury or property damage sustained by reason of the exercise of the permit.
LOCATION:
Access is to be located on State Highway 68, a distance of 3311 feet
east from Mile Post 0.0 on the south/right side.

IY OTHER TERMS AND CONDITIONS:

1. This permit is only for the use and purpose stated in the Application and Permit.
A change in use of the property which results in a change in the type of driveway
operation may require reconstruction, relocation, or conformance of the driveway
to the Access Code.
2. Reconstruction or improvements to the access may be required when the permittee
has failed to meet required specifications of design or materials. If any con-
struction element fails within two years due to improper construction or material
specifications, the permittee is responsible for all repairs.

Upon the signing of this permit the permlttee agrees to the terms and conditions and referenced attachments contained
herein. All construction shall be completed in an expeditious and safe manner and shall be finished within 45 days from
initiation. The permitted access shall be completed in accordance with the terms and conditions of the permit prior to
being used. The permittee shall notify Gareld Sisson
with the Colorado Department of Highways in Loveland at 667-4650
at least 48 hours prior to commencing construction within the State Highway right-of-way.

VARIANCE FROM THE STATE HIGHWAY ACCESS CODE
WHEN USED, THIS FORM SHALL BE ACCOMPANIED BY AN ACCESS PERMIT APPLICATION.
1. State specific reasons for this variance request. Documents verifying statements may be requested or should be
provided with request. State specific sections of the State Highway Access Code from which this request seeks relief.

A Variance is requested to allow the Temporary Construction
Access at Boardwalk Drive and Harmony Road to meet the 45 M.P.H.
Design Criteria for the following reasons:
1. Permanent improvements will be based on 45 M.P.H. Design
Criteria. This request will allow most of the permanent
striping to be done with installation of the Construction
Access.
2. There are existing 45 M.P.H. (posted) sections of Harmony
Road short distances to the east and west of the affected
area.

Utility work authorized under this permit shall comply with the requirements of the CDOH Utility Manual, and applicable federal, state, and industry
codes and regulations.
Construction of any portion of the highway facility, including the pavement structure, subsurface support, drainage, landscaping elements, and all
appurtenant features, shall comply with the provisions of the CDOH Standard Specifications for Road and Bridge Construction, and with the
Colorado Standard Plans (M & S Standards).

WORK WHERE DEPARTMENT LACKS AUTHORITY
Utility work within municipal boundaries (pursuant m 43-2-135 CRS), or on certain public lands,
may require separate approval of the appropriate jurudictionat agency or property owner.
INSTALLATIONS ON FREEWAYS (2.011)
CDOM may permit utility accommodations on freeways, including the Interstate System, only In
accordance with Utility Manual provisions. Special case exceptions as defined therein may be
permitted only with prior concurrence by FHWA. Special case exceptions generally involve

PAVEMENT CUTS AND REPAIRS
Under no condition is a paved surface to be cut unless otherwise specified in this permit. No
more than one halt the roadbed may be opened at a time, when otherwise permitted. Pavement

Pavement will be replaced to a design equal to or greater than that of the surrounding
undisturbed pavement structure. Pavement repair shall be as per the Special Provisions or the
approved plans. (3.03d)
BORING. JACKING, ENCASEMENT -
Unless otherwise specified. buried crossings shall be bored or jacked beneath the roadway, at
least Iron toe to slope to toe of opposite slope. (3.01d, 3.03c).

Boring shall not exceed 5 percent oversize. Resultant voids shell be grouted or otherwise
backlilled, subject to CDOH approval. Ends of bored sections shall not be covered before being
inspected.(3.03c)
Encasement requirements shall " conslsent with Utility Manual provisions. CDOH may
require protective casing for shallow installation, or certain conduit materials. Encased
crossings shall extend at least from toe of slope to toe of slope, of the full width between
access -control lines on freeways, including the Interstate System. (3.01d. 3.030. 3.03h)
INSPECTION AND ACCEPTANCE (3.03a)
CDCH will determine the extent of Inspection Services necessary for a'given installation.
Permittee may be charged the costs of inspection services at the rates established in the CDOH

RESTORATION OF RIGHT OF WAY (3.03d)

Construction, maintenance, and watering requirements shall conform with the CDOH Standard

OPERATION AND MAINTENANCE (3.04a)

Routine, periodic maintenance and emergency repair, may be performed under the general
terms and conditions of this permit. CDOH shall be given proper advance notice whenever

district office and the State Patrol shall Immediately be notified of possible traffic hazards.
Emergency procedures shall be coordinated beforehand, where Foealble.
Maintenance activities requiring new excavation or other disturbance within highway ROW may
require separate permit.
Where highway construction or maintenance operations so require, Permittee will snotion lines,
remove all Combustible materials from the highway right of way, or provide other temporary
safeguards.
Should any permitted facilities be abandoned, Permitted agrees to promptly notify the district
office and to remove any or all portions of such facilities, as may be directed by CDOH.
UNDERGROUND UTILITY LOCATION ASSISTANCE
Permittee may be required to identity the installation with suitable markers, of a type and at
locations as specified or otherwise approved. Markers shell be maintained by Permittee for the
file of the installation.
Warning ribbon and/or detection wire may be required for buried facilities. "As Constructed"
lines and grades will be furnished as directed.
Owners of underground facilities should participate in a notification association pursuant to
9-1.5-105 CRS. or at a minimum shall provide CDOH with location assistance information filed
pursuant to 9-1.5-103(1) CRS.
ADJUSTMENTS DUE TO HIGHWAY CONSTRUCTION (2.011)

SUSPENSION AND CANCELLATION (3.03s) _
The COOH inspector may suspend operations due to: 1) Noncompliance with the provisions
of this permit. 2) Adverse weather or traffic conddionic 3) Concurrent highway construction or
maintenance in conflict with permit work; or 4) Any condition deemed unsafe for workers ad for
the general public. Work may resume upon disposal of grounds for suspension.
This permit is subject to cancellation due to: 1) Persistent noncompliance with permit
provisions; 2) Abandonment or transfer of ownership; 3) Supersedure by new permit covering
the same installation: or 4) Conflict with necessary planned highway construction. Permitted
must promptly terminate occupancy upon notice of cancellation of permit, unless a new permit
Is applied for and granted.
Where Permittee does not fulfill an obggation to repair or maintain any portion of the highway
facility, or control and safely maintain rho flow of traffic thereon. CDOH reserves the right, in lieu
of cancelling this permit, to accomplish the required work by any other appropfiate means, and
Permittee shall be liable for the actual costs thereof.

The Standard Provisions are terms and conditions of this permit

Utility work authorized under this permit Shall comply with the requiremil of the CDOH Utility Manual, and applicable federal, state, ancrindustry
codes and regulations.
Construction of any portion of the highway facility, including the pavement structure, subsurface support, drainage, landscaping elements, and all
appurtenant features, shall comply with the provisions of the CDOH Standard Specifications for Road and Bridge Construction, and with the
Colorado Standard Plans (M & S Standards).
NOTES: Related Utility Manual criteria are cited in boldface type.

DRAINAGEWAYS AND WATERCOURSES
In no case shall the flow of water ever be impaired or interrupted. Where Possible, crossings of
ditches, canals or water carrying structures Shall be bored or jacked beneath. Irrigation ditch or
canal crossings require approval of the ditch company or owner. Damage to any drainage
facility shall be repaired by Permitter, to the satisfaction of the owner.
TRAFFIC CONTROL (2.01n)
Whenever the work will affect the movement or Safety of traffic. Permutes shall develop and
implement a frelllc control plan, and .idle traffic control devices as necessary to ensure the
sale and expeditious movement of traffic around and through the work site end the safety of the
utility work force.

Manual on Uniform Traffic Control Devices and Colorado Supplement thereto, and with the

No parallel installations will be permitted within roadways (Including curbing and/or shoulders)

Parallel installations shall follow a uniform alignment, wherever practical. Due consideration
art be given to conserving space available for future utility accommodations. The standard
allowable deviation from the approved horizonal alignment is s IB inches. (3.01s, 3.01c)
Minimum cover shall be as patine Special Provisions. Normal specified cover will be 36 inches
or greaten reduced cover, 24 inches absolute minimum, may be approved where site conditions

PAVEMENT CUTS AND REPAIRS
Under no condition is a paved surface to be cut unless otherwise specified in this permit. No
more than one half the roadbed may be opened at a time, when otherwise permitted. Pavement
shall be sawed or wheel -cut to a neat line. (3.01d, 3.03c)
Pavement will be replaced to a design equal to or greater than that of the surrounding
undisturbed pavement structure. Pavement repair shall be as per the Special Provisions or the
approved plans. (3.03d)
BORING, JACKING, ENCASEMENT
Unless otherwise specified, buried crossings shall be bored orlacked beneath the roadway, at
least from toe to slope to toe of opposite slope. (3.01d, 3.03c).
Portals for unhenched crossings more than 5 feel in depth will be bulkheaded. Minimum lateral
dimension from portal to edge of pavement is 6 feet, but In any case shall not be less than the
vertical drop from roadway surface to top of line. (3.03c)
Water letting or tunneling is not permitted. Water assisted boring may be permitted as
determined by the COOH Inspector. (3.03c)
Boring shall not exceed 5 percent oversize. Resultant voids shall be grouted or otherwise
backulled, subject to CDOH approval. Ends of bored sections shall not be covered before being
repaced. (3.03c)
Encasement requirements shell be consistent with Utility Manual provisions. COOH may
require protective casing for Shallow installation, or cenS.n conduit malariah. Encased
crossings shall extend at least from toe of slope to toe of slope, or the full width between
access -control lines on freeways, including the Interstate System. (3.01d, 3.03g, 3.03h)

COON will determine the extent of Inspection services necessary for a given Installation.
Permiltee may be charged the costs of Inspection Services at the rates established in the COON

The following paragraphs are pertinent hi( this of the State Highway Access Code.Then re provided for your convenience but
do not alleviate compliance with all sectio,._ of the Access Code. A copy of the State High Access Code is available front your
local issuing authority (local government) or the State Department of Highways (Department). When this permit was Issued, the
issuing authority made its decision based in part on information submitted by the applicant, on the access category which Is
assigned to the highway, what alternative access to other public roads and streets is available, and safety and design standards.
Changes in use or design not approved by the permit or the issuing authority may cause the revocation orsuspenslon of the permit.
I Appeals
1. Should the permitted or applicant chose to object to any of the terms or conditions of the permit placed therein by the
Department, an appeal must be filed with file Colorado Highway Commission within 60days of transmittal of the permitter
permittee signature. The request for the hearing shall be filed in writing and submitted to the Colorado Highway
Commission, 4201 East Arkansas Avenue, Denver, Colorado 80222. The request shall include reasons for the appeal and
may include recommendations by the permittee or applicant that would be acceptable to him.
2_ The Department may consider any objections and requested revisions at the request of the applicant or permittee. If
agreement is reached, the Department, with the approval of local Issuing authority (if applicable), may revisethe permit
accordingly, or issue a new permit, or requirethe applicant to submit a newapplication for reconsideration. Changes in the
original application, proposed design or access use will normally require submittal of a new application.
3. Regardless of any communications, meetings, or negotiations with the Department regarding revisions and objections to
the permit, if the perniittre or applicant wishesto appeal the Departments decision tothe Comrpission, the appeal must be
brought to the Commission within 60 days of transmittal of the permit.
4. Any appeal by the applicant or permittee of action by the local issuing authority when it is the appropriate local authority
(under suhsectlon 2.4), shall be filed with the local authority and be consistent with the appeal procedures of the local
authority.
5. If the final action is not farther appealed, the Department or local authority may record the decision with the County Clerk
and Recorder.
II Construction standards and requirements
1. The access must be under construction within one year of the permit date. However, under certain conditions a one year
time extension may be granted if requested In writing prior to permit expiration.
2. The applicant shall notify theoffice specified on the permit at least48 hours priorto construction. A copy of the permit shall
be available for review at the construction site. Inspections will be made during construction.
3. The access construction within highway right-of-way must be completed within 45 days.
4. It is the responsibility of the permittee to complete the construction of the access according to the terms and conditions of
the permit- If the permitlee wishes to use the access prior to completion, arrangements must be approved by the Issuing
authority and Department and included on the permit. The Department or issuing authority may order a halt to any
unauthorized use of the access. Reconstruction or Improvements to the access may be required when the permittee has
failed to meet required specifications of design or materials. If any construction element fails within two years due to
improper construction or material specifications, the permittee Is responsible for all repairs.
5. In theevem it becomes necessary to remove any right-of-way fence, the posts on eitherside of theaccess shall besecurely
braced with an approved end post before the fence is cut to prevent any slacking of the remaining fence. Allposts and wire
removed are Department property and shall be turned over to a representative of the Department.
6- A copy of the permit shall be, available for review at theconstruction site. if necessary, mmorchangesand additionsshall be
ordered by the Department or local authority field inspector to meet unanticipated site conditions.
7. The access shall be constructed and maintained in a mannerthat shall not cause watertoenter ontothe roadway, andshall
not interfere with the drainage system in the right-of-way.
8. Where necessary to remove, relocate, or repair a traffic control device or public or private utilities for the construction of a
permitted access, thework shall be accomplished by the permittee without cost to the Department or issuing authority, and
at the direction of the Department or utility company Any damage to the state highway or other public right-of-way beyond
that which Is allowed in the permit shall be repaired Immediately.
9. Adequate advance warn i rig is required atall timesduring access construction, in conformance with the Manualon Uniform
Traffic Control Devices for Streets and Highways. This may Include the use of signs, flashers, barricades and flaggers. This
IS also requiredby section 42-4-501,C.R.S. as amended. The issuing authority, the Department and their duty appointed
agents and employees shall be held harmless against any action for personal injury or property damage sustained by
reason of the exercise of the permit.
III Changes in use and violations
1. If there are changes In the use of the access, the access permit -issuing authority must be notified of the change. Achange in
property use which makes the existing access design or use in non-conformance with the Access Code or the terms and
conditions of the. permit, may requirethe reconstruction or relocation of the access. Examples of changes in access use are;
an Increase in vehiarlarvolwme by 20 percent, or an increase by 20 percentof adirectional characteristic such as left turn.
The issuing authority will review the original permit, it may decide it is adequate or request that you apply for anew permit.
2. All terms and condltiors of the permit are binding upon all assigns, successors -in -interest and heirs.
3. When a permitted driveway is constructed or used in violation of the Access Code, the local government or Department may
obtain a court order to halt the violation. Such access permits may be revoked by the issuing authority.
IV Further information
1. When the permit holder wishes to make Improvements to an existing legal access, he shall make his request by filing a
completed permit application form with the issuing authority. The issuing authority may take action only on the request for
improvement. Denial does not revoke the existing access.
2. The permittee, his heirs, successors-In-inlerest,and assigns, of the propeity serviced bythe access shall be responsiblefor
meeting the terms and conditions of the permit and the removal orclearance of snow or ice upon the access even though
deposited on the access in the course of Department snow removal operations. The Department shall maintain in
unincorporated aruas t�re highway drainage system, including those culverts under the access which are part of that system
within the right-of-way.
3- 1"he issue date of the permit is the date the Department representative signs the permit which is after the permittee has
returned the permit signed and paid any required fees.
4. The Department may, when necessary for the Improved safety and operation of the roadway, rebuild, modify, remove, or
redesign the highway Including nny auxiliary lane_ .
5. Any driveway, whether constructed before, on, or after June 30, 1979, may be required by the Department, with written
concurrence of the apmoprlatc local authority, to be reconstructed or relocated to conform to the Access Code, either at
the property owners expense If the reconstrnicfion or relocation is necessitated by a change in the use of the property
which results in a change in the typr� of driveway operation; or at the expense of the Department if the reconstruction or

EXHIBIT A
DESIGN
1. Access shall be constructed 70 feet wide with 35 foot radii, as shown on Exhibit
"B"
2. The access approach shall be surfaced immediately upon completion of earthwork
construction and prior to being used.
3. Surfacing shall consist of 12 inches total full depth asphalt, as sown on Exhibit
"B" and shall extend from the travelled way to the right of way line. Specifications
for these materials are attached.
4. Compaction of the embankment shall comply with Section 203.11 of the Division of
Highways Stand Specifications, see attached sheets.
5. Speed change lanes shall be provided according to Exhibit "B".
6. The first 20 feet beyond the closest highway lane, including speed change lanes,
shall slope down and away from the highway at a 2% grade to ensure proper drainage
control.
7. The side slopes, of the access approach shall be no steeper than 6:1.
8. Construct handicap ramps at the intersection of sidewalks and curbs.
9. Drainage to the State Highway right of way shall not exceed the historical flow.
10. The area around the new work shall be well graded to drain, top soiled,
fertilized, mulched and reseeded.
11. If frost is present in the sub -grade, no surfacing material shall be placed until
all frost is gone or removed.
12. Owner is responsible for any utilities disrupted by the construction of this
access and all expenses incurred for repair.
13. Highway striping shall be done by the Permittee.

1. Variance of section 4.10, subsection 3 is requested to allow
Boardwalk/Harmony Road intersection not at a 90' angle. Proposed
south half of intersection is designed to match the existing
north half in which Boardwalk is not perpendicular to Harmony

Rather than matching the existing 10' shoulder, a 4' paved

SECTION 203.11 STANDARD SPECIFICATIONS
CONSTRUCTION OF EMBANKMENT AND TREATMENT
OF CUT AREAS WITH MOISTURE AND DENSITY CONTROL
The contract will show the areas in which embankments are to be
constructed with moisture and density control, and the distance below
subgrade to which such methods shall be applied. The moisture content
of the soil at the time of compaction shall be as specified or directed.
Within the areas indicated on the plans and to the designated depth
below subgrade, for the full width of roadbed in all cut sections, earth
shall be thoroughly scarified and the moisture content increased or
reduced, as necessary, to bring the moisture to the content specified.
This scarified layer shall then be compacted to the relative compaction
specified. The remainder of the area up to subgrade elevation shall be
constructed of suitable material placed at the moisture content specified
and compacted to the percent relative compaction specified.
All material in embankments designated on the plans shall be compacted
to the specified relative compaction.
Maximum dry density of all soil types encountered or to be used will be
determined in accordance with AASHTO T 99, or AASHTO T 180.
The amount of water to be used in compacting A-2-6, A-2-7, A-4 and A-6
through A-7 soils shall not deviate from optimum on the dry side by more
than 2 percentage points as determined by AASHTO T 99 or T 180 as designated
on the plans. A-4 soils which are unstable at the above moisture content
shall be compacted at a lower moisture content to the specified density.
The amount of water used in compacting all other soils shall be as required
to obtain the percent relative compaction required.
Full compensation for any additional work involved in drying embankment
material to the required moisture content shall be considered as included
in the contract price paid for excavating or furnishing the material and no
additional compensation will be allowed therefor.
The quantity of water shown on the plans may be subject to change due to
conditions brought about by storms, drought, or other causes.
Density requirements will not apply to portion of embankments, bases of
cuts and 'oases of embankments constructed of materials which, as determined
by the Engineer, cannot be tested in accordance with any of the above
procedures for determining maximum dry density. Compaction for all materials
which cannot be tested by any of the above procedures, shall be in accordance
with subsection 203.12.
The percentage of relative compaction specified shall be equal to or greater
than minimum values as shown in the following table for the various classes
of soil and type of compaction.

OTHER TERMS AND CONDITIONS:

change in use of the property which results in a change in the type of driveway
operation may require reconstruction, relocation, or conformance of the driveway to
the Access Code.
2. This access use shall continue to exist until May 20, 1990, or until such time that
a permanent access is approved, whichever occurs first.

conditions of the permit, may require the reconstruction or relocation of theaccess. Examples of changes in access use are;
an increase in vehicular volume by20 percent, oran increase by20percentof adirectional characteristic such asaleftturn.
The issuing authority will reviewthe original permit, it may decide it is adequateor requestthat you applyfora new permit.
2. All terms rand conditions of the permit are binding upon all assigns, successors -in -interest and heirs.
3. When a permitted driveway is constructed or used in violation of the Access Codethe local government or Department may
obtain a court order to halt the violation. Such access permits may be revoked by the issuing authority.
IV Further information
1. When the permit holder wishes to snake improvements to an existing legal access, he shall make his request by filing a
completed permit application form with the issuing authority. The issuing authority may take action only on the request for
improvement. Denial does not revoke the existing access.
2. The permittee, his heirs, successors -in -interest, and assigns, of the property serviced by the access shall be responsible for
meeting the terms and conditions of the permit and the removal or clearance of snow or ice upon the access even though
deposited on the access in the course of Department snow removal operations. The Department shall maintain in
unincorporated areas the highway drainage system, including those culverts underthe access which are part of that system
within the right-of-way. - -
3. The issue date of the permit is the date the Department representative signs the permit which is after the permittee has
returned the permit signed and paid any required fees. - - - - - -
4. The Department may, when necessary for the improved safety and operation of the roadway, rebuild, modify, remove, or
redesign the highway including any auxiliary lane.
5. Any driveway, whether constructed before, on, or after June 30, 1979, may be required by the Department, with written
concurrence of the appropriate local authority, to be reconstructed or relocated to conform to the Access Code, either at
the property owner's expense if the reconstruction or relocation is necessitated by a change in the use of the property
which results in a change in the type of driveway operation; or at the expense of the Department if the reconstruction or
relocation is necessita':ed by changes in road or traffic conditions. The necessity for the relocation or reconstruction shall
be determined by reference to the standards set forth In the Access Code.

5. Reconstruction or improvements to the access may be required when the permittee
has failed to meet required specifications of design or materials. If any construction
element fails within the year due to improper construction or material specifications,
the permittee is responsible for all repairs.
Design Attachment:
1. Driveway shall be constructed 24 feet wide with 50 foot radii. Width at R.O.W.
to be 24 feet.
2. The access approach shall be surfaced immediately upon completion of earthwork
construction and prior to being used.
3. Surfacing shall consist of asphalt pavement and shall extend at least from the
highway traveled way to the right-of-way line. Specifications for these materials
are attached.
4. Surfacing shall consist of 5 inches of full depth asphalt pavement on a compacted
sub -base in the area shown on the attached plan. (See attached specifications
sheet for asphalt pavement material.)
5. Compaction of the embankment shall comply with Section 203.11 of the Division of
Highways Standard Specifications, see attached sheets.
6. Speed change lanes shall be provided according to the attached detail sheet titled
"Striping, Signing and Paving."
7. The first 20 feet beyond the closest highway lane, including speed change lanes,
shall slope down and away from the highway at a 2% grade to ensure proper drainage
control.
8. The horizontal axis of the access shall be at a right angle to the centerline of
the highway and extend a minimum of 40 feet beyond the outside edge of the nearest
lane.
9. An access that has a gate across it shall be designed so that the longest vehicle
using it can completely clear the travelled way when the gate is closed.
10. The side slopes of the access approach shall be graded a minimum of 6:1 and match
existing grade at the right-of-way line.
11. Drainage to the State Highway right-of-way shall not exceed the historical flow.
12. The area around the new work shall be well graded to drain, top soiled, fertilized,
mulched and reseeded.
13. If frost is present in the sub -grade, no surfacing material shall be placed until
all frost is gone or removed.
14. Owner is responsible for any utilities disrupted by the construction of this
driveway and all expenses incurred for repair.
Maintenance/Traffic Engineer:
15. Highway striping shall be done by the permittee.
16. COPY OF THIS PERMIT MUST BE ON THE JOB WITH THE CONTRACTOR.
