The plans which you have proposed for Harbor Walk Estates Phase II
development have been reviewed for impact to the safety of Warren Lake
Reservoir Dam. There appears to be no adverse impact to the dam. The
proposed construction may actually improve the safety of the embankment;
therefore, this office approves of the modification.
The approval of your plans to place a fill upstream of the existing dam
for a housing platform is based upon the following conditions:
1. The volume of fill that displaces present flood storage capacity does
not exceed more than about one-half acre foot.
2. The reservoir company will need to have access for emergency repair
of the dam.
3. The platform must be compacted to 95% standard proctor density,
except for backfill of utility lines which must be reasonably
compacted with hand equipment. The material must not be highly
organic and must not be lenses of different suitable soils. A
relatively homogeneous blended soil with 5% or more fines is
desired. The embankment may be more pervious toward the upstream
face to accommodate the developer's plans for a stable upstream face.
4. Main utility lines will parallel the existing crest and will not
constitute a breach of the existing dam. The storm water drain will
be perpendicular to the present crest, installed at about the
reservoir high water line, but does not completely penetrate the
embankment, and, therefore, does not appear to pose a threat to the
existing structure.
5. You must provide a copy of the final plans to the state for
information and filing and to the owner of the dam for possible
future use to develop "AS -BUILT" drawings of the dam.

The intent of this letter is to notify you that the following haul routes
used by Connell for the transportation of fill material to the Harbor Walk
Estates Phase 11 Development have been visually inspected by the City and
appear to be in good repair.
Lemay Avenue from Brittany Drive north to Harmony Road
LeMay Avenue north to Harbor Walk Drive
Harmony Road from Lemay Avenue east to Timberline Road
Timberline Road north from Harmony Road to Horsetooth Road
Horsetooth Road west to Leray Avenue
Lemay Avenue south to Harbor Walk Drive
Harbor Walk Drive west to Harbor Walk Lane
Please be informed that the acceptance of these streets as of this date
does not relieve the Development of its obligation to abide by the
conditions of the Development Agreement should additional fill material be
required as part of this project.

Your company must insure that the embankment is constructed according to
the state requirements and that there are no significant deviations from the
plans that affect dam safety. Also, you must provide adequate construction
documentation to the State Engineer's Office to substantiate proper
construction.
The state will discontinue formal inspection of the portion of the
existing dam adjacent to the new housing platform. The State Engineer in no
way assumes any liability for the housing platform or the structures built in
connection with the development of this land.

Dear Linda:
This letter is being written to request approval for a variance from the
City of Fort Collins Street Design Standards. The project is "Harbor Walk
Estates Phase II, P.U.D," and the Gamer is United Bank.
The variance is requested for the first street curve on Harbor Walk Lane at
Harbor Walk Drive. A reduction of the centerline radius from the street
standard of 240 feet (Table 2, page T-2), to 165 feet is desired. The
standard cannot: be net because the proposed Harbor Walk Lane will not fit
well in the existing platted R.O.W..
Taranto, Stanton & Tagge feels that no safety problems are caused by this
centerline radius reduction because the curve is at an intersection where
vehicle speeds are greatly reduced.

information.

Dear Walt:
Back in October, I sent you four copies of a development agreement for the
Harbor Walk Estates Phase 11 development. The agreements were transmitted for
your processing to get signatures. You then indicated your objection to some of
the language, particularly related to requirements for the fill material hauling
operations. Therefore, I did not receive the signed agreements back from you.
Gary Diede, Director of Engineering, several other City staff members, and I
have reviewed your concerns. 1 am writing to let you know that our discussions
have revealed more concerns that we have regarding the haul operations and
the process of excavating fill material from Warren Lake. These concerns need
to be covered in the development agreement. The development agreement that I
sent you in October and which was unacceptable to you, is, for the foregoing
reasons, inadequate in addressing the City's needs as well. I will prepare new
language and send you copies of a new version of the development agreement
for your review and signatures.

Pursuant to our discussion enclosed is the suggest language
that has been agreed to by all parties with respect to the
excavation of fill material from Warren Lake. I am also
forwarding to you a copy of pages 1 and 2 of the earlier
Development Agreement with Warren Properties, Inc.
I have also reviewed your "new" standard form development
agreement and I think the agreement is fine as written if you
will insert the new agreed upon language on excavation of fill
material on Warren Lake. Further, you need to add to provision
1(c), the same language as in the prior agreement, that is: by
adding the language 11except on Lots 9 through 16 where each
structure requires a residential fire sprinkler system."
Mike Sollenberger will be available a few minutes prior to
the public hearing to sign the Development Agreement.

Language for the Harbor Walk Estates Phase II development
agreement:
E. Fill Material Hauling Operations.
(1) Prior to beginning any construction or importation of
fill material to the development site, the Developer
shall submit a haul plan to the City for approval.
Said haul plan shall include the following items:
*Proposed route
*Schedule for the haul
*Number of trucks to be used
*Load characteristics of all trucks
The City shall not have the right to disapprove a
hauling plan unless such plan violates applicable City
of Fort Collins ordinances, provided that the plan
provides that every other loaded hauling truck
emanating from South of Harmony Road shall use an
alternate route other than from Harmony North on South
Lemay Avenue to the development site. The empty trucks
shall be allowed to use South Lemay Avenue to return to
Harmony Road and points south. Notwithstanding the
foregoing, the City shall have the right to require
Developer to use alternative hauling routes for the
filled loads._ In such event, the city shall promptly
notify Seller of the alternate route and the City shall
promptly (within 30 days after receipt of the
Developer's documentation of extra cost incurred by the
alternate route) pay to Developer all extra costs
incurred by the Developer attributable to the use of
the alternate route. Developer shall submit reasonable
and verifiable written documentation to the City of the
extra costs incurred by Developer for the use of the
alternate route.
The fill hauling operation shall follow the approved
haul plan. The Developer shall be responsible for any
damage caused by the hauling operation to Harbor walk
Drive and Harbor Walk Lane. An inspection of the
street conditions for Harbor Walk Drive and Harbor walk
Lane shall be made by the City prior to beginning and
at completion of the hauling operation to determine the
amount of damage, if any. The City must approve the
Developer's proposed method for repairs needed to
return the local streets to the conditions existing at
the beginning of Developer's hauling.
Developer shall repair, to City standards, any damage
caused by its operations to Harbor Walk Drive and
Harbor Walk Lane so as to restore Harbor walk Drive and

Harbor Walk Lane to their condition as it existed prior
to the Developers commencement of hauling of fill
material.
F. Excavation of Fill Material from Warren Lake
The Developer shall take precautions to assure that any
excavation of fill material for this development at the
south end of Warren Lake is performed in a way that
does not increase seepage from the lake, if such
seepage would detrimentally affect the function of the
underdrain system in Lemay Avenue adjacent to Warren
Lake. The soils report of Empire Laboratories, Inc.,
dated June 15, 1988 and supplemented by Addendum dated
February 5, 1990, for the development addresses the
seepage issue and specifies what must be done to
prevent an increase in seepage. All construction shall
follow the procedures described in the Empire
Laboratories, inc. report. Prior to the issuance of
any building permit the Developer shall provide
certification from a licensed professional engineer,
with expertise in soils, that the procedures specified
in the Empire Laboratories, Inc. soils report were
followed and completed.
Notwithstanding anything to the contrary provided
herein, nothing set forth in this Agreement shall imply
or create a general or specific legal duty from the
Developer to the City to be responsible for the results
Or consequences of any increase in seepage from Warren
Lake unless (a) the activities of the Developer are the
proximate cause of such increased seepage and (b) the
seepage occurs within two years from the date of
substantial completion of excavation and fill of each
phase of excavation and fill activity. This Agreement
is not intended to nor does it create any right or
duties to any third parties on the part of the
Developer or the city and all legal responsibility is
expressly limited to this agreement between the City
and the Developer as set forth herein. This paragraph
shall only be effective if the Developer elects to
utilize existing Warren Lake materials for the fill,
furthermore, if Developer utilizes „imported" fill,

no effect.

RE: Harbor Walk Estates PH II
I am writing this memo in regards to the imported fill for the
above mentioned project.
The main haul route for this project will be down South Lemay
across Harmony Road continuing North on South Lemay to the
project. Our alternate route will be the same except the trucks
will go East on Harmony to Timberline, then North to Horsetooth,
Vest on Horsetooth to South Lemay, South on Lemay to the project.
All empty trucks will exit the project on Lemay and go South.
We will be using between seven to ten trucks on this project.
Then all will be able to haul 80,000 Lb. loads legal.
We hope to start on this project after the IOth of October and
finish in 10 working days.
After hauling, Lemay Avenue (just outside the project) will be
broomed and cleaned.

improvements on the City right-of-way have been inspected and
initially accepted by the City of Fort Collins pending the normal
contractor's warranty period.
Please be informed that this letter of acceptance does not relieve
the developer or the contractors, lot owners, or their contractors,
of their responsibility for the repair of any damage which may
occur as a result of the building construction.
