Dear Glen:
This letter is being written to record the meeting regarding
the Collindale South P.U.D. held at our offices on October 31, 1977.
Attendance included the following:

The major points discussed included:
1. Mr. Johnson indicated that the ditch company could not accept
additional surface runoff into the existing irrigation system.
Consequently, drainage solutions for the first filing and the
ultimate development program should not plan to utilize the
ditches to carry runoff.
2. Permanent access to all ditches for maintenance purposes is
necessary. A fifty (50) foot easement, off -centered to one
side, will be adequate for the Warren Lake Canal.
3. Mr. Johnson felt that it may be appropriate to abandon the
Harmony Lateral Ditch through the Landings project and a
portion of the Collindale South project and to shift the flow
through Warren Lake. Such a procedure would require a perpetual
right agreement with Warren Lake Reservoir. It was also agreed
that shifting to the north a stretch of the Harmony Lateral
between Lemay Avenue and the Warren Lake Canal was acceptable.

We hope to complete the pond this winter as we have a new crew
coming in to do the work. It is now over 1/2 complete and can hold a lot
of water - more than enough for what is presently and will be developed
in the 80's.
We will post bond on this if necessary but I believe it will be
completed some time in March or before.

At the request of the President of The Warren Lake Reservoir
Company, I am writing this letter to confirm and further detail
Mr. Preston's discussion with Mr. Mike Herrick.
Where the Warren Lake Cutlet Ditch crosses over from Collindale
Golf Course into property now owned by Medema Homes, the presently
developed area between Ticonderoga Street and the boundary of
the golf course has now been totally developed and fences placed
on the west: side of the ditch to preclude access for maintenance
purposes by the company along the ditch.
Presently, development is commencing on the east side of the
ditch, and it is imperative that the company maintain its access-
c1L91i:y to the ditch and that the letter agreement of October 31,
1977 between The Warren Lake Reservoir Company and K. Bill Tiley,
as representative of Collindale South, be honored. This letter
agreement states in part, "Permanent access to all ditches for
maintenance purposes is necessary. A fifty (50') foot easement,
off -centered to one side, will be adequate for the Warren Lake
Canal." Therefore, we must insist that a total distance of
fifty (50')1 feet from near or on the west boundary of the ditch
extending east be kept open, permitting a road for maintenance
of this ditch from the east side between the golf course and
Ticonderoga Street. It is inconvenient but possible for our
ditch personnel then to cross the bridge on Ticonderoga Street
and then have on- ditch road run on the westerly and southerly
side of the ditch to the Union Pacific Railroad property.
There is not presently an established or recognizable road right -
of. -way along the ditch bank since, when this was open land, our

ditch personnel entered and drove at random as necessary to
maintain this section of the ditch. Now that development will
restrict this unfettered access, it would be preferable that
an established roadway exist along the east side of the ditch
from the golf course to Ticonderoga Street and the road then
continued along its western and southerly edge. However, if,
as other developers have chosen to do, you would wish to grass
the ditch banks on both sides as an amenity, the ditch company
has permitted this so long as there is a written agreement recog-
nizing our right to enter upon the grassed area along the ditch
for all reasonable emergencies and maintenance purposes.
Please advise us in writing as to your intentions concerning
your future plans within the scope of our request.
Parenthetically, we would like to point out to you, so as to
avoid future problems, that in developments of this nature,
utility companies often feel free to place risers, stations,
metering boxes, etc. within our needed access right-of-way.
Please make sure that none of the several utility units attempt
to do this..

Before irrigation season in 1980, Medema Homes employed a
contractor to lower a concrete pipe in the Warren Lake
Reservoir Outlet Ditch where it crosses under Ticonderoga
Street in the Golden Meadows development. The contractor
placed small rocks at each end of the pipe, supposedly to
prevent erosion. The rocks cannot stay where placed and
fall into the inlet and outlet openings, blocking the flow
of water.
It is requested that Medema Homes have the rocks removed
from each end of the pipe prior to May 15, 1981, when the
1981 irrigation season begins.
It is further requested that Medema Homes take action to
prevent storm water from entering the outlet ditch from
Ticonderoga Street.

In reference to your letter of April 20, 1981, we will comply with your request
and remove the rip -rap at the ends of the culvert for the Warren Lake Reservoir
Outlet Ditch, as it crosses Ticonderoga Avenue in our subdivision, Golden
Meadows.
The original intent of the rip -rap was to reduce the potential for erosion at
the crossing. In removing the stones, we feel that the possibility of damage
as a result of erosion is greatly increased. Therefore, we will not accept any
liability for damage to the culvert, appurtenances, or the channel due to erosion
as a direct result of the lack of any protective measures.
At this time, no storm water enters the Warren Lake Ditch from Ticonderoga Street,
which is in compliance with the original discussions between the Warren Lake
Ditch Company and University Realty, the primary developer of the entire complex
of Golden Meadows (reference, Bill Tileys' letter of October 31, 1977 to Glenn
Johnson). Also, as a condition of our purchase agreement with Golden Meadows
Business Park, we agreed to direct the storm water across the Warren Lake Ditch.
Therefore, in our opinion we have taken "action to prevent storm water from
entering the outlet ditch" as you requested in your previously referenced
letter of April 20, 1981.

a property owner downstream of the Golden Meadows development.
From his correspondence, Mr. Chandler started experiencing drainage
problems on his property after the development started in the Golden
Meadows Subdivision.
At this time I have no formal recommendation to address this matter.
The main purpose of this correspondence is to make you aware of the
matter.
I will be contacting you in the near future to discuss this matter
in more detail.

Dear Mr. Smith,
I am the owner of a tract of land located north of Harmony
Road between the Union Pacific Railroad tracks and Timberline
Road.
I would like to call your attention to a problem I now have
with surface and subsurface water being drained onto my
property from property to the west.
The drainage water enters my property from the west through
a 36 inch culvert under the tracks and runs in an open ditch
to a 10 inch outlet pipe that runs approximately 300 yards
northeast to an open ditch and eventually into Fossil Creek
Reservoir. This drainage system functioned satisfactorily
until development was started on land to the west. Most
recently additional drainage systems have been installed
creating a larger volume of water than the 10 inch pipe can
discharge. As a result my property is being flooded, creat-
ing a detrimental effect on the value of my land.
As this problem is of great concern to me, I am asking your
help in resolving it. Should you have any questions please

4. Mr. Johnson indicated that the ditch company would be receptive
to straightening out stretches of the Warren Lake Canal. This
would aid maintenance for the ditch company and may help the
developers in land planning. He also indicated that grates
were undesirable from the ditch company's point of view.
5. The developer will have James H. Stewart's office look at
drainage solutions for the first filing as well as the long
range plan. A major consideration will be the solution where
storm drainage crosses Warren Lake Canal. Proposed solutions
will again be reviewed with the Warren Lake Reservoir Company.
Mr. Johnson indicated that the ditch company requires calcula-
tions based on a 100-year storm. The ditch company's engineer
is Ellery H. Wilson in Denver.
6. The developer indicated there are no plans to alter the Spring
Canyon Canal.
7. Mr. Johnson and the Board indicated that the Warren Lake Canal
carries between 40-45 cfs.
8. Mr. Johnson stated that the county has plans to raise Lemay
Avenue on the dike as part of their improvement program. This
improvement will be delayed until the fall of 1978 at the
earliest. It is our intention to cooperate to our fullest in
order to insure that the reservoir company can obtain this
work at as little cost as possible.
We are also stockholders in the Warren Lake Reservoir Company
and are, therefore, "wearing two hats." You can be rest assured we
will cooperate in every problem area. We will endeavor to keep you
immediately informed as we progress through this subdivision.

I represent Collindale South, the owner of lands being
developed as the Golden Meadows Subdivisions. The single
family portion of these lands has been sold by Collindale
South to American Continental Corporation. Collindale South
and American Continental Corporation have processed subdivi-
sion plats through the City of Fort Collins and some of the
filings have been finally approved. One requirement of the
City has been to relocate Lemay Avenue and remove it from the
Warren Lake dam by bringing the road further to the east.
The plats which have been approved contain a dedication for
the Lemay Avenue right of way relocated as required. The
property owners are now in the process of installing the road
improvements on the relocated Lemay Avenue right of way.
These owners' responsibility for installation of road
improvements will end at their north property line. Most of
the remaining property in this section through which Lemay
Avenue will extend is owned by the City (Warren Lake Park and
Collindale Golf Course). It will be necessary for the City
to install 'the new street improvements from the north line of
the Collindale South property north to Horsetooth Road. The
City has acknowledged that it will be responsible for extend-
ing Lemay Avenue north from the north property line of the
Collindale South property.
It will also be necessary to acquire a right of way
across property owned by Mr. Ronald Bockman. The City has

also acknowledged it will be their responsibility to acquire
this right of way.
It would seem desirable for the City to coordinate its
acquisition and installation of the additional road improve-
ments with Collindale South and American Continental Corpora-
tion. The installation of the new roadway through the
Collindale South property without continuing this new road
through Mr. Bockman's property will create a very hazardous
situation for automobiles using Lemay Avenue. Therefore, my
clients have asked that I inquire as to the City's antici-
pated schedule for acquiring the additional right of way and
installing at least the improvements required to complete the
relocated portion of the road. I would appreciate your
advice as to the City's timetable on this improvement.

When the City of Fort Collins widened Lemay Avenue south of
Warren Lake, it cut deeply into the bank of the Spring Canon
Ditch, which in itself is an unlawful act under the statutes
of the State of Colorado. The ditch company has no practical
objection to this action so long as the City realizes that
by so doing, it assumes all responsibility for any weakening
of the bank: or failure of the ditch caused by the weakening
of the bank.
Unless I have heard from the City to the contrary, I will
assume the City accepts this position.

I have discussed your request for additional building permits with the
storm drainage engineers and we will honor your request.
Nlr. K. Bill Piley sent a letter dated January 12, 1980 wherein he
estimated completion of detention facilities sometime in March, 1980.
Based on this estimate,the present allotted building permits (35),
the buildinq permits pending (7),and your division manager's anticipated
rate of construction, we feel we can allow you an additional thirty (30)
building permits (makinq a total of 85) to allow Pir. Tiley's contractor
time to complete the storm water facilities. When facilities are
completed and accepted by the City, these restrictions will be lifted.

Dear Maurie:
Within the Subdivision Agreement for Golden Meadows, Filing No. 2,
specifically 5(b) there is a 55 building permit limit pending acceptance
of the off -site detention facility by the City of Fort Collins.
We will, within the next several weeks, reach this limit of 55 building
permits. The pond is substantially complete but its final_ completion
and ultimate acceptance by the City is now delayed by winter weather
conditions. Mr. K. Bill Tiley, who is responsible to complete the pond,
has advised us that he is willing to post a bond or some form of acceptable
surety to guarantee the ponds completion as weather permits.
The original intent of this language in the agreement was to guarantee
the ponds completion, and further, to guarantee its completion before
developed flows leaving the Collindale/Golden Meadows basic reached an
untenable or damaging volume. With Mr. Tiley's commitment to post surety,
the problem of ultimate completion is resolved. As to run-off volume,
the pond is sized to accommodate flows from all of the Collindale South
P.U.D. Inasmuch as a very small percentage of the development has occurred
to date, the flow volume being generated are still very minor. This
coupled with the fact that the pond is even now capable of retaining a
significant flow, makes it reasonable to expect that continued building
in Golden Meadows, Filing No. 2 between now and when the pond is complete
will not create a problem.
Therefore, we respectfully request that Section 5(b) of the Subdivision
Agreement for Golden Meadows, Filing No. 2 be waived until some reasonable
date for completion of the pond can be arrived at between the City and Mr.
Tiley. For computation sake, we estimate a need for 10 building permits
per month in Golden Meadows, once we exceed the 55 building permit limit.
