At his suggestion, we are forwarding these concerns to you for response. We have noted with substantial dismay that the land in the 4th filing, immediately behind our 3rd filing home, has been filled to a height of approximately five feet above the original surface level. This will result in the first floor of any home built: on the lot being level with the top of the fence built by Medema behind our home to screen the irrigation ditch between the filings. Adding to the negative aspects of this change in elevation is the fact that the lots behind our home are very small (6500 square feet) and that not just one but one entire and parts of two other lots actully abut our property on the other side of the ditch. When we purchased our property, we made substantial inquiry into the plans for the acreage behind us and were informed that single family homes of the same general type as in the 3rd filing would be built. In fact, the information we received was instrumental in helping us decide which borne to purchase last year. Accordingly, we invested much time and expense in landscaping our property, including the construction of a gravel pad for a deck, that proceeded under the assumption that we would be sheltered from view by the fence behind our property. Over recent months, we have attended planning and development meetings and have pursued our questions regarding plans for the 4th filing only to be reassured that although the series of homes would change, all other aspects were as before. Only when the graders began dumping and packing the fill did it become apparent that a major change in land contour was being effected. The end result of what appears to be in the offing is that we have lost all privacy in the back yard of our tri-level home. Not only does this seriously detract from property values, but it also ruins the anhience of what was previously a purchase that exactly met our needs. Curbs have already been poured in the 4th filing, making it difficult, of course, to regrade the land. Nevertheless, we would like to know why it was necessary to raise the elevation, especially since the expense of Such actionwould be borne by your customers Kirby 2 in the 3rd filing who purchased your earlier constructed horses in good faith. We have three suggestion3for your consideration regarding future work in the 4th filing: 1) Restrict use of the lots along the irrigation ditch to a green belt. This would involve little loss of land but would substantially advance property values in both filings. 2) Lower the elevation along the ditch as much as possible and restrict construction to ranch -type (single story) homes to protect the privacy of homes in both filings. 3) Raise the height of the fence behind the 3rd filing homes to maintain the level of privacy now available. This is our first experience in buying a home immediately adjacent to undeveloped land. Frankly, we have been disappointed, not with the home, but with Medema's apparent lack of concern for homeowners who have already made purchases. We have written to Medema Homes Denver Planning Office with these concerns beginning as early as November of last year. We have never received any response ,ihatsoever to our inquiries. Such action on your part guarantees that we will continue to actively support close review of not just this development, but all other Medema activities in Fort Collins. Your actions to date do not match the theme of your advertisements, nor lend credence to the good will proposed by your line "welcome home." If, as it appears, we were purposely mislead about your intentions in the 4th filing, we would at least like to know why. The end result has been patently unfair to those of us in the 3rd filing, will eventually result in cost to us when we revise our landscaping, add screens to decks, and resell the homes, and adds a bitter taste to what was up to now a enjoyable relationship with a group we considered not just contractors, but citizens of the community in aihich tnay worked. The Golden Meadows #4 6-inch sub -drain was tapped into a similar 10-inch drain by Nelson Pipeline Contractors. We believe this is the same sub -drain but recalrlend a dye (organic and non-polluting) tracer be used to confirm. There has been no reported back-up of drainage in this pipe since it has been tapped.. Water is flowing out of the 10-inch pip(, into the pond and appears to be working. I contacted Web Jones, City of Fort Collins Water and Sewer Department, and explained the 10-inch c.p. outfall location and sub -drain tap; 1%cb said it would not be necessary for the City to inspect the tap, he was greatful for the information, and pleased that we were able to utilize this existing drain pipe. Upon contacting the property owner, I learned that ,your company had installed this drive approach. This work is .not according to specifications. Specifically, the concrete was poured into the street. We require a straight lip on the edge of the gutter, and any damage to the asphalt street be patched with asphalt. In addition, the new concrete ponds water in the flowline. This letter has two purposes: 1) This is written notification to remove and replace this work to City specifications. 2) This is written warning that the drive approach you installed was done without a permit and is a violation of Fort Collins City Code, Section 95, Article VI. You should obtain a permit for a drive approach from the City Engineering office for this and any future drive approaches you install. Failure to do so will prompt further action. The first is the roll curb and walk on Dillon Court fronting 4118 and 4124. The sidewalk slopes away from the street and ponds water from the lots. This work should be removed and replaced to slope towards the street as per City specifications. The second is the northwest radius at Beaver Creek and Troutman Parkway. This area ponds water in the flowline at the handicap ramp. The curb and gutter should be removed and replaced with the correct grade to allow water to drain around the radius and into the catch basin on Troutman Parkway. Now that the pipeline is installed, the storm drainage system should be completed as per the utility plan. The following is a list of improvements that are required to be complete before acceptance of the drainage improvements by the City. From the Golden Meadows 4th Utility Plan: 1) Cut a drainage swale from Cape Cod Circle to the detention pond as per section 8-13, Sheet 7 of 27. 2) Regrade bottom of detention pond to contours shown on Sheet 7 of 27. 3) Install water -tight lid on sanitary sewer manhole GM#2, adjust to final grade if necessary. See Sheet 19 of 27. 4) Install rip -rap on inlet and outlet pipes of detention pond as per detail on :Sheet 26 of 27. From Revised Storm Sewer Outfall, Sheet 25B of 27 5) Install orifice plate as per detail. 6) Regrade detention pond side slopes at outfall pipe to contours indicated. 7) Install berm to protect ditch and pump station. The price to seed this approximately 3/4 acre pond is $550, and to mulch it with straw is $400. I have given you separate prices for seeding and mulching so that we can either just seed or do both. The seeding price includes the following; •250 lbs diammonium phosphate (18-46-0) Chisel plowing to prepare the seedbed and work the fertilizer into the root zone. -Broadcast seeding with 20 lbs smooth brome and 20 lbs tall fescue -Harrowing and hand raking to cover the seed. The mulching price would include 2 tons/acre straw crimped in. Timing on this ,project will involve frost leaving the ground and the soil drying out enough so that the soil can be worked. Hopefully this would occur in late February or mid March. I would definately like to get the seed in the ground by May 1. Once again we hope that we can be of service to you on this project. CITY OF FORT COLLINS PARKS & RECREATION DT: March 7, 1985 TO: Matt Baker, Construction Inspector FM: Leslie Stumpe, Park Planner ✓•' RE: Golden Meadows Detention Pond Park The Parks and Recreation Department is planning to develop Golden Meadows Detention Pond as a neighborhood park with construction beginning in April. I have several concerns regarding the recent work that was done to the swale along the south boundary of the park. Because of the changes made, a new survey of the elevations in the park must be done prior to bidding for park construction. It appears, however, that the contractor needs to finish grading the area along the north side of the swale before accurate elevations can be taken. I would hope that this could be accomplished within the next two weeks so that we can continue with our plans. In addition, it is my understanding that the contractor is responsible for seeding the swale. The Park Plans call for this area to be seeded in buffalo grass at a rate of 3 lbs. per thousand square feet. Prior to seeding, we will be installing an irrigation system. I would like to work out some arrangement agreeable to both us and the contractor whereby they agree to seed the area after we have installed an irrigation system. We will pay the difference in cost for our seed specifications versus their seeding proposal. The other swale, located at the southeast corner of the park, can be seeded by the contractor as planned. Continental Homes is currently storing some topsoil on the park property. We would like this removed immediately so that we may proceed with surveying. In addition, we have had complaints about the debris and garbage on the park property. Much of this looks like construction debris; i.e. insulation scraps, pipe, metal, concrete, etc. This should also be cleaned up immediately. I hope I have stressed the immediacy of the situation. Since we were not made aware of the chancres to the swale, the construction start-up time must now be pushed back. We would like to fully complete construction of the park by this summer so that newly seeded areas will have a chance to be established before fall. Last November your company had a drainage swale constructed through this area from the outlet of a 36" RCP pipe to the pond as part of Golden Meadows, 4th Filing. This was done without any communications with the Parks and Recreation Department. This causes some concern. First of all, we weren't notified and secondly, the past few months we have been working on the final design of the park. Construction was scheduled to begin this spring, however, the plan must now be revised to accommodate the larger swale. I realize that widening the swale and making the side slopes 4:1, benefits us in terms of maintenance. However, when we started working on the park design last summer, Leslie Stumpe, the project manager, received confirmation from your staff that the pond had been built as designed and had been accepted. No mention was made of any revisions and therefore, we proceeded with the design based on the existing swale elevations. Now that we must redesign the park, we will need a new (as built) drawing. If we could have this by April 15, we would be able to stay on schedule and complete the park this year as planned. If you would like to discuss this further, please contact me. Upon review of your plans, the Board substantially agrees with the feasibility of the crossing, but the Board is not willing to approve this crossing within its right-of-way until two other matters are resolved. Medema Homes has placed dirt which is spilling into the Warren Like Outle- Ditch, which complicates maintenance and violates the use of this right-of-way by the ditch company. Any obstruc- tions placed within our maintenance right--of-way or which intrude into the ditch itself cannot be tolerated. Perhaps more importantly, we have never had an opportunity to meet with properly authorized personnel of Medema Homes concerning the actual physical encroachment upon the deeded right-of-way of The harmony Lateral Ditch Company.
