Dear Mr. Storck:
I have had several discussions with Mike Herzig regarding the arterial street
improvements to Drake Road abutting your development. This letter will confirm the
City's position under the ordinances and policies of the City Code for oversizing
arterial streets.
Under the standard policies of the Street Oversizing program, the developer's
responsibility on Drake Road is for the cost of the curb and gutter, 12' wide asphalt
pavement (full depth), and four foot (4') wide concrete sidewalk for the full length of
the developers frontage. The City would reimburse the developer for certain costs
incurred in oversizing the arterial street beyond this local access portion. These costs
would include additional earthwork, paving, concrete costs, and engineering to
construct the street to arterial standards.
The City is contemplating additional off -site improvements in conjunction with this
project for the property directly east of your property. These off -site improvements
would extend the arterial construction at Drake Road east approximately 400' along
property currently owned by the City Light & Power Utility. All costs associated with
this off -site improvement would be reimbursed to the developer upon completion of the
construction.
I must mention that in accordance with the ordinances of the City, reimbursements for
street oversizing are limited to funds budgeted and appropriated for each fiscal year.
This means that the City cannot absolutely guarantee that funds will be available for
reimbursement. However, I believe I have sufficient appropriations to budget for this
project. In the past, the City has never failed to promptly reimburse for street
oversizing.
