Sheet 3 of 8: Overall Utility Plan and Horizontal Control Plan
• Show the existing median along College Avenue.
• Show all existing features with hidden lines.
• Clarify the limits of the new paving taking place along College Avenue.
• Please dedicate a Public Access Easement for the handicap ramp proposed along College
Avenue, since it is not contained within the street R.O.W.
• We would like to see the design of the handicap ramp included in the plan set with all of
the relevant information, i.e. dimensions, profiles, etc.
• When constructing the curb returns along Pavilion Lane, leave curb cuts for the future
handicap access ramps.
• Please reference all details used throughout the plan set.
• Please clarify with notes about what is being "constructed by others".
• Identify more clearly the limits of your construction. Lighten up the areas/items that will
be constructed by others in the future.
• Show the location of the cross-section on the plan view.

Dear Don:
Staff has reviewed your plans for the Harmony Centre PUD Final that were
submitted on February 24, 1997 and would like to offer the following comments.
1. The Zoning Department offers the following:
a. Along the northern lot line/landscape buffers, need trees placed
where adjacent to the parking lot/drives. There are sections missing
them. A minimum 5' landscape strip is needed.
b. If Circuit City is not a part of Harmony Centre, its building cannot be
in Tract A which is in Harmony Centre.
C. Trucks will not be permitted to back in from Pavilion Lane to service
the loading area serving Circuit City/Building A. Make sure there is
adequate negotiating space at the parking area to the east.
d. Assure all buildings have dimensions and show distances to closest
lot line.
e. The General Note #20 as to the Tenant's Rights to Outdoor
Storage/Sales is far too open in its language --it needs to be tightened
up.
u The general "seasonal" sales probably are OK, "But not
Limited to..." in #D needs restricting.
o Including #E--What is the size of the enclosed area --the whole
parking lot? Many of these will need a case by case approval
via administrative change.

2. The Building Inspections Department offers the following:
"Buildings which exceed 5,000 square feet in area must be equipped with an
automatic fire suppression system or be compartmentalized by fire -resistive
construction as required by Section 3802, Uniform Building Code as
amended by the City of Fort Collins
The site shall be accessible to persons with disabilities in accordance with
Uniform Building Code Section 3103 and UBC Appendix Section 3106.
Provide a designated and marked "accessible route of travel" among all the
buildings on the site and building exits and entrances and the public way
(public sidewalk). Accessible routes shall comply with ANSI A117.1-1992
with running slopes no greater than 1:20 and cross slopes no steeper than
1:50. Where routes cross lanes for vehicle traffic, they shall be designated
and marked as a cross walk. Provide parking and signs per Appendix
Section 3107. Parking and access aisles shall comply with ANSI A117.1-
1992 with slopes no greater than 1:50 in any direction.
Buildings shall be designed to comply with the Fort Collins Nonresidential
Energy Code (ASHRAE 90.1 with local amendments) or the Fort Collins
Residential Energy Code as appropriate.
Section 504 of the 1991 edition of the Uniform Building Code as adopted by
the City of Fort Collins requires that exterior walls of B2 buildings located
closer than 10 feet from a property line be of one -hour fire -resistive
construction. No openings are allowed in such exterior walls located less
than 5 feet from the property line. A parapet extending 30-inches above the
roof surface is required unless the structure complies with the exceptions to
Section 1710. Projections, such as cornices, eave overhangs or exterior
balconies shall not extend over the property and must comply with UBC
Sections 1710 and 504. The site plan shows property lines bisecting
buildings. Please correct.
Any building designed using the "unlimited area" criteria of Section 506
Uniform Building Code must be entirely surrounded and adjoined by yards
not less than 60 feet in width. "Circuit City", Building B/C/DIE and Building
I may be subject to this criteria and do not appear to conform. Sufficient year
width miust be provided at building permit."
3. The Light and Power Department offers the following:
a. E=asements for electric facilities inside of the development may be
required. A blanket easement would simplify this process.

b. On the Utility Plans a proposed water line located in Harmony Road
towards the east end of the project is located approximately 3' from
an existing electric duct bank. This line needs to be moved to show
a minimum of 10' clearance from the electric line.
C. Building I on the east edge of the project has a note stating the
electric meter is to be located inside of the building. The electric
meter should be located on the outside of the building.
d. Proposed transformer locations for all pads should be shown on the
site plan.
e. The number of street trees has increased dramatically from the first
submittal. This has a great impact on streetlights. Please refer to the
enclosed streetlight layout as a guide to relocate street trees. The
streetlights on are being placed approximately 120' apart. A 40'
clearance is required on each side of the streetlight.
f. On the southeast corner of the project we will need to install a bank
of switch cabinets. Please refer to the enclosed drawing of this
corner. We will need access for a line truck from the west through the
open portion of the fence. A pocket easement will be needed to place
these cabinets. Trees need to be relocated and the type of trees
changed to avoid growing into the equipment.
5. Please refer to the attached "redlined" plans for comments from the
Advance Planning Department. Please return these redline plans to the
Current Planning Department with plan revisions.
6. Public Service Company states that
"In addition to utility easements shown on the plat, there needs to be a 20'
wide utility easement adjoining the northerly line of Block 1, Lot 1 and Tract
"A" from the westerly R.O.W. line of JFK Parkway to the west line of Tract
"A". Paving and landscaping of site needs to be coordinated closely with
Public Service Company since many proposed natural gas lines will be within
the limits of areas to be paved or landscaped. No trees may be planted
closer than 4' to any gas line."
7. The Transportation Planning offers the following comments:
a. Resolution is needed regarding the transit pull-out on JFK.
b. Attached is a memo which addresses the design for pedestrian
crossings and improvements for College and Harmony and
JFK/Hogan as discussed by the Planning and Zoning Board at the
Preliminary PUD hearing.

C. Provide for future transit stops on Harmony by Pad 5. No
construction needed at this time, just space for a future pad site.
8. - Comments from the Engineering Department are attached.
9. Comments from the WaterNVastewater Utility are attached.
10. Comments from the Stormwater Utility are attached.
11. The Current Planning Department offers the following comments:
a. Please refer to the attached "redlined" plans for comments from the
Current Planning Department regarding the need for additional
landscaped islands. Each of these islands should have shrubs and
two trees.
b. Please provide samples of the proposed fencing material for the
garden center on Building I. Please also include daytime and
nighttime photos of buildings with the same material. Staff is
concerned that the proposed fencing is similar to that used on the
Home Depot along 1-25 near Northglenn.
C. Is Final PUD approval requested for the pad sites or will the individual
pad sites have to request separate Final PUD approval(s)? If Final
P'UD approval is requested for the pad sites, then building footprints
and square footage should be shown on the Site Plan and
architectural elevations submitted. Please refer to the attached
copy of Ordinance No. 161, 1996. If the pad sites are not a part
of this Final PUD submittal, then each of the pad sites must
submit Final PUD applications prior to July 17, 1997. Notes
should be added to this PUD submittal which clearly state that the
architectural theme and building materials of the pad sites must be
the compatible with the rest of the center. Standard corporate,
architecture will not be accepted.
d. Are all of the trees that were designated for preservation shown on
the Site and Landscape plans? The tree preservation plan should be
included in the plan set.
This completes the review comments at this time. Additional comments may be
forthcoming as the various departments and reviewing agencies continue to review
this request.
As discussed previously, it is highly unlikely that this request will be able to be
considered by the Planning and Zoning Board on April 28, 1997 due to the lack of
information provided in the utility plans.

Engineering's staff comments to Circuit City at Harmony Towne Center PUD,
Preliminary 46-96A were received on November I I,1996.
Item number 1 under "Site, Landscape Plans" requests "more R.O.W. on College Ave......
which refers to recently revised city street section plans calling for 71' of right of way on
College Avenue compared to the previous 60' requirement.
Circuit City requests a variance from this requirement based on the fact that this property
is situated between properties north of Pavilion and south of Kensington which are built
and approved, respectively, to the former 60' R.O.W. standard. To impose a 71' R.O.W.
on this "infill" property creates an undue burden upon the site due to the loss of available
acreage and corresponding limit on building size possible. Additionally, since both
adjacent sites will have aligning 60' R.O.W. conditions it makes practical sense that our
site also aligns with the 60' R.O.W.
Item number 4 under "Site, Landscape Plans" requests that loading access align with the
driveway across Pavilion.
Attached site plan sketch highlights how truck maneuvering will be accomplished
without turning motions occurring on Pavilion. Harmony Towne Center's site plan was
coordinated with ours to provide access for trucks to turn in from Pavilion heading east
adjacent Building A, then backing into the dock areas(commonly located between Circuit
City and Chandell's Building A). As shown by the truck templates trucks will be able to
maneuver on ours and Chandell's site therefore the requirement to align driveways
doesn't seem necessary.
We respectfully ask that you grant the requested variance and conclude the driveway
alignment on Pavilion isn't necessary.

As per Mike Herzig's previous comments, the intersection at College Avenue and
Pavilion Lane needs to be reconstructed to make it a standard intersection. This will
require removing the existing concrete apron on the north side of Pavilion Lane and
extending a 6' concrete pan straight across. The concrete pan cannot be obstructing the
drive lane or the turning lane.
Adjust the cross -sections at the College Avenue and Pavilion Lane to reflect the
modifications made.
