A complete review of the staff comments and redlines have been completed. Where applicable, changes
were made to the drawings. Following is our response to the comments answered in the same order as the
comments.
2. The note has been revised on the landscape plan per the redlines.
4. The mechanical equipment has been shown on the building elevations and site plans. The parapets
have been raised an additional 8 inches to screen the mechanical units completely.

Dear Mr. Goltermann:
This is in response to your letter dated March 8, 2000 (copy attached) requesting reconsideration
of the reimbursement request for S211,859.28 for the "enhanced crosswalks" on College
Avenue, Harmony Road, and JFK Parkway. Matt Baker forwarded this to me for review and
reconsideration.
It is clear from the PUD Final comments that colored, stamped concrete crosswalks were
considered important by our Planning and Zoning Board and our Transportation Planning
Department. Your designers then included these on vour site plans and utility plans, and
scheduled them for construction along with all of the other off -site improvements. Fortunately,
the crosswalks on JFIK and at the Harmony/JFK intersection were easy to construct in
conjunction with the other street improvements in those areas. The crosswalks at the
Harmony/College intersection, however, were another story. To construct these properly, your
designers and contractors had to meet all of the City's and CDOT's requirements for traffic
control, for minimizing the tragic impacts to the public, and for constructing a structural product
that would withstand the pounding it would receive at the busiest intersection in Fort Collins. I
do not believe that this was adequately anticipated, and clearly this is what caused the costs to
exceed your budget.
In reviewing the Development Agreement for this project, I can find no specific mention of the
enhanced crosswalks- The Development Agreement is clear, in paragraph I.E., that the
developer agrees to install and pay for all of the public improvements shown on the plat, site
plans, landscape plans, and utility plans- Later, in paragraph ILD.1., the items eligible for street
oversizing reimbursement are spelled out, and enhanced crosswalks are not mentioned. In
discussing this issue with members of our staff who worked on this project, no one is aware of
any other agreement made by the City that would indicate our willingness to pay for these

We wanted to expand the explanation of our request for reimbursement of an additional

SUBJECT: Minor Amendment -Harmony Centre Pad B, C, and D
Dear Mr. Rucker:
This letter is in response to your Minor Amendment application dated January 14, 1999. In that application, you
requested that the City approve a change to the building plan to allow the addition of wall mounted decorative light
fixtures.
The Fort Collins Land Use Code (LUC) Section 2.2.10 allows an applicant/developer to make minor amends of an
approved site specific development plan as long as the development application, as so amended, continues to comply
with LUC standards. Staff reviewed your application for compliance with LUC standards and for possible adverse effects
your proposal may have on the overall Harmony Centre PUD development.
It appears that the proposed fixtures are consistent with the style and character of the original pole mounted fixtures as
approved per the Harmony Centre PUD. Hence, your request to amend the approved development plan with the addition
of twelve exterior wall mounted light fixtures is hereby approved subject to the following:
1) All lighting fixtures shall be down shielded and not shine or create glare meeting LUC Section 3.2.4.
If you disagree with this decision, you have the right to appeal and such request should be in writing and submitted to the
Current Planning Department within fourteen (14) days of the date of mailing. However, subject to permit approval, you
may commence with work at your own risk during this appeal period. Please contact me at 970-416.2138 if you should

Re: Harmony Centre Enhanced Crosswalk Design
Dear Darrell:
In response to our phone conversation on May 22, 1998 about the enhanced crosswalk design,
I have provide two different options for you to consider.
Option #1: 12 foot wide crosswalk
a) The width would be twelve (12) feet wide with the outer two (2) feet on each
side being stamped and colored, i.e. two (2) foot stamped boarders. The entire
crosswalk will be concrete.
b) The boarders will be colored with Davis Color -Omaha Tan.
c) The eight (8) foot wide portion in the middle of the stamped boarders will be
striped with reflective striping as per City standards.
d) The depth of the crosswalk will need to be the same as the design depth of
Harmony Road for concrete. Please reference the pavement design for the
design depth.
Option #2: 12 foot wide asphalt/concrete crosswalk
a) The crosswalk would be constructed as shown on the approved utility plans.
However, the two (2) foot wide stamped concrete boarders will need to be
designed by a registered Engineer in the State of Colorado. The boarders will
need to be reinforced to withstand the loads being applied.
b) The striping in the 8 foot wide middle portion of the crosswalk will need to
reflective striping per the City standards.
c) The color of the concrete boarders will need to be Davis Color -Omaha Tan.
Please submit to the City of Fort Collins Engineering Department, a copy of the cost estimate to
facilitate both options.

RE: Access permits for Harmony Centre PUD
Dear Tess:
Attached are the applications and State Highway Access Permits for three access points
for the Harmony Centre PUD. Two access points are along the north side of Harmony
Road (State Highway 68) and the other is on the east side of South College Avenue (State
Highway 287). The access points along SH 68 are approximately 835 feet and 1760 feet
East of the South College Avenue/Harmony Road intersection. The access point along SH
287 is approximately 530 feet North of the South College Avenue/Harmony Road
intersection These new access points will provide access to several retail stores.
The Developer will construct these accesses as shown on the plans (Exhibit "B"). They will
also widen the pavement on Harmony Road along the frontage of this project. This is to
allow for a landscaped median, right turn lanes at both accesses, and a six-foot bike lane
along the north side of the road. The Developer is also responsible for widening the
pavement on South College Avenue in front of the project. This will provide for a right turn
lane into the site at Kinsington Drive. The edges of both Harmony Road and South College
Avenue next to this development's property will have curb, gutter and sidewalk constructed.
Also included as a part of this submittal are attachments "D" and "E," the necessary A -Line
deeds, variances and detailed descriptions of each variance as discussed at our meeting
on September 5, 1997.

Re: Additional concerns for Harmony Centre P.U.D.
Dear Mike,
This letter is to inform you of the results from our Transportation Coordination Meeting on
August 28, 1997. Present at this meeting was Tess Jones, Access Coordinator, from the
Colorado Department of Transportation (CDOT). During this meeting Tess Jones had the
Opportunity to review the utility plans for the Harmony Centre P.U.D. project upon your request.
For your information, Tess and other staff members had significant concerns about the design of
I larmony Road. These concerns include:
i. Right -turn lane onto NB JFK Parkway from WB Harmony Road
Referring to the State Highway Access Code, this present configuration does not meet the
requirements of the State. You will need to provide the minimum amount of taper length
with a ratio of 13:1. This figures out to be approximately 234 feet. The remaining 66
feel or so needs to be included in the actual length of the lane. The length of the lane will
then become approximately 323 feet. Please verify these calculations.
ii. Right -turn lane onto NB Driveway Entrance from WB Harmony Road
Referring to the State Highway Access Code, this present configuration does not meet the
requirements of the State. You will need to provide the minimum amount of taper length
with a ratio of 15:1. This figures out to be Z70 feet. Currently there is approximately 162
feet shown. Therefore, an additional 108 feet will need to be added to the taper length to
meet the Stale's minimum requirements. Referencing section 4.8.1 of The State
Highway Access Code, the requirement for the lane length, with the posted speed of 45
mph, is 350 (feet (377 feet is shown). Also referencing section 4.8.4 of The State Highway
Access Code, an additional 50 feet is required. This needs to be added to the lane length
due to the number of right turns that will be present at this access point into the site. In
summary, the total length of the lane needs to be 400 feet (350 feet + 50 feet for
additional storage) with a taper length of 270 feet.
iii. Right -turn lane onto NB College Avenue from WB Harmony Road
Referring to the State Highway Access Code, this present configuration does not meet the
requirements of the State. You will need to provide the minimum amount of taper length,
having a ratio of 12.5:1 for the posted speed of 35 mph. This calculates out to be 225
feet. Currently the utility plans indicate that there is approximately 183 feet being
provided. Therefore, an additional 42 feet needs to be added to meet the requirements of
the State. Since this proposed site is not increasing the number of right -turns at this
intersection by 20%, additional storage is not required. However, the lane length being
proposed is not adequate. Referencing Section 4.8.1 of the State Highway Access Code,
the minimum. lane length for the posted speed of 35 mph is 275 feet. Currently there is
176.5 feet being provided. Therefore, an additional 98.5 feet needs to be added. In the
end, the lane needs to be 275 feet long with a taper of 225 feet.
iv. Left -turn into Driveway Access from EB Harmony Road
We will need to discuss this item with Tess Jones at our meeting Friday, September 5,
1997. The minimum requirements for the left -turn lane seem to conflict with the double
left -turn lanes onto SB College Avenue.
There were a few other issues that were brought out in our meeting last week as well. These
include:
♦ the reconfiguration of the median along Harmony Road, particularly at the 3/4 movement
intersection,
♦ the cross -slopes along Harmony Road, and
♦ some of the striping along Harmony Road.
I had planned on discussing these with you on Friday. This way I can show you on actual
comments on the utility plans. If you should have any further questions or concerns, please do
not hesitate to contact this office, otherwise I will see you Friday.

o Due to physical hardship constraints described to you in a
N letter dated April 2.3, 1997 from Robert C. Goltermann, the
northbound right -turn lane on College Avenue approaching
oKensington Avenue will not meet the design standard described
in the :hate Highway Access Code (SHAG). From available site
plans, the distance from the future curb return on College
oAvenue to the property line carrier is 200 feet. At the posted
= speed of 40 mph, the required deceleration length is 295 feet.
o" Clearly, this cannot be achieved.
Section 4.8.1.E of the SHAC describes an alternative
design approach that includes providing only the taper and
storage lengths. This segment of College Avenue meets the
constraint criteria since there are four or more intersections
per mile per side and there is a driver expectancy of speed
changes, turning movements, and weaving movements along that
section of highway. It. is expected that the College/
Kensington intersection will meet signal warrants in the short
range future. The traffic study forecasted a maximum of 65
right turns in an analyzed peak hour. This volume would
require a storage length of 60-80 feet. Using the 60 feet as
the minimum length of the full lane, leaves 140 feet available
z fnr taper. At a lane width of 12 feet, the ratio for the
w taper will be 11.67:1. This is close to the minimum criteria
m z set forth in the SHAC.
W In addition to applying the criteria in the SHAC, I also
o consulted the AASHTO criteria for minimum braking distance in
a A Policy on Geometric Design_of_Highways and Streets, 1984.
Under wet pavement conditions, the calculated braking distance
a for the posted speed of 40 mph is 135-167 feet. It can
i reasonably be assumed that the reaction time is not
applicable, since a turn at Kensington will likely be a
F- planned maneuver. This analysis also shows that. the available
"b 200 feet is a sufficient deceleration distance for standard
passenger car/pick up truck as the predominant vehicle.

In my judgment, a turn lane and taper totalling 200 feet
will not be detrimental to the public health, welfare, and
safety. When the additional right-of-way becomes available,
a continuous turn lane should be constructed to Harmony Road.

The City of Fort Collins has requested that we complete a deceleration lane on College from Harmony to
Kensington as part of our development of the Harmony Centre. We are requesting an administrative variance
from that because it creates an undue hardship.
A portion of the property from Harmony to Kensington is not owned by us and is owned by Wayne Schrader
and operated as a Schrader Country Store. Mr. Schrader has been cooperative with us in granting additional
land for road purposes along Harmony, the south part of his property. We have also requested additional land
for the deceleration lane on College. However, the gas pumps for the Schrader Country Store are situated so
close to College that the gas pumps could not be operated if the additional lane is put in through the Schrader
property. In addition, the area is needed for safe truck turning and access.
The requirement of an additional lane through the Schrader property creates an undue hardship, if required
in connection with the development of the Harmony Centre, for two principal reasons:
1) Timberline Development does not own the property.
2) The requirement would create an undue hardship on the Schrader property because the
westerly gas pumps could not be operated causing a significant detriment to the Schrader
business.
Matt Delich has confirmed to us that the deceleration lane as we have designed it is safe and he will supply
you with a letter to that effect.
